I had a C & P exam at a hospital that the VA contracts. She went through a questionnaire and did not really discuss all of my conditions and only spoke about 1 certain topic. I just got denied after waiting a year and I very upset especially after consistently contsating the VA to ask if there were other steps I needed or if I needed to meey with other people. I will definitely see if I can request my C & P results and see what the issue is. Very informitive and thank you so much
Did you take your own DBQ and go over the questions she missed at the end of the exam. Veterans can submit FOIA request to get a copy of their VA claims folder from VBA. Thanks for sharing and the support to the channel.
@@DewayneKimble I did not even know I could do that. I am trying to request a copy of my DBQ and then try to appeal afterwards. Although, with my listed conditions, I was unable to acquire any evidence and I do not have a primary care doctor. I had assumed I was going to be given a doctor or a check up from the VA to discuss my listed conditions, but never happened. The process is a bit intimidating and stresses me out.
Awesome video. Hearing about the process was so insightful. It’s also disheartening to hear that leadership seemed uninterested in investigating possible impropriety being done to a veteran, not to mention a fellow employee. Shameful. How much time does a rater spend on the average claim?
When I tried to bring up the issues, I was given the deer in highlight look and I knew it was up to me only to be an advocate for my claim. I just came across your video Dwayne and wish I had your representation. Currently dealing with ptsd, sleep apnea, headaches, flat feet, been diagnosed thru the VA but not rated yet.
Dwayne thanks for the information. I VA rep was horrible too. I learned that I have PTSD since Iwas in the Pentagon during 9/11. My physiologist states that I have been dealing with PTSD since 2001. I did put this in my claim in December 2019. Just waiting on my claim
Dewayne thank you for such a great video on the process and the hurdles that we face. I have experienced some of the same issues and still in the fight right now . Going to check out your website.
Thanks for the positive feedback. I just added a new educational event and will be updating my website, so stay tuned. Also, I add all events to my Facebook veteran group. Don't give up on your claim and good luck. "Always stay in the fight".
You did an awesome job recounting your claims experience. Thank you for this video, and I will be viewing the rest of videos to see whats cooking. My claims process has been..well A PROCESS. I have a claim at the BVA, received by them 3/2020, and I was told its going tom take 1yr. All because the MO.
Thanks for the feedback and glad you enjoyed the video. Good luck with your claim, I know you have been waiting awhile since it's at BVA. Thanks and good luck
Brother Dewayne, this is just plain old good information. I have been struggling with getting my migraine headaches service connected due to a neck injury 30% service connected while in the Navy. I was unloading helicopter blades and from a supply truck and was struck across the head and hit the ground face first. Was told neck injuries doesn't cause migraine headaches, by the C&P examiner. Again, thank you for this information.
Can you do a video addressing Active Component Service members and what they should do before retiring or ETSing out of the military to be successful with their VA claims? Thank you 🙏🏽.
Thanks for the suggestion. I'm doing a video tomorrow, so I will do that video next week. It will be on BDD claims. Thanks for the suggestion and don't forget to attend the live Q & A on the 12th of this month.
I was infantry and looking back on it I am kicking myself for not being seen for some injuries I sustained while I was in (did see the medics occasionally but no record of that was ever made as far as I know). Also I came back from deployment and straight into the covid issue taking off in the states so I didn't have the chance to do much but attempt to ETS. Only thing that got onto my medical records was a gnarly heat injury. That being said I still claimed what I could and the examiners I saw that were contracted out by the VA were awesome. Put that in a year ago and I am still waiting on some appointments but the majority have been completed. So far I have a rating of 20 percent for knee strain and tinnitus. No idea how long the remainder of my claim will take or if it will be favorable or not, but the process hasn't been as bad as I imagined it would be. Of course I say that now. Might be of a different opinion if everything else is denied lol
Thanks Dewayne, your persistence is a very good quality to have. I submitted a TDIU claim which is in progress and I submitted a secondary claim for migraines. VA has consolidated all of my records to include DBQ Lay Statements, VA TDIU Forms, Medical Evidence. Just waiting to see how the VA is going to rate me. Estimated date of completion is Between June and September 2020. Can you advise on the consolidation process?
Thanks for the question. TDIU is not a standalone claim. It's an increase claim for all the conditions you are service connected for that you stated keeps you from gainful employment. I hope this helps. Thanks again
@Jim Burnett Thanks for the feedback and don't give up. It sounds like the effective date is facts found on your last C & P exam. Good luck moving forward.
I had five C&P examiners (Orlando area) intentionally falsify relevant information on DBQs which automatically caused my claims to failing to get service connected. Most of their rationales directly contradicted the medical evidence shown in my service records. Their wrongdoings(inadequate exams) caused me years of delays but I toughed it out and spent my money to get honest DBQs which I had to pay for. I eventually received a 100% rating this spring but will need to appeal to the CAVC for a SMC(s) rating I deserve. Some of the C&P examiners are so corrupt! Very difficult and expensive to obtain the benefits I earned.
These horror stories make me want to be a better advocate for my fellow veterans. I am on the right track with Kilo Mike Delta! Thanks for being a true advocate for veterans! Tango Mike Whiskey out!!!
If you have a C&P at the VA it's extremely easy to get the copies, now if you do it outside the VA the form sf-180 needs to be filled and that takes longer. I wish I knew this in the past, I was given wrong information multiple times so I'm hoping to see what the rater wrote down for my most recent exam. For all, you out there follow his advice and get those copies! these people aren't your friends and can't expect them to give you favorable decisions.
I was referred for an RSVR position on April 23, 2023. I have an interview today at 3:00 for a VSR position. I’m currently a claims representative for the social security administration as a GS 11 step 7. Do you think the interviewer will consider me for the RSVR given my current 9 years experience as a GS 11?
I think is terrifying that an actual insider professional VSR had to go thru hurdles using insider knowledge. Is very intimidating for us on the outside. I just went thru my psychology C&P and he was awful in the same way you alluded. You say I can get the doctor notes at the same location or is it other VA location? Thanks
WHOA...Desert Storm/Shield Vet out of Fort Hood too. I have Lumbosacral Strain, Bilateral Hip Degeration, Hysterectomy and SSD service connected 90% overall. I have been complaining to the Doctors about my feet which are FLAT and extremely painful and stabbing pain when I walk, stand too long and getting out of a car, out of bed in the mornings is worst. I have been working as Security Officer over the last 7 years and my conditions have gotten worse. I keep getting physical Therapy appointments and nothing has changed better but rather for worse. Now I have GERD, frequent numbness in my feet and recently diagnosed with Diabetes in pre-stage. I am experience continuous Chronique fatigue and body aches. Any Advise moving forward toward 100%? By the way my work days have reduced from 5 to 2 days because I have difficulty coping at work.
Great video Dewayne! I have filed 2 HLR’s and now a supplemental claim because the raters continue to not review submitted evidence. Any suggestions at this point because they basically just denied my supplemental because I did not submit new evidence. I continue to insist on the failure of a duty to assist.
The military needs to set-up a presentation for service members who are going to be getting out with a VA representative before they start clearing so they know ahead of time what they NEED to file a VA claim if they need to.
When You record a video, your volume is too low to hear. Sometimes Eye have to turn up the volume and when an ad comes on, the volume for the ad goes too loud and Eye have to make adjustments. Is there a way for You to turn your volume up when You record Your videos?
I just got my c&p results from the va hospital. It came favorable. I understand that in the end its the raters decision. To the question, seen the section 4 on the c&p exam the doc marked "occupational and social impairment with occasional decrease in work efficiency and intermittent periods inability to perform occupational task, although generally functioning satisfactorily with normal routine behavior, serlfcare and conversation" the section 5 symptoms on the c&p exam, I have four symptoms on the 30% criteria two on the 50% and two on the 70% should I get the 30% since its showing higher symptoms in that criteria? How does va calculates symptoms for rating purposes? Thanks
I received a tentative offer for a veteran service rep (rater) GS 12 position. I don’t have the official offer yet but now I’m starting to get cold feet. I want to know all of the cons as well. I’m trying to reach out to people who actually did this job as a rater for a while so that I can know the entire breakdown. I have 14 years in the social security administration and I’m thinking of staying for some reason. I’m truly wanting to know as much as I can because I don’t want to jump into something and feel that I made a mistake
I need your expertise because i've tried everything possible for 10 years only to still be denied and someone would have to be blind not to see what is in my STMR's.
Thanks. I worked at the PEB where the USN/USMC determines fit/unfit. It was eye opening working with the VA. I know VA math very well. The CFR 18 schedule of ratings is important. It is the map for the VA rafters to determine the % of your claim. If they cannot determine they go with an educated guess. The C&P examiners need to look at the schedule of ratings and use the VAs words based on their exam. It makes it easier. MTF providers are unaware as they take of you while on active duty. Good luck and my services as a retiring Navy physician are available.
Dewayne what can I do if I have denied disabilities that I feel that should have been approved, but I cannot find a physician to write a Nexus letter? I have contacted the VHA which won’t do it, my private doctor who will not write it, and other doctors that don’t feel comfortable doing it. I’m at a loss as what I can do. I have requested my C&P exams from the VA though.
Sir! Very informative, thank you! I recently had an C&P exam and two more coming up. I don’t have any nexus letters. Will all my claims be denied because of that ?
Dewayne Kimble I see! Perfect thank you! Also I heard you mention I can get a copy of their report. How do I go about doing that? It’s only been a day since my first appt. I feel I might of messed of my feet claim. Back and knees may be good still. I have coming up headaches, GERD & stomach issues, tinnitus and my last one is PTSD. I wish I could just have a heads up on what to expect during these exams or what they’re going to ask. Most worried about my PTSD as an Iraq combat vet.
Dewayne Kimble thank you I saw! Even though all my appointments aren’t done I submitted for the findings VA said they will mail it. So, last question, I wan in the infantry it was almost not acceptable to go to sick call during basic or deployments. So I never went. I went once while on an actual mission issues with stomach and we had to stop for 2-3 days for me to get better. Other than that I never went. Will me never going to sick call while in service basically deny me of claims?

Is there a conflict of interest working for the VA as a rating specialist and filing for benefits while working in that capacity? It seems once VA veteran employees get their ratings awards to 100% because they have insider knowledge & information, they resign from the VA. I also heard that there are rules preventing “double dipping” as a VA employee so, for example, you cannot collect your full Social Security Retirement benefits which is another reason VA veteran employees leave.
It took me 4 years to finalize my claim so I don't know about the insider information. You can't get Social Security if you are working private or federal sector. Leaving any job, people do that all the time for different reasons.
Thank you for your video. What is your recommendation for a pending claim (pending since 6/2019) that has been sitting at the gathering data stage. Is there a way to request that they move it to the next stage? The VA is saying that they have a backlog and they will get to it. I have had multiple other claims that were submitted and answered within a month or two. Thank you.
If you don't mind Me.Kimble do you have an available email address and direct social media contact you can share with us, here in the Philippines it's hard to get updated information I can also report to the private doctors here in Angeles City Philippines that are mostly previous VA raters for C & P exam Doctors here or previously worked in FMP funded clinical work that went private.
I had an examiner decline my exam because SHE didn't have a chaperone. But in my claim she wrote that I declined the exam. I have an appeal in for it. So my question is should I have appealed it or file a disagreement.
My experience with the VA process when you file a fully developed claim however they take you fully developed claim and make it your primary claim and Rachel Rachel fully developed claim as a primary claim to deny unemployability how do I overcome that
Sorry to hear your struggle but get educated on what a FDC claim is and how IU works. There are so many veterans that do not understand IU. It's not as easy as many think.
How was you were able to get a 30% rating for PFB , I have all the documentation in my military records and every time I go to a C & P thru QTC it doesn't get increased . I haven't seen a VA doctor for it. Should my next move be for VA doctor or should I go to private medical ?

Requests like that pertain to the VA’s duty to assist. They are basically looking for or requesting more information from different sources that may support your claim. For example, if you claim PTSD & cite a stressor event, the VA liaises with JSRCC (US Army & Joint Service Records Research Center) to find reports filed in the past that corroborate your story. If they cannot find any documents, the VA sends out a Request which means you must submit extra evidence or a statement with as many details as possible to support your claim (sworn lay statement, newspaper articles, witness/buddy letters, police reports etc.). That is what a Request 1,2, 3, etc. may mean on va.gov or ebenefits. You usually get 30 days to provide additional evidence. You don’t have to, in which case after the time limit lapses, they close the request. If the VA uses a lack of evidence against you to deny your claim, then you can file an appeal or complaint citing the veterans law case Arizona vs. Shinseki which states the VA may not conclude that an in-service event did not occur due to an absence of records or a veteran’s failure to report the incident. In other words, they should give you the benefit of the doubt.
Basically you’re saying you actually start high in your rating process and then start deductions based upon criteria? Whereas many start their rating at zero and work their way up...
That's the way I looked at the claim. I still had to follow guidelines to grant or deny any claim. I don't know how other RVSR's viewed the claims that landed on their desk.
I just always wanted to know its quicker for a murders to get sentence to life in prison then it is for a veteran that served his country to get his disability?
Ten plus years ago, there were longer wait times but in the last couple of years, the VA has done a better job improving their process to decrease the long wait times.

@@DewayneKimble Hi Sir, I have actually had this very thing happen to me as well. The VA Doctor/C&P Examiner flat-out told me that she doesn't think the DBQ from my IME should be considered by the VA and that she would be doing a Legal Examination. In the VA Dr's notes, the stated that my private DBQ should not be considered valid nor hold any value... then she goes on to downplay my conditions. My initial claim was filed in 2009, it is 2020 and I am still battling them to service connect things that are in my C-File and for things that I have witness statements for (buddy letters). I have another C&P scheduled for this coming Monday (June 22, 2020) at VES. Funny thing is my first C&P was through VES and I got denied for childhood stuff, then I filed a supplemental after complaining about the VES's examiner only seeing me for 10-15 mins then making stuff up in the notes. So, I received a request to see a VA C&P examiner.... I had two 4 hour sessions (separated by 1-2 weeks) with a VA Dr. who belittled, berated and interrogated me only to deny me, label me a malingerer and side with the VES. Now that I am in my HLR, the rater requested a C&P (even though I have a private DBQ on record) and at first I was scheduled at the VA again but they cancelled it saying it was a conflict of interest. Then I was scheduled with VES and the very same Dr. that I saw the first time.... So much for un-biased review of HLR (de Novo) right... I had to complain and call the hotline so many times just to get them to play fairly. Anyway, the information you have provided in your videos is Gold and I will recommend you to any of my brothers and sisters in this fight. Thank you.

Thanks for the feedback as it is much appreciated. You can go to my website and set up an free 15-minute consultation so we can discuss.
Thank you for the information.

Thanks for sharing and good luck moving forward with your claim.
Your story here reminded me why many Veterans hate the C&P Exam. Examiners can be completely bias and lie on their statements.
It's crazy but I was able to make it through.
Thanks so will it really seems like hit and miss on your VA Claim whoever's your rep is. I will email you. An amazing video very helpful

@Jim BurnettDate I submitted my intent to file.

Ok, it is on the list.
Thank you for sharing.
No problem, enjoy educating veterans.
Thank you.

As stated in the video, this is a one time benefit. You can call their 800 number to confirm or see if there has been in changes.
What does “We closed the notice for Request 1” mean?
If that statement is on ebenefits, that is not managed by VA employees that develop or rate claims.
@@yayagazab4449 Sounds like you have VSR experience "duty to assist, "JSRCC" or maybe an RVSR if you know about "Arizona vs. Shinseki"
Basically you’re saying you actually start high in your rating process and then start deductions based upon criteria? Whereas many start their rating at zero and work their way up...

I just always wanted to know its quicker for a murders to get sentence to life in prison then it is for a veteran that served his country to get his disability?

I have actually had this very thing happen to me as well.
