    I think it's important to include casinos in the restricted list since we do have a good amount of them in PNW(which yes are part of liquor control). Some casino establishments have attached hotels and some of the casino/hotels consider the hotel part of the casino and don't allow Firearms. Example- The Angel of the Winds casino/hotel does not allow Firearms in either sections. But Tulalip Resort and Casino do offer a safe that is outside of your room but that is accessed only by Casino Security (under specific watch by control) at the request of the hotel side for storage if a long gun/handgun. You can store handguns and ammunition in your hotel room. There was never a minimum or max amount of ammo or number of firearms discussed while I was working at that property. Of course this was meant for the hotel guests specifically but I have seen a casino guest voluntarily give his EDC for storage while he gambled, which they gladly stored it for them. They were escorted to the safe and in Clear view of control and while unholstering it, removing mag and keeping pointed at the ground. They allow you to unchamber and allow you to put into the safe.

      Not only that, we need to teach people to not be too afraid to exercise those rights. I’m mostly talking about 4,5 and 6 because people think using those rights is criminal, rude, asking for a beat down/tasing or flatly don’t know that they exist. It’s sad and disgusting.

    If I am hiking in Washington state with a pistol, that has a magazine above a capacity of 10 rounds that was obtained before the ban, can I still open carry that pistol? (as a non resident who is visiting)

    Can't be loading either if you're an out of state and also if you're a WA resident that doesn't have a CCL.

    30 years LEO here. First, thanks for the video. A lot of great info. Having rubbed elbows with the less than savory for three decades as a Cop open carry is not something I choose to do. The absolute last thing I want a crook to know is I am strapped. Sure, the sight of someone wearing a pistol might scare away some lower offenders but in my opinion it makes you a target for the hardcore crooks. I saw a pic of a guy wearing a pistol stuck in his belt at a Subway. As he is concentrating on whether he wants his sandwich toasted or not a hardcore armed felon could come in, see the gun and think he is has entered a bonus round. Not only does he get the register money, he gets a gun as a bonus. Those of you who think they can pull and beat an armed suspect already pointing a gun at you are in a dream world.
    The second crook is the one who sees you carrying and follows you. Eventually you get to a place you can’t open carry and you have to leave your piece in the car. As you are getting your FroYo with sprinkles the crook breaks into you car and takes your gun.
    Carrying a firearm is about personal and weapon security. The less people who know you have a gun the better. Open carry takes away your ability to surprise an assailant and lets the bad guys know where there is a gun to steal. In this old Law Dog’s opinion, if you are willing to degrade you own safety by displaying a weapon just to “own the Libs” you are in effect shooting yourself in the foot.

      Great comment, on top of this, are the violent criminals really concerned with following the law or are they going to conceal so they can get an edge? So the restrictions against conceal largely hurt the good guy.

    This video is a few years old but moving every few years, I always have to research reciprocity and legal methods of carry. Luckily, I carry primarily on a Florida license and even more luckily, most of the country allows concealment and OC with no permit. That said, I’ve acquired licenses from multiple states to get over the hump posed by reciprocity problem children like WA. The specific answer to crack the nut of WA is UT, which I keep current just in case I have to move there or somewhere that license has an advantage over my primary license for a few years.

    What about open carrying in the countryside on public lands - like national/state parks/forests… in the past, I’ve encountered armed people on the pacific crest trail and enchantment lakes trail out of Leavenworth. Holstered in all cases. Didn’t bother me, but I rather imagine some would get pretty freaked these days if they encountered a lone hiker with a 10mm in a cross-draw chest holster for example. There are times I’ve wanted to carry an 1895 carbine on hikes for the hell of it, but haven’t just to avoid any weirdness with people or even with rangers who might take issue with something. When I hike now, I always carry concealed (with CPL) for this reason, but it is a pain because the center chest holster is the most convenient carry mode when running a frame pack.
    I’d also add that I have >10 round pistol mags purchased before the ban, but I’m hesitant to hike with them for fear of a law enforcement officer or ranger raking me over the coals. Does a person have to dredge up and have the receipts on hand to prove they’re legit? Or is that only scrutinized in the context of buying or selling the magazines. I avoid the whole thing by running

    Just searched thru all washington state's rcws. They were extremely vague on open carry. Their job is to inform the public of laws. Not just enforce them

    I open carry because it takes over 7 months to get a CPL in Washington, yea it makes people uncomfortable but I dont care, i dont have a choice

      It took me 2 weeks the first time and it has only taken 1 week to get my renewal cards. I have had a CPL for 21 years but I am in Eastern Washington.

      Washington is a shall issue state. They have 30 days to issue if you have lived here for 90 days and have a valid washington state ID. They have 60 days if not. RCW 9.41.070 is very clear.

    If I can’t have a gun loaded in the car in Washington, that would mean I can’t open carry in my car. That means I’d have to get to my location put the mag in, unholster the weapon to put one in the chamber and then put it back. I’m sure that could pose an issue for having to unholster it and load it, but I’d be forced to because I don’t have a cpl in Washington yet as I am out of state and have a Florida ccw. How do I go about legally arming the gun to go on a hike in Washington if I want to open carry.

      Once you get to your destination for your hike…Arm yourself openly….Open Carry is legal in Washington State as long as you are not a felon or barred from owning a firearm..

    Thanks for making a video and uploading it to such an accessible platform. Ever since COVID, or even a few years prior, it's been nearly impossible to find information using search engines. The only results I get are anti-gun rhetoric and articles about tragic misuse of firearms. I asked my attorney some simple questions about our local laws a couple years back, and turns out he doesn't support gun use at all so he just told me I'd have to find someone who specializes in this field. Like, my man, you're literally an attorney, turning down my money. So thanks to people like you who actually look out for your people. Hope you're doing well and may the wind be ever at your back.

    I live in Oregon and I open carry every day and have for over 20 years and did for over 25 while living in Washington State, where I was born and served time as a Reserve Police Officer for the city and the county. I make a yearly trip, every summer, to Washington for a family get together. I am licensed in Oregon and remove my pistol/unload just before entering Washington. When I get to my destination, I reload it and open carry while there, not for show, not for anything else but self defense for me and fellow citizens. I do not have a CPL for Washington and this is the only way to do it lawfully, my destination is only 28 miles across the river, and I will not take the chance of breaking the law and losing any of my 2nd Amendment rights for that hop, skip and jump! There are many opinions about Open Carry vs Concealed and that is all they are…Opinions…every one has one and not all agree. So, Do what you feel comfortable and safe with, know the laws and live the way you want..your Constitutional Rights do not end where others opinions begin….

      @pnw224 Are you asking about Oregon or Washington? I wouldn't do either without a CHL or CWP..If you get caught with a loaded magazine out of the gun and both are in reach of the driver, it could be up to" officer discretion" and considered loaded...both States I believe, for vehicle transport without a CHL or CWP require the pistol to be locked or stored in an opaque container out of reach of the driver and preferably out of sight....the ammunition stored separately. However, as strict as oregon is with its CHL... There are no such laws on the books about rifles or shotguns... They can be loaded, and you are not breaking any laws if your favorite AR or shotgun are in your vehicle and loaded.

    Primary Question - Could the RCW 9.41.270(1) be used improperly to allow those to take the stance of feeling intimidated or warrants alarm just by stating "I am intimidated / this warrants alarm" upon seeing the firearm on the person waist, holstered?
    I know there always be those anti-2nd that just claim it, but what about those that have no exposure other than the negative they see in the news.
    I have spoken to some people that have not been exposed to firearms in general and have an initial prejudice just by seeing them. The sight of guns has lost its normalization through many variables and laws that require them to be invisible and because of this, some 2nd advocates are attempting to re-normalize. Some 2nd advocates state open carry, is ideologically good but tactically dangerous.
    How do we find the balance to keep people from feeling intimidated / warranting alarm?

    Im a bit confused about this. So if my old neighbor lady sees me open carry and im completely safe and never touch it. If shes scared i can get in trouble with the law? Seems kinda messed up. Like how can you be safe open carrying if any random person who sees it can decide whether or not its illegal?

    I think it is extra important we do things like open carry in places where we know residents are extra sensitive. They need to get comfortable with the fact that open carry is lawful. And quite frankly, f&$% their feelings. I won't change my behavior for their feelings and I shouldn't be asked to. If the store we are in gets robbed I will happily save their life the way I would my own daughter so I really don't care if my gun scares them.

      @@boris5693 in glad you taught someone something new but it's important we get that info exactly correct. This is an open carry state. It is not a constitutional carry state. They allow us (their thought not mine, it's a right) to open carry. They require us to get permission to conceal carry. However, Thanks to Bruen, it will only take one person getting "caught" concealed carrying without a license, willing and able to push the issue, and this could be forced by the appeals court to be a constitutional carry state or the Supreme Court could force the country to be a constitutional carry country. Meanwhile I believe there are 26 states that have wording in their law that reinforces their citizens right to "bear" arms. Washington is not one. I personally haven't renewed my ccp in like 10 years...

    What are my rights when I open carrying lawfully and are harassed by other shoppers or they famous yell he's got a gun when iv done nothing wrong other than just going about my business shopping etc it does happen what are our legal rights as far as someone else causing a disturbance in public. iv tried to conceal carry to avoid this unpleasant situation it's just to uncomfortable and I have a hard time doing it for my body type

Boise and Coeur d'Alene are not far behind. They concentrate in the cities and, from there, rule (mess up) vast swaths of the rest of the states. The rural communities hardly know what hit them and it seems that one moment they are free and the next, they are not.

    In addition to the 2nd Amendment of the US Constitution, every gun owner in Washington should be aware of Section 24 of Article 1 of the Washington State Constitution: "SECTION 24 RIGHT TO BEAR ARMS. The right of the individual citizen to bear arms in defense of himself, or the state, shall not be impaired, but nothing in this Section shall be construed as authorizing individuals or corporations to organize, maintain or employ an armed body of men."

    So whats the point of carrying then if restaurants are off limits and vehicles are off limits. As someone visiting the state thats the ONLY places I would be. If I’m walking around a town and we decide to pop into a dive for some food, where are you supposed to put your firearm? Regulations against law aboding citizens, meanwhile murderers and thieves will do as they please and the police will be too busy to help anyone in real need. Let alone give two shits.

    I have done so many times in Clark County. And seen others doing the same. The average member of the general public is oblivious and caught up with them selves to notice. I have only had positive interactions when i do it. Mainly its im heading to shoot or going to do something that i would have it on me anyways. Not doing a "audit"

    I have (two) back to back non violent felonies from the State of Texas from 1980 when I was only 20 years old... and I've stayed out of trouble ever since. I moved to Washington State in 1990. Question: Can I purchase and own a firearm in Washington State?

      Not without first applying to get you right to own a firearm back. Basically go before a judge and make the case that you weren't a violent when you were engaged in criminal activity, and that you haven't been in trouble in 40 years. Its a hassle but I know a guy who went through it.

      @@xxskitsxx15 That is specifically prohibited by law in Washington State, which uses the definition found in Federal law. The cartridges are primer-fired making the conversion into a firearm. Using black powder is not what defines those cap or flint ignition systems. Read the RCW. Also, federal law (26 U.S. Code § 5845) includes a section defining "antique" weapons and states: The term “antique firearm” means any firearm not designed or redesigned for using rim fire or conventional center fire ignition with fixed ammunition and manufactured in or before 1898 (including any matchlock, flintlock, percussion cap, or similar type of ignition system or replica thereof, whether actually manufactured before or after the year 1898) and also any firearm using fixed ammunition manufactured in or before 1898, for which ammunition is no longer manufactured in the United States and is not readily available in the ordinary channels of commercial trade.

    What I haven’t found is an RCW that addresses whether there is a legal requirement to identify to police if the only reason for the stop is the open carry.. any thoughts?

      Obligatory not a lawyer but if you’re carrying and a cop asks for ID, you should provide it. They’re trying to make sure you’re not a felon or prohibited person carrying. While being a legal carrier, it’s inconvenient sure, but it’s also how the cops protect the public from people who shouldn’t be carrying.
      Plus when you start butting heads with cops for no reason, you’re just making a simple ID check escalate into something else. Give ‘em your ID, thank them for their time and you’ll be on your way

    Do I need a holster displaying the whole gun or am I able to put it on my wasteband with my shirt tucked behind the gun? I used to have it in my back pocket where it shows the same about of the pistol as it would In front of me on my waist

      You can carry "open" however you wish. But tucking it into a waistband or pocket is not the preferred method. Spend a few dollars and get a good quality holster made for that particular firearm.

    No, you have not made certain aspects of this clear at all, nor do the laws. You are implying, but not definitively stating, that open carrying in a place where a given resident feels threatened is not lawful. While the applicable statute first cites an intent to threaten as the test, it seems to primarily rest upon subjective perception. Some person can feel threatened at any time by the mere presence of an open carrier, whether the locale is in some rural county in Eastern WA or on Seattle's Capitol Hill. This gets into ref flag/prior restraint areas. I agree with others here, as a practical matter in both laws and tactics, that open carry is unwise. But threat perception in turn naturally leads to concealed carry scenarios: what if a person feels threatened merely by someone being licensed for conceal carry, i.e., they find someone's very presence or demeanor threatening, and they suspect with sound basis or without that said person may be carrying a firearm?

      Yes. They can pretty much even tell you that you either need to put your weapon away, or leave the area. It's easy enough for them to claim that people are feeling intimidated and the laws are written as such that there's significant room for defining brandishing/threatening. Now you can't really be arrested just for peacefully open carrying, because it is legal, but you can definitely be asked to stop pretty easily. And if you resist then it can quickly become an issue with trespassing, resisting, brandishing, or the catch all for when police just want something to get you with because it's so vague: disorderly conduct. And remember anytime you have a firearm in the mix, it tends to be used to elevate things from like a basic trespassing to something really nasty like aggravated trespass while armed with deadly weapon. Pick the hills you want to die on very carefully :)

After the Civil War open gun carry was restricted to military style pistols frequently owned by ex-confederate soldiers but unnafordable for poor black people. The Ku klax Clan were early supporters of gun control particularly the possession of guns by black people. One important part of American life, Jim Crow continues to thrive-the legal foundation of restrictive and oppressive gun control that was built by Jim Crow. The Jim Crow cases continue to hobble the Right to Keep and Bear Arms.
    Shockingly, the Jim Crow laws and legacy are lauded by some persons who consider themselves liberal and tolerant. In the 2010 Supreme Court case McDonald v. Chicago, Justice Stephen Breyer wrote a dissent that asserted that District of Columbia v. Heller should be overturned, and that state and local governments should be allowed to ban guns. Justices Sonia Sotomayor and Ruth Bader Ginsburg joined the dissent. That dissent included a litany of restrictive American gun control statutes and court cases, many of them the products of Jim Crow. Previous issues of America’s 1st Freedom have told the story of how the defeated Confederate states enacted the Black Codes, which explicitly restricted gun possession and carrying by the freedmen. Sometimes these laws facilitated the activities of the terrorist organization Ku Klux Klan, America’s first gun control organization. The top item on the Klan’s agenda was confiscating arms from the freedmen, the better to terrorize them afterward.

      Open carry with a round in the chamber is perfectly ok, and many will tell you the preferred and proper way to carry. But that is a personal choice. If traveling with a handgun, and NOT having a CPL, the manner in which you describe carrying would be totally legal. IF, however, you have a valid CPL, you can carry that handgun loaded in the car.

      Someone at a gun store told me I can't have mine within reach and readily usable without the concealed license. Making it pretty much useless if it's truly needed.

    Not really clear. Open carry is legal, but not if someone feels threatened? So some anti could call police, claiming they felt threatened, and legal open carry can get you in trouble? This whole open carry is nuts! On one hand, the Wild West is OK, but concealed carry requires a permit? Huh? So, a criminal might get away with open carry for years, and the public never has/had a clue about the monster among them? But the good citizen is forced to go through the examination for a concealed permit? One might also consider, at least with open carry, others are aware of the weapon, while crooks carry concealed at will! Again, this whole thing is crazy! Then, even with a carry permit, one can walk into a gun store packing a loaded firearm, but still must pay a tax, pass a background check, take a course stressing suicide, and wait 10 days to get your new gun. Nuts! Why does anyone with a concealed carry permit have to go through that? I could see presenting your permit at purchase for a quick look-up if you're still a good guy. This is all BS. Because criminals do not care about laws. They will get a gun one way or another and carry it! This is more about punishing law-abiding citizens and making things so confusing that an attorney is needed to figure things out! I like simple solutions. At a certain age, get a gun license. Pass a course? Just like a driver's license. Then, with your gun license, buy any gun you want. Carry anyway you want. Just like with a car which might be used to run people over. Then, make punishment for deliberate firearms abuse serious. Like commit a deliberate violation... using gun to rob someone, and so on... like 10 years in prison! Society educates Sheeple how to drive. Educate the Sheeple about guns. Then throw the drunk drivers and bad gun apples in prison! Let law-abiding citizens be free!

      @@Fatboyqt No. The firearm just needs to be unloaded if you do not have a valid concealed pistol license while in an automobile. Whether you have the magazine in your pocket or next to the firearm whether the firearm is in the cup holder or the glove box or the center console it doesn't really matter. And no you do not have to inform law enforcement if you have a firearm in your car however experience has shown me that law enforcement greatly appreciates knowing that upon contact.
