- The plaintiff rented the defendant’s house for 12 years. However, the plaintiff claims the defendant won’t return her security deposit even though she didn’t cause any damage, so the plaintiff is suing. The defendant insists the place was a disaster. The home was covered with bugs and cigarette smoke, so the defendant denies owing a thing.
Your MOM’s tenant that stayed for 12 years and didn’t trash your house and you didn’t have to advertise and find new tenants every year or renovate every couple years is priceless!!

12 years is a long time for a place to not be repainted or repaired. And the landlord was being greedy.
Even with the stain paint. If his mother allowed the smoking why should she have to pay for that? It’s dusty bc she smoked. She’s an old lady.
We lived in a rental house for 11 years and it was never repainted or the carpet replaced during our time there. I didn't fight to get our deposit back because there was some damage to the doors and walls that we were responsible for.
This case is exactly why I don't allow pets of any kind and absolutely no smoking in my rentals. It's highlighted in my lease. I had a tenant who didn't care what the lease said and smoked in the house anyway, along with her boyfriend and 2 kids. She lived there for 4 years, and I had to replace the carpet that was put in just prior to her moving in due to burn holes. The entire house had just been remodeled prior to her moving in. Every surface in the house had to be washed several times to remove as much of the yellow from the surfaces before I could even put the kilz odor block primer on the walls. If I hadn't washed them first, all I would've done is mix the nasty yellow smoke residue into the primer, and it would not cover the stains and odor. I had beautiful ceiling fans that had a large glass globe with nightlight bulbs in it and 4 regular globes. The nightlight globe was so full of smoke that I was unable to see anything through it. I had to take the fans completely apart and wash them with a toothbrush for over an hour on each globe. Everything turned to a nasty paste in the water. I had to replace all the window treatments because they were still yellow and smelled like smoke after being washed 3 time with special detergents. The kitchen cabinets had to be cleaned, primed with kilz, and painted inside and out. Every window and door had to be cleaned numerous times, I could scrap the smoke sediment off the windows it was so thick. I had hardwood floors under the carpet, and I had to kilz primer every one in the house before putting down knew carpet. I had the HVAC system and air vents professionally cleaned, and the company employees that did the work said they had never seen so much smoke damage from cigarette smoke in the system and vents. The vents were just cleaned by the same company a year earlier, and I don't smoke, so it was all from her.
I had cigarette burns on my bathroom sink, countertops, tub, my kitchen sink, stove, and countertops. If a cigarette would sit on the surface, there were stains. I never knew just how much damage smoking in the house can do. After seeing what it did to my house, I can only imagine what smokers' insides must look like. If I smoked, it would have been enough to make me quit.
Needless to say, I sued her. Unfortunately, at that time, the limit for Small Claims Court was $5,000.00. It didn't pay for all the damages, smoke, and others, but at least I made her pay for some of it. I did all the cleaning and painting myself while working a full-time job other than laying the carpet. I received 2 bids for a company to come in and do the work. Both of them wanted over $15,000.00 just to clean and paint. I guess the tenant got off easy. If I had paid someone, I would have taken her to regular court. The maximum suit amount is now $10,000.00. Someone finally got smart and raised the limits.
As a landlord, I am begging anyone that rents and smokes to please do it outside. I always tell my tenants that even though it's my house, I want them to feel like it's their home. I don't put a lot of restrictions on them, but smoking and pets are 2 of the worst things a landlord can allow in their properties. The cost of repairing the damage is not worth it. Please respect our houses so that we can continue to keep them and enable tenants to have nice homes.

im a painter , paint on walls will discolor on their own after a certain number of years , no smoking is required . she paid a deposit over 1300 and i think after 12 years she should have got back at least 1000 when u consider the interest it would have built in an interest bearing account which is what landlords are usually required to deposit the money into . the clean up that the landord had to do was worth aroud 350 bucks at the most and this verdict was far too low , she should have received twice what the verdict was .
This same thing happened to my mom! She lived in her little house renting with no problems for 18yrs. Then the landlord passed and the daughter took it over and when my mom died they tried to sue, Ty judge!
After 18 years, your mom could’ve afforded a house. Why people rent for a decade or a decade and a half I don’t understand. You can get loans for no money down and pay for a house probably the same amount you would be paying a landlord and it’s your house you’re building equity and if you have problems, you can turn around and sell the thing if you get into any issues. Renting for more than a three-year span is really student.

I completely agree that the landlord would have had to paint no matter what but at the same time when you're dealing with smoke and that was some bad smoke as you could see you can't just clean the walls and paint you have to use a special type of paint to get rid of the smell and that paint is more expensive so I don't think it was unreasonable in any way for him to ask for the stain remover he didn't actually ask for the cost of paint.
They knew she smoked when she moved in. I agree that smoke does terrible things to the inside of a home; however, they knew or should have expected the walls to look like that from a smoker.
@@NavyMommie I didnt hear that they knew but even if they did know that's doesnt mean she wasnt responsible thats why the judge said it was reasobable and allowed him to keep cost of stain remover because she said he wasnt charging for paint just remover.

Just so unbelieveable how people live. I have been overseas espsecially Germany that even in the country side humble homes are so clean. Within stairwells we saw a cleaning lady sweep and mop daily. To include the stairwell windows. This was an overall standard. Every effort to make their homes no matter how humbliing was kept presentable. I believe it is pride for what you have. No income whether low or high is any excuse for laziness.
He was very reasonable, he asked only for the special stain to cover the smoke stain, he didn't ask for the paint.
That lady was living in horrible condition, everything in the house was filthy, she probably didn't dust or cleaned any all those 12 years.

I totally agree with all the comments about the paint it really is impossible to get that smell out and cover it without a few gallons of special primer and paint and stain remover. He should get at least $250 just for that everything else he is very lucky, I ran a paint department in Lowe’s for many years and it really does cost that much in 3…. Five gallons buckets to do it, right
Landlord shouldve been able to keep it all. She was a lazy old woman and could have paid someone a cleaning fee. I had smoky walls when I moved into my condo and hired someone to paint with that special paint. JM always so cheap in her verdicts!

Yes, I agree. There will have to be a lot of cleaning done before you can even begin to paint especially since everything is coated in layers of nicotine. At least 9 years worth. Also it appeared that no cleaning or very little was done in the 12 years. I'm 69 with lupus nephritis, ra, sjogrens and spinal cord damage; lived here 11 years and my home is not in that condition. Stage 5 kidney disease the last 6 months. I don't think she deserved any money returned. At most $50.

U can't just paint over nicotine resin and it sucks because it costs a lot I don't smoke cigarettes but when I smoke I don't ever do it inside.

That isn't the law, wear and tear is on the Landlord's dime, not the tenants.
I'm in electrical sales and that fan wasn't legal and a potential major hazard. A good landlord who was regularly inspecting their place would have fixed it from when it was a problem, not tried to blame the tenant and get them to pay for it.
That the landlord seemed to do exactly zero maintenance on the house over 12 years and didn't even seem to know what was original with house or was tenant's and then tried to claim money for deposing of his mother's stuff which was with house is a tad obnoxious.
Frankly as a landlord myself I would have been embarrassed to have inherited the house in the run down condition it was in and would have fixed the house to both make up for the mother's neglect as a landlord and to protect the value of my new asset. I would also given the woman's age and health problems would have been round there to help her move out and clean the place as a thank you for being a good tenant of that length of time.
Having a reliable tenant for 12 years who always pays the rent and seemed to be completely reasonable and nice is huge asset to landlord and frankly the defendant comes across as a miserable bastard.

Smoking damage to a rental should be treated the exact same as vandalism. It's not an accident. It smells, it's nearly impossible to get rid of the smell, drywall and insulation needs to ripped it. The smoker should pay for it or choose to smoke outside. This plaintiff is a pig. If she couldn't clean she needs to hire someone weekly to clean.
They never did discuss the original agreement with the defendant's mother - did they agree that she could smoke? If that was the original agreement, then there would be an expectation that he would have to use special paint to cover up the odor. Plaintiff should have taken pics before she left - the defendant took a bunch of "close up" pics that made the house look filthy! I think the verdict was fair.

I'm wondering if there is mandatory interest to be paid on a damage deposit? Where I am, the deposit is to be kept in a separate interest-bearing account, and when the tenant moves, they get the damage deposit and the interest accrued. This is providing things are in order, if not, they receive the balance, but still with the interest.
In California you must get interest from your deposit.
The landlord was very very fortunate to have a gem stay that long . Giving the security deposit back and then some would the least that he should do, for having someone stay that long a term .
Perhaps this landlord is a newbie , and doesn’t realize how fortunate he was. He will in the future.

Why is there even a question, landlord followed the law provided reason to withhold money. Provides pictures. Smoke can destroy the fan and create more problems when painting, lady trashed the carpet beyond cleaning. Old bag never cleaned and let the place rot. This judgement was very stupid

It’s always funny when she pulls number out of her ass. $400 to clean the house and haul off major trash is a bargain. My 2000sqft house costs $200 for a monthly clean. That need a deep clean PLUS trash haul.

@@J_Greeves She probably got closer to $500 as got her appearance fee (which I believe is around $250 per person) plus the settlement payment which the landlord wouldn't have had to pay as the $200 would have been deducted from his $250 appearance. Then on top she and her companion (who I guess is her daughter?) would have had a expensies paid trip from where they are living now to Stamford, Connecticut, where they film the show. So probably a lot more than the what she was suing for.

Twelve years is a long time to live anywhere so you'd have to expect for there to be wear and tear to some degree which is why I'd never want to be a landlord dealing with tenants. But this case went better than I expected and the ruling was fair to both sides.

Washing carpets don’t get smoke smell out. I had to put up with it in my apartment for a year and then moved out because of the smell. And yeah he’s would be painting but to cover the smoke is hard to do I’m sure the smell would still be there

The place was pretty run down when tenant took it over, the fan and ceiling being a issue early on in tenancy demonstrates this.
She had a run down bungalow for 12 years with pretty much zero maintenance done on it.
Even if no-one had smoked at all in the house, you'd still be replacing all the carpets and unlay. Having restored a few bungalows over the years you'd also being stripping back the walls, ceilings and floors as well as these old places always need rewiring, relining and you want to check the timber framing isn't rotted beneath.
That this guy, who remember hasn't spent a dime on the place till now, would try and get a few hundred bucks off a lady who seems to have paid the rent on time for 12 years and made few if any demands on getting just basic maintenance done makes him a pretty worthless piece of humanity.

I don’t think the landlord should have returned any money back . She left the place a mess . Whether she lives there 12 years or 5 years. The landlord didn’t charge her for the paint or labor just the stain remover . The carpets should have been cleaned before she left and the house cleaned .

Rent needs to be free because it's a basic right for everyone to live in a house! We have people who are treated bad by landlords and it's hard enough to live without having to worry about buying food and surviving in this economy and crime filled world.

What’s with these comments? The lady could’ve easily dusted and cleaned a little more. The new landlord didn’t have a say in whether she could smoke INSIDE or not until he became the landlord. I think he deserves to be able to wash out all the damage in the walls. And clean that disgusting carpet. Yes, 12 years is a long time, but you can most definitely keep up with caring for your house.
