      This company wants to hire me as a 1099 driver. I’ve never done truck driving as a 1099 driver. What will be my expenses? Do I have to pay for fuel, repairs, insurance?

    Why are there so many trucking companies publicly advertising they pay 1099 when all of their terms clearly label their drivers as non IC's? Why is there no enforcement of this?

      Those people are the treason AB5 exists! If they wouldn’t have been trying to cheat the system California probably wouldn’t have AB5….. which put a lot of legit owner / ops out of business from what I’ve heard. 🤦‍♀️

      They agree and no one reports them. If they drive as a company driver meaning they are not purchasing your vehicle on a lease purchase program they are all supposed to be W2 employees but many drivers agree because they believe they can benefit from the 1099. But it’s illegal if they are driving your vehicle not buying it they are supposed to be an employee

    If my driver has an LLC and he signs an independent contract agreement with my company with specific stipulations that distance his driving for my company as an employee, it should work. Its a thin line and the feds have the last say, but I'm going to at least try it for the 2023 tax year. Plus, the turnover for drivers is crazy, that would be a lot of paperwork if you have a high turnover, reporting terminations and new hires. I will make sure I have enough to cover if the feds disagree, but I'm banking on the agreement, and advising my drivers to form an LLC to perform "driving" services for my company. Similar to a chauffeur.

In the process of hiring a driver. I got someone interested in the job. He has 20+ years of experience. Advice on what to do next. Will appreciate.

    The carrier paying for fuel, repairs, and insurance for a 1099 contractor may get flagged as well.

    So this job I’m looking at. I’d fall under the W2 category but I’d be being paid as a 1099. The owner would ask me to crest a scorp. There for I can claim a few things but not thing substantially enough as a owner op. This sounds like I’d be taking a risk of getting hit by the irs is this correct?

    So what if the broker instructs the driver what to do and where to be, he decides when and how to move. But he’s using my equipment and the financial risk is set on me?
