Article 77 of the Constitution stipulates that "① President may declare martial law as prescribed by law when it is necessary to respond to military needs or maintain public well-being with military strength in wartime, incident, or a national emergency." Article 87 (Rebellion) of the Criminal Code stipulates that "Anyone who has rioted for the purpose of excluding state power or disrupting the Constitution from all or part of the territory of the Republic of Korea shall be punished according to the following categories…”, Article 91 of the Criminal Code (Definition of Destruction of the Constitution) stipulates that "the purpose of destructing the Constitution in this chapter means that it falls under any of the following subparagraphs. 1. Extinguishing the function of the Constitution or the law without the procedures prescribed by the Constitution or the law. 2. Overthrowing a state agency established by the Constitution by coercion or making it impossible to exercise its power." Therefore, there is no question that the evidence disclosed so far comes under a crime of rebellion. However, President Yoon argues that his actions are justified because they constitute an act of governance, even though they constitute an act of rebellion. In other words, he argues that he can be justified even if numerous people bleed due to acts of rebellion that violate the Constitution and related laws because the people have given the president an absolute power. If all of the president's actions are justified by the act of governance, he should have continued the act of governance (rebellion) without lifting the emergency martial law even if the National Assembly demanded the lifting of the martial law, but he accepted the National Assembly's request to lift martial law. Therefore, President Yoon's argument is nothing but sophistry that does not make sense. In order for Yoon's argument to gain legal validity, he must explain why some laws can be ignored for governance purpose and others cannot be ignored before claiming his legitimacy. It should be clarified why the act of destroying a democratic system can be an act of democratic governance. Yoon's act of civil war constitutes an act of anti-democratic governance. If emergency martial law causes numerous lawmakers and citizens to be injured or killed, and overthrowing the democratic system is justified as an act of governance, the grounds should be presented. Let's say, for instance, that terrorists in a foreign country demanded money by taking Koreans as hostages. Sending money to a foreign country requires compliance with the Foreign Exchange Transactions Act. If the President, without considering it, ordered governmental officers to have Korean citizens return home safely by paying ransom to terrorists, it can be regarded as an act of democratic governance. However, that is not the case here. The National Assembly consists of members elected by the people, and members of the National Assembly have the right to operate state affairs through legal-making activities as a representative organization of the people. For the minority governing party to run its state affairs smoothly, it must seek the cooperation of the opposition to become a successful president and the governing party. Since taking office, however, Yoon has continued to disrespect the views of the majority opposition party, and has continued to veto the opposition's demand for an independent counsel to protect his wife, Kim Geon-hee. As a result, the opposition party has exercised the rights granted by the people to prevent the administration from abusing its power. The opposition's check of the administration is based on the principle of check and balance, which is the basic concept of democracy and rule of law. The opposition party's majority in the last parliamentary polls was because of Yoon's poor political performance. The people turned the opposition party into a majority to keep the administration in check. So the responsibility for the governing party's being a minority rests with President Yoon. It is a legitimate activity guaranteed by the Constitution that the opposition party checks the government and the ruling party through impeachment activities, thus it cannot be a problem. As President Yoon has continued to exercise unfair veto power, the opposition party exercised the impeachment power granted by the people to check the administration's dominance, and it is regrettable that he does not regret his fault for causing this situation and passes everything on the opposition party. If President Yoon is a person who has not studied law, people might think that he may make such a claim because he has no legal knowledge, but it is absurd that a person who has been a prosecutor for a long time makes such a claim. [President Yoon's Lame Excuse]
On the morning of December 12, President Yoon gave a lengthy explanation of his position on the latest rebellion incident in a pre-arranged statement. He seems to still think that the public is a stupid group.
President Yoon has talked about numerous issues that justify the emergency martial law with the aim of intentionally dividing national opinion, and the key conclusion is that his emergency martial law is not problematic at all because it constitutes an act of governance.
Article 77 of the Constitution stipulates that "① President may declare martial law as prescribed by law when it is necessary to respond to military needs or maintain public well-being with military strength in wartime, incident, or a national emergency."
Article 87 (Rebellion) of the Criminal Code stipulates that "Anyone who has rioted for the purpose of excluding state power or disrupting the Constitution from all or part of the territory of the Republic of Korea shall be punished according to the following categories…”,
Article 91 of the Criminal Code (Definition of Destruction of the Constitution) stipulates that "the purpose of destructing the Constitution in this chapter means that it falls under any of the following subparagraphs. 1. Extinguishing the function of the Constitution or the law without the procedures prescribed by the Constitution or the law. 2. Overthrowing a state agency established by the Constitution by coercion or making it impossible to exercise its power."
Therefore, there is no question that the evidence disclosed so far comes under a crime of rebellion.
However, President Yoon argues that his actions are justified because they constitute an act of governance, even though they constitute an act of rebellion. In other words, he argues that he can be justified even if numerous people bleed due to acts of rebellion that violate the Constitution and related laws because the people have given the president an absolute power.
If all of the president's actions are justified by the act of governance, he should have continued the act of governance (rebellion) without lifting the emergency martial law even if the National Assembly demanded the lifting of the martial law, but he accepted the National Assembly's request to lift martial law. Therefore, President Yoon's argument is nothing but sophistry that does not make sense.
In order for Yoon's argument to gain legal validity, he must explain why some laws can be ignored for governance purpose and others cannot be ignored before claiming his legitimacy. It should be clarified why the act of destroying a democratic system can be an act of democratic governance. Yoon's act of civil war constitutes an act of anti-democratic governance.
If emergency martial law causes numerous lawmakers and citizens to be injured or killed, and overthrowing the democratic system is justified as an act of governance, the grounds should be presented.
Let's say, for instance, that terrorists in a foreign country demanded money by taking Koreans as hostages. Sending money to a foreign country requires compliance with the Foreign Exchange Transactions Act. If the President, without considering it, ordered governmental officers to have Korean citizens return home safely by paying ransom to terrorists, it can be regarded as an act of democratic governance. However, that is not the case here.
The National Assembly consists of members elected by the people, and members of the National Assembly have the right to operate state affairs through legal-making activities as a representative organization of the people.
For the minority governing party to run its state affairs smoothly, it must seek the cooperation of the opposition to become a successful president and the governing party. Since taking office, however, Yoon has continued to disrespect the views of the majority opposition party, and has continued to veto the opposition's demand for an independent counsel to protect his wife, Kim Geon-hee.
As a result, the opposition party has exercised the rights granted by the people to prevent the administration from abusing its power. The opposition's check of the administration is based on the principle of check and balance, which is the basic concept of democracy and rule of law.
The opposition party's majority in the last parliamentary polls was because of Yoon's poor political performance. The people turned the opposition party into a majority to keep the administration in check. So the responsibility for the governing party's being a minority rests with President Yoon.
It is a legitimate activity guaranteed by the Constitution that the opposition party checks the government and the ruling party through impeachment activities, thus it cannot be a problem.
