A few points: 1. You don’t have to be intoxicated to be a DUI. All you have to be is “impaired” which means you can feel the effects of alcohol or drugs, however slight. 2. You don’t have to have a BAC of .08. If you are impaired it makes no difference what your BAC is. I’ve seen numerous convictions for 0.07. 3. If you are 0.08 then you’re guilty of a DUI whether you’re impaired or not. This is called the “per se” count. “I wasn’t drunk/impaired” is no defense if you’re 0.08 or higher. 4. If you’re impaired by drugs you’re a DUI. The evidence will be in a blood test, not breath. 5. And if you don’t want to cooperate with a breath or blood test you’ll be labeled a “refusal” meaning a one year loss of your license and a stiffer punishment. AFTER the forced blood draw. 6. This is law in all 50 US states, possessions, territories and Canada. 7. The US shares your driving records with Canada, by treaty.
Why did my police department ever hire this cop. We the people deserve better accountability. Every officers file should and must now be audited. We can not trust any officer knowing this about our department

This isn't the first IMPD officer to drive around drunk. It won't be the last.
