Please note, in order to provide some more time to the taxpayers, the date for linking PAN and Aadhaar has been extended to 30th June, 2023, whereby persons can intimate their Aadhaar to the prescribed authority for Aadhaar-PAN linking without facing repercussions!!!
False news . Last date without 1000 payment was 30th June 2022. This year with 1000 payment u can link it till 31st March 23.

Why don’t the banks link from their side as they already have both information of customers. They should automate the process. What if there are some illiterate people & old age people how will they approach and do it. Specially Indian govt banks are still not digitalized and automated. Lot of manual work they do and customers keep waiting on the counters.

OTP comes to any Indian number which you enter at the time of linking... if you have any friends or relatives or even your tax professional can lend their mobile number for this process...

Dear NRI clinic, Thank you for your utmost care. I have two queries which probably will pertain to many of NRI/OCIs like me
(A) I have already my PAN and Aaddhar linked in IT website. But problem is that I am now a OCI since last 3 years. So what should I do since Aadhaar is not relevant for OCI who is not living in India.? Is there a process for returning Aadhaar card ?
(B) 2nd issue is that My Current overseas address, Address in PAN and Aadhaar card address are all different. In Aadhaar an old Indian address is mentioned. How to align them all ? Can this be done online from Overseas?
If an NRI doesn't have Aadhar ever but has only PAN which is 10 years old...then what to do???

Changing the jurisdiction of the PAN card from local to International could take up to 6 months as per your comments around 20:38 and not only that, there is a lot of formalities and follow-ups to be observed. For NRIs/OCIs this is practically very difficult to accomplish as Indian Tax dept demand all paperwork to be done on hard copies with affidavits/notarization rather than emails or online.
I have couple of queries on this matter -
1. While the PAN card jurisdiction is updated in the system, would it become "inoperative" during this time which can take up to 6 months ?
2. Wouldn't it be simpler just to obtain an Aadhar card (even without being in India for 182 days) and then link it with PAN card in the system ? Getting an Aadhar card takes much less time than 6 months.

India has gained and so much more to gain by relaxing rules and welcoming foreigners and NRIs. Decision makers could evaluate the enormous gains to be had. When people visit they spend a lot of money, this boosts economy. The more people visit the more India has to gain, the longer they stay the better for the economy. Allow long stays as a tourist without tax responsibility. All kinds of rules prohibit the enormous potential. India is not among the top visited countries, not even in the middle of the barrel, its I think is at the bottom of the barrel, having so much to offer its hard to believe.
A field in PAN details which is probably accessible only to the IT department indicates that a person is an Indian citizen. This is how they are able to identify that it is not necessary to link the PAN card to the Aadhar card. For OCI card holders it would indicate that the person is "NOT" an Indian citizen so would that not suffice for the Income tax department to automatically identify and change these card holders to International jurisdiction?
The issue here would be, how IT authorities come to know the citizenship, if after obtaining PAN, if there is a change in citizenship? It is to be noted that even if there is change in citizenship, PAN will remain the same & only updation of citizenship can be done in back-end of system by jurisdictional officers, for which the OCI's must intimate them

As per my knowledge, there is neither a provision to surrender nor a provision to cancel Aadhar.. it will remain perceptually...

This is the information from incometax website, now i'm confused. How to link aadhar and pan if I dont have access to the Indian mobile number.
IMV - the income tax website which has the above wording, does not contain full information... Hence, the link for entire notification no 37/2017 dt 11th May 2017 is given in description box below the video... you can check the same.... To link PAN & Aadhar one can take help from their friends & relatives or even their tax consultants, who can give their number to get OTP.... For linking purpose, it just wants one Indian mobile number for which OTP will come... that mobile number need not be the one which is mentioned in Aadhar
I have received an answer from the authorities that Indians who are citizens from another country with or without OCI need not link their PAN and Aadhar as it is mainly for Indian citizens and NRIs with Indian passports. My Bank in India also told me I cannot apply for Aadhar as I am not a citizen of the country now.
Yes, it is correct… but the computer system (PAN database) must know that you are not a citizen of India… make necessary arrangements for such correction/updates in your records
An NRI who was eligible for ITR Refund has filed ITR. But This NRI didn't have Aadhar as it was not mandatory for NRIs to obtain Aadhar. Now in income tax portal his PAN is showing as inoperative and message is being displayed that Refund will not be issued due to non linkage of PAN with Aadhar. What to do in such scenario ??

Yes, Please check the notification dt. 20th September 2019 which mandates NRI's who are Indian citizens to obtain Aadhar when they arrive in India... you can check this notification from link given in description box below the video...

Dear Mr Sriram, migrated to UK, in 2006, my son . But for safety purposes in 2010 for possessed of both PAN & AADHAR cards. From 2016 , he got ILR card of UK. IN 2022 he has become a Brit citizen & also got Overseas citizen of India status, duly surrendering INDIAN Passport. Should he surrender both PAN & AADHAR cards , which are not linked ? Till now he has not availed any benefit from these cards.

I am an NRI and after watching this video tried to link my PAN and AADHAR. Made the payment of 1000 rs through Protean link for SBI and payment was successful. But it says that i need to wait 4-5 days after making the payment to complete the linking process. Since this is the last day (31.03.23) what will happen now. Will i be able to link my pan and aadhar after 4-5 days or some new procedure will have to be initiated

I am an OCI holder. I tried in 2019, 2020 to link but unable. I file tax in India and US every year. My Income Tax India profile is updated with US mobile and US address. I don’t operate Indian mobile ( adhar mobile #) in USA and unable to link PAN and Adhar since the OTP is sent to the Adhar mobile # listed. Any suggestions?

@@sriramrao2514 maybe I am understanding it wrong. When I applied for Adhar card, I used the Indian mobile number. The OTP comes to that mobile number. In US I don’t have access to the same mobile. Hence linking becomes difficult.

I have applied for and obtained an Aadhar card recently. I am not an Indian citizen but qualified for the Aadhar card by way of the 182 day resident rule. Will it be required to pay a fine even though the Aadhar card was obtained recently?
Unfortunately, yes... it will be required to pay fine as of now.... The main issue is if some one provides Aadhar as a proof to obtain PAN, then they will link PAN & Aadhar automatically. However, I think that similar way of linking PAN & Aadhar is not available, if PAN is provided as a proof of identify to obtain Aadhar...

@@bijuldesai3097 For name mismatch, correct name in PAN or Aadhar or both, depending on facts & circumstances..... for changing name in PAN, you need to apply for PAN correction, writing to income tax officers will not solve the issue... to correct name as per Aadhar, you need to approach Aadhar correction center's in India... Since linking is fully automated without any human intervention, even a single spelling mismtach/space difference etc... will not allow linking of PAN & Aadhar...

An OCI obtains Aadhaar card without living 182 days in India, then what? At the end of the video 23:24, it is said that OCI must live 182 days in prior 12 months to obtain Aadhaar card. Is there a check by Aadhaar center to check if one is eligible to obtain Aadhaar card.
In the Aadhar application form itself a declaration would be filed by the applicant in this regard....

How do people gone on holiday abroad get OTP to link PAN n Aadhar
I am an OCI and foreign citizen and not eligible to obtain Aadhar card. I did apply but was refused because I have never been in India for more than 182 days in a year at any time. So how the hell am I supposed to link. Very contrasting rules. They keep sending notification. I don’t have an income in India apart from a paltry sum of interest from my NRO account.

Hi , for NRIs , the ability to get Aadhar without staying in India was only done in Sep 2022. However , it it still not clear if it is MANDATORY to get Aadhar for NRIs. Also, to get Aadhar , you have to visit India and provide address proof etc. I have not visited India since Sep 2022. How will I even get Aadhar let alone link it to PAN ?
Visiting India will not entitle an NRI, an Aadhaar Card. You need to stay for six months. Therefore vide 2017 GOI, NRIs are not obliged to link PAN and Aadhaar Card.

@@sriramrao2514 Sir, An OCI (US Citizen) can not get Aadhar on arrival. If one is an NRI (Indian Citizen) he can apply for Aadhar on arrival. (Explanation from your referred GoI notification.-For the purposes of this notification, “Non Resident Indian” means a person who is a citizen of India holding a valid Indian Passport but not a resident as defined under clause (v) of section 2 of the said Act).

Hi, Video was useful for NRIs who are having OCIs. I'm trying to change my citizenship in the PAN profile to OTHERS, but the dropdown is not listing any countries and showing error. I don't have Aadhar card and having OCI and my residential status as NRI. i would like to correct the citizenship so that my PAN card won't be cancelled. My jurisdiction appears as NonCorp which seems to be residential and not international. Could you please advise what should be done in this case.

Yes, your jurisdiction is not international taxation ward... unfortunately, there is no mechanism to correct the citizenship online... However, in IT portal profile, one can update the status as NRI as well change the citizenship... Apart from the above, to change the citizenship, you can contact your jurisdictional assessing officer through your IT portal grievance and submit proof of your citizenship as well as change citizenship in back-end database... Could you please let me know on what basis did you so confifidetly advise that NRIs who obtained Aadhaar card must link it with PAN? IT department has always said that NRIs are exempted from linking without exception and as per my knowledge, nowhere have they ever said that NRIs with Aadhaar card must link the it with PAN within the deadline which anyway is now extended till 30th June. Appreciate your clarification as it caused a lot of anxiety and concern to many NRIs including me.
Please check the description to this video in which a link for notification dt 11th May 2017 is given... as per which a person not having Aadhar card & is a NRI/OCI need not link it...
Thank you for your response. But this notification does not say that NRIs with aadhaar card must link it with PAN. All NRIs with or without aadhaar cards are exempted as per my understanding. If so, there is no need for NRIs with aadhaar cards to link them with PAN. Is this correct?
Read 3rd line which starts..... "an individual who does not possess the Aadhaar number or the Enrolment ID and is"..... the word 'and' here denotes that there are twin conditions.. one is not having Aadhar card and another as mentioned below 4 items.... if one condition is satisfied, then automatically this exemption notification will not apply to him....

In this video it is mentioned OCI holder cannot obtain Aadhaar unless they become resident but what happens if they have obtained Aadhaar before becoming OCI or have applied after getting OCI status, is there any issue, if yes what is the solution to it
And in this case is Aadhaar required to be linked to Pan card
At the time of obtaining Aadhar if you are eligible, then no issue, you can continue to hold it, as there is no way to surrender/cancel Aadhar...

@@NazNap-nw8sq once Aadhar is obtained, it can neither be surrendered nor be cancelled… it will remain… once Aadhar is available then linking is compulsorily

Very good now the pan and achar card link will get jammed and govt will make more money by late fees and penalties. Moreover people will looses their money in banks as the account holder cannot withdraw money from his account without pan card which is now inactive. Wow it's as good as another form of demonetization or liquidity control by govt.
if a NRI do not have aadhar, you say you dont need to link..this dosen't make any sense....where will the question come to link aadhar if NRI do not have aadhar....your wording is confusing

Cannot obtain new PAN as it will have a penalty of Rs 10,000/-... just for your information, notification & directions to link PAN & Aadhar has been coming in media ever since 2017...

First, match the name as per Aadhar & PAN, then match the DOB as per PAN & Aadhar... only if both matches, it will get linked.... if there is a spelling mistake, then the same needs to be corrected either in PAN or Aadhar as the case may be and then go for linking.... FYI - Due date for linking is further extended to 30th June 2023...

There are many Mail ID's as there would be many international taxation ward/circle officer, they are allocated area basically with PIN code of your locality... but the mail ID may generally contain words like 'IT' or 'intl tax' etc... If you check your PAN jurisdiction in your IT portal, you will find an e-mail ID, if you post it here, I would be able to let you know whether it is international taxation jurisdiction or not....
I am an NRI but jurisdiction in ITR portal shows me as Indian resident. I tried many times to link PAN and Aadhar but unable as it shows mismatch of name. I have applied online for name change in PAN card. Now I have received mail from NSDL to send them by post a proof of name change (publication in official gazette or certificate from gazetted officer). Is there any way to submit this online or by email ? If not, do I need to send original notarized affidavit to NSDL in Pune or a copy will be sufficient?

If you have a minor correction, as in spelling mistake then only send self attested Aadhar, Pan and Passport copies having the correct name.
I had an issue with my Middle Name being different on Pan and Aadhar. So along with the documents,I also wrote a letter stating that the correction or mistake while applying for Pan initially.
NSDL accepted the documents and corrected the Pan within 15 days.
Only if you have a different name altogether for eg (Ram Mishra to Ram Yadav) , then alone you would need gazette certificate which is a time consuming process and is not possible within such a short period of time.
For documents submission, use DHL spend AED250 for couriering to Pune, I did the same
