The bird feeder in the video is very well known in the Morecambe and lancaster area, he as been harassed and arrested many times for doing what he does, he does this all day every day, leave the poor man alone he loves what he does.. just feeding the birds....

So your restraining order restricts your rights as an individual to freely express yourself.
Human Rights Act 1988
1 Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.
Although you may appear guilty under the restraining order, the order itself may not be lawful as it impacts heavily on your right mentioned above. As your dialogue in your videos is only an opinion, albeit expressed in colourful language, it still remains as just that, an opinion.
You have every right to voice your opinions and criticisms, especially of those in a position of authority or those who represent it. Not everyone has the linguistic skills of Stephen Fry but express themselves in multitudinous ways as you yourself do.

In your video you expressed genuine remorse at using the "C" word, but this is still only an opinion albeit a crude one. It would be very difficult to prove if it was used in a derogatory manner, unless you admitted that was your intention, as only you know what you were thinking when you said it. How it is perceived by others is a different matter. I'm fairly certain that the courts do not employ mind readers for this purpose. Your language is your own to express yourself.as you please.

Our police are posting messages now saying "Hate speech is a crime and there will be consequences when we catch you."
Even though freedom of speech and freedom of expression are fundamental human rights, we can be prosecuted for exercising those rights because of laws that our governments have made. We need a bill of rights similar to those in USA to protect us.

What this boils down to is the fact that the police will back the council for whatever matter even over silly words like scum, you would think that the courts were far to busy to deal with petty matters such as this. 🤔

3GS are not council employees, they are a contracted company, not actual civil servants. There is no breach of your restraining order. If they were working for a council, they would be legally bound to a code of conduct.
They are contracted by the council and the order says any contractors.

I'll be very surprised if you get your hands on the body cam footage 9 times out of 10 it will magically get lost when ever it is incriminating towards the police

Sorry but unless I missed something the security staff are not council workers and not covered by the order. They may be contracted by them but are not their employees.

Re the clip at the end and pigeon feeding. There may be a local bye law forbidding it and to be honest they are a health hazard as are the revenue collectors and they make a mess. For that reason you have to be careful. If it is just a littering offence the best thing to do is wait until all the food has been eaten and just to be sure use a dust pan to clear any remaining. It is only an offence to leave it.
Don't plead guilty, these guys work for 3gs, they were wearing the uniform. How are you supposed to know who is working for the council, sub contracted or otherwise?

So Marti, it is claimed that you breached your restraining order by using insulting words towards Leeds City Council contractors? But what constitutes an insulting word? Different people perceive things in different ways. Plus, the words a person uses comes under a person's behaviour (well, depending on how one sees it.....)
When you were given the order, you should have said it is vague. From what I'm hearing, no specific words are classed as "insulting".
Really your behaviour (words, gestures, etc) is only "insulting" if you make it so/admit to breaching the order. The fact that somebody perceives your behaviour as "insulting" does not necessarily mean that you have breached the order, you know.
Also, how long does the restraining order last - and did it come about as part of civil or criminal proceedings?
The order lasts 2 years and yes Criminal by Sending a malicious communicating that been an email containing only the link to my youtube video.

In one of your earlier videos, there is information about your restraining order on a bit of paper.
Amongst the info is: "not to use abusive or insulting language or gestures towards any employee, agent or contractor of Leeds City Council either in person or through any electronic device or social media".
Marti: did you appeal the sentence? It is way too extreme. Just because somebody from the council is involved does not mean that the council itself is involved.
If that is all because you called a council official a “cunt” then you should start a petition to get the conviction quashed.
It'd make more sense if the restraining order was between you and that official, but really, this is a big deal made out of a extremely tiny incident.
Are you also banned from going to a certain place, as you mentioned in one of the CCTV what's your view videos? I didn't see anything on the restraining order that says you are banned from anywhere..
