It is meant to be that way. Judges need to be independent of the government. They follows laws and legislation however the government cannot get involved by removing power as then it would not be independant and would be conflict of interest due to the state bringing the charges and if you allow the state government to tell Judges to do this you have too then that is a massive conflict of interest. The only way to introduce min sentences are law changes but Judges need to have independent power.
If you start picking and choosing who has rights and who doesn't, then the system doesn't work. "Oh well he's charged with murder"... Keyword is 'charged', not convicted.

Keep alleged murderers in jail? How about we keep CONVICTED murderers in jail and speed up the process of integrity and justice to figure out IF an alleged murderer is actually innocent or guilty. You must be white.
This story is about getting it right and those overseeing our criminal justice system being honest in their pursuit of justice. Neither Sheriff Dart or the judge, in this case, were honest. This man clearly and factually did nothing wrong to violate the terms of his monitoring and had video proof. The device malfunctioned. It's called "drifting" when a signal goes wayward, away from the device and the towers lose the exact location. The man was secured and the community was safe. Dart & the judge, the elected professionals who are expected to uphold justice on behalf of the taxpayers, failed to do their job competently in their elected roles.
We give WAY too much power to judges, many of them are irresponsible and corrupt, we need to make huge changes in our justice system.
