It has worked in court a very, very small amount of times with the cases being argued by common law experts and solicitors. It has never, ever worked at the side of the road and no one with common law credentials would ever attempt to argue it there...

@@TheRazaah Once you get arrested for suspected driving while impaired, they can search your car. She was "being detained" before she exited the vehicle. They would need her permission before that point, but not after it.

Since the car was being towed, they need to take inventory of it, same as they do with your personal belongings when you’re arrested/booked. She should have served jail time for driving under the influence, possession of cocaine and the other traffic violations but she took a plea deal and that’s why she got probation
The most fascinating thing is this sovereign citizens think driving and traveling are mutually exclusive. You are going from one location in the US to another which is you’re right as a citizen and you don’t need any special licensing for that. But you are also operating a motor vehicle to travel which is driving which is not a right and something you must be licensed for. I got pulled over a few years ago for speeding. I was very kind to the officer. He checked my ID and insurance and ran everything. Since I’d had a clean record and I was very respectful he let me off with a warning. Kindness and respect goes along way
Ten years ago I missed a speed limit sign in Leavenworth, Kansas and got pulled over. The officer was very very correct and professional. I took my ticket. I went and paid it. When I was paying it I asked the clerk if she knew the writing officer. I told her I was most impressed with his professionalism. I said "Don't get me wrong, I didn't enjoy getting a ticket - but I felt like I was treated properly and with great respect. If you can you should make a note that a citizen of this State and County approves of how Officer X conducts traffic stops." Perhaps because the approval came from someone who actually got a ticket - maybe it stood out and had a positive effect on the officer's performance review. It should have. PS - it should be noted that Leavenworth is home to the US Army Staff & Command College. On any given day a traffic stop may be of an important high ranking ally of the United States Military. So I think that PD probably keeps their best men on Traffic detail.

A positive attitude during stops over the years has seen me avoid a few tickets. Often the difference between getting a ticket and avoiding one just comes down to your attitude towards the coppers.

It also states "The right of a citizen to travel and transport property and to use the ordinary and usual conveyances of the day may, under the police power, be regulated by the city in the interest of public safety and welfare;" There is no case law that any SovCit has provided that overrides a State's right to license and govern the use of private automobiles on public roads/lands. None. I read John Dalen's Petition for Writ of Certiorari. It is a poor attempt to cherry pick single lines of case law while ignoring the entirety of the cases he was sighting. All those cases actually rule against him when the entirety of those rulings is read. The sheer stupidity of trying to put such patchwork of garbage past the Justices and there staff is ridiculous. Not only can they look up all the cases he sighted, many of those cases are well known to the Court and his interpretation easily disproven. The US Supreme Court rightly denied his petition. So, no, SovCit is a cult with no legal leg to stand on. The only time a SovCit gets off is when the police are worse that their jobs than the SovCit.

@@TheRazaah Once you get arrested for suspected driving while impaired, they can search your car. She was "being detained" before she exited the vehicle. They would need her permission before that point, but not after it.

Since the car was being towed, they need to take inventory of it, same as they do with your personal belongings when you’re arrested/booked. She should have served jail time for driving under the influence, possession of cocaine and the other traffic violations but she took a plea deal and that’s why she got probation

The most fascinating thing is this sovereign citizens think driving and traveling are mutually exclusive. You are going from one location in the US to another which is you’re right as a citizen and you don’t need any special licensing for that. I got pulled over a few years ago for speeding. I was very kind to the officer. He checked my ID and insurance and ran everything. Since I’d had a clean record and I was very respectful he let me off with a warning. Kindness and respect goes along way
Ten years ago I missed a speed limit sign in Leavenworth, Kansas and got pulled over. The officer was very very correct and professional. I took my ticket. I went and paid it. When I was paying it I asked the clerk if she knew the writing officer.
I told her I was most impressed with his professionalism. I said "Don't get me wrong, I didn't enjoy getting a ticket - but I felt like I was treated properly and with great respect. If you can you should make a note that a citizen of this State and County approves of how Officer X conducts traffic stops." Perhaps because the approval came from someone who actually got a ticket - maybe it stood out and had a positive effect on the officer's performance review. It should have.
PS - it should be noted that Leavenworth is home to the US Army Staff & Command College. On any given day a traffic stop may be of an important high ranking ally of the United States Military. So I think that PD probably keeps their best men on Traffic detail.

A positive attitude during stops over the years has seen me avoid a few tickets. Often the difference between getting a ticket and avoiding one just comes down to your attitude towards the coppers.

There's not one court case or law that says differently and you cannot provide one. No where does the law or SCOTUS say a drivers license is only required for commercial purposes.

SovCit love to try and invoke Thompson v. Smith, which wasn't a SCOTUS ruling, but a ruling of Supreme Court of Virginia, but fail to read the entire ruling.
While Thompson v. Smith does in fact state "The right of a citizen to travel upon the public highways and to transport his property thereon in the ordinary course of life and business is a common right which he has under his right to enjoy life and liberty, to acquire and possess property, and to pursue happiness and safety." as SovCit claim.
It also states "The right of a citizen to travel and transport property and to use the ordinary and usual conveyances of the day may, under the police power, be regulated by the city in the interest of public safety and welfare;"
There is no case law that any SovCit has provided that overrides a State's right to license and govern the use of private automobiles on public roads/lands. None. I read John Dalen's Petition for Writ of Certiorari. It is a poor attempt to cherry pick single lines of case law while ignoring the entirety of the cases he was sighting. All those cases actually rule against him when the entirety of those rulings is read. The sheer stupidity of trying to put such patchwork of garbage past the Justices and there staff is ridiculous. Not only can they look up all the cases he sighted, many of those cases are well known to the Court and his interpretation easily disproven. The US Supreme Court rightly denied his petition. So, no, SovCit is a cult with no legal leg to stand on. The only time a SovCit gets off is when the police are worse that their jobs than the SovCit.
