Only the people who own the property can do something or not do something to create a lien on it.

Excellent quality video! Thank you. Question... I loaned my aunt money to pay off her home mortgage. I had a promissory note completed and used her home as collateral. I'm have a first position lien. There are no other liens on this home. If my aunt goes into a nursing home down the road and Medicaid places a lien on her home will I be paid in full before Medicaid?
Hi Greta - good question! The only liens that can jump ahead of others for certain purposes are property tax liens. Everything else goes in date order from recording. Check your title insurance policy as it is your protection. Will make another video to cover this.
Hi. I had a judgment lien on personal student debt, not loan, and creditor placed lien in my personal home. Creditor never contacted me to pay it prior nor sent a copy of judgment. Currently, still relitigating debt due to them filing a renewal of judgment and judge said to remove lien, but go to another court due to wrong amount, etc. How can they just place a lien w/o any contact to pay and now back in court still contesting it? Don't they need to go to court to get approval to place on home since now blocking my title and I now can't refi? I don't want to pay since still contesting amount in Court? Need it removed so I van get money to hire an attorney in CA.
If a lien shows on a title report and the basis for that lien is in some sort of dispute the title company will normally write around it if an escrow or some other arrangement is made. The bankruptcy court can also remove nonconsensual (not given with permission of the owner) liens.

Great question Star- the consensual liens are also on vehicles- they are notated on the title.

How would one go about removing a judgment lien from a property when the lienholder has gone bankrupt and the attoney who name is on the fi-fa claims he has nothing to do with it ? . not denying the debt just no one to contact to clear it .
HI @Mrjims The non-exempt assets in a bankruptcy case pass to the bankruptcy trustee for administration. A place to start is to check the case.

What about doing repairs on a home you are living in and the person doing the repairs are a part of the estate.
The house is paid off.
What about UCC1 Commercial Liens?
Hi @ItsWesley This video is about liens on real property- land. The UCC pertains to other assets - it does not cover real property. YOu may be thinking of a fixture filing against real estate which is to connect the fixture which is personal property to the real property where it is located and a ucc-1 financing statement is recorded in county records to give notice of that lien. Good question!

I wrote to you but I’m not sure you’ve received it.
I have a mechanical lien on the house placed there due to lack of payments. The company went out of business but not before placing the lien on the house. The bank that give the loan (HOMETRUST MORTGAGE BANKERS) also went out of business (both) well over 17 years ago. No government Agency’s has been able to locate the lien and 4 attorneys attempted taking this to the Supreme Court to have it dismissed or paid but no luck. My question is who do we pay and how?
