      @@dawndoyle9707 however he broke the Law. The very minimum we should expect is for an officer to work within it. I suspect he is a probationer following instructions from another who had no idea himself of the Laws appropriate to this scenario. Sect 47A is a major major error.

    Compensation definitely due here. Totally illegal from the first mistake - wrong section of law, let alone everything else that follows. Take him to court asap (within 6 months). Another one for Ian Gould, a brilliant solicitor for getting police who don't know our laws or how to use them into court.

    A police officer on his own would never approach a person they believe could be a terrorist with articles useful to a terrorist, ie guns, bombs, suicide vest etc. He would observe from a distance and wait for backup. He did this on his own, because he knew there was no danger and whom AB was. This cop tried to be a tough guy for the camera and it's backfired.

      AB’s recent community post showed confirmation from a firm of solicitors that he’s appointed to make another claim against the police so I’m sure he will pursue this one too.

Once the officer said I know who you are, AB kept saying "you know who I am but you searched me" which the officer kept ignoring. I was expecting AB to say "you said you put me in handcuffs because you said you don't know who I am and for your safety but then said you know who I am"

    Section 47A allows police to stop and search someone or a vehicle, without reasonable suspicion, in order to prevent acts of terrorism. Searches under this power may only be authorised by a senior police officer, in a specific area for a defined period where the police reasonably suspect an act of terrorism will take place.
    Interesting section to use and one that could net you a good pay day......

      Definitely abuse of power. He also freely admitted that he knew who AB was, therefore was reasonably aware that he wasn't a terrorist, and targeted him for an illegal search, and put the handcuffs on too tight, as a kind of punishment treatment.

      @@AuditingBritain AB did you find out what police office he works from and do you have the phone number so we can phone up and make complaints on not just your behalf but ours aswell because we cant have officers working for the police like that. he admits he knew exactly who you were and he obviously must know then that you are not a hostile person in the slightest, yet he walked up straight away and put you in handcuffs. this was DEFINITELY RETALIATION for what you do. trying to uphold the police to be transparent. please inform us which force he works from and their phone number

      Flip that script. It's obvious that bad karma hit him from birth - he had to endure a micropenis, parents who offered him no love, and a succession of bullies at school who preyed upon him even as he was being rejected by all the girls. The damage this did to his psyche doomed the few relationships he managed to initiate in adult life, and all of this forged the hollow, bitter and pathetic individual standing before us in this video. What we see here is him trying to exact vengeance on the karma that dealt him these cards, and reclaim some semblance of manhood. Sadly karma doesn't work that way, and he just looks exactly like the little b*tch he was when he was young. I almost feel sorry for the pr*ck. Perhaps therapy and introspection might help him free himself from the heavy shackles of his past and achieve a metamorphosis into a human at peace with himself. But my bet would be he just becomes a bigger and bitterer c*nt, increasingly toxic to women and potential partners, and soon runs headlong into another appointment with bad karma.

      I'm sure he's gutted that AB, you and I had to waste our tax money paying his fine for him. He probably also loses sleep about the fact that because AB, you and I pay his salary through our tax before he pays any tax on the money we give him, he's even insulated from chipping in to the fine his idiocy has cost us.     TACT 47a "A senior police officer may give an authorisation...... " - he's not a senior police officer. Everything that flows was illegal

      Exactly. Section 47a can only be authorised by a constable with rank of at least assistant chief constable (or commander in London) and needs to be authorised for a specific area BEFORE any searches take place and there has to be very good reason for doing so. It’s not to be used on a whim to search an individual, which is why the Secretary of State must be notified of any authorisation (and must confirm any authorisation if section 47a is to remain in force for longer than 48 hours).

      A senior officer has to authorise the use of the act for a certain area and time frame, but any officer can apply it if authorisation is in place. The officer MUST also state that as fact before any detainment.

    Section 47 powers are a last resort, which are supposed to be exercised extremely carefully. Basically they exists for when there is a credible and particular threat, and they are authorized only in a specific location for limited period of time relating to the threat. Even then their use should be carefully considered for the potential they have to breach Article 5(1) (c) of the European Convention on Human Rights, since they don't require reasonable suspicion. I think it's highly unlikely that they have been authorized for use at that location at that time, and I very much doubt that any senior officer would consider this a proportionate or reasonable use of these powers, even if they were authorized at that location and time.

    To me that is a sackable offence to detain and search someone under a law that he has not got the rank or qualifications to do so. His senior officers should immediately suspend him until he answers the question as to why he used that section without the authority to do so. Another big pay day for AB and hopefully one less cop that is ignorant if the law, pathetic creature who should not be a cop.

      i mean thats wrong, he doesnt have the authority to grant those powers but someone probably gave them to him, though this section is only used when theres basically an imminent threat of it so yes its excessive, however he almost definitely had authorisation to do so because if he never he simply wouldve used section 43 which allows him to do everything he just did, only difference is 47 allows the search of everyone in the area

      @@KayJayDZ he doesn’t have the authority period. It must be granted by the chief or assistant chief only, not a cop on his own. It is quite clear in section 47 (n) who has the power to issue it, definitely not a junior cop.

    I will never condone violence in any way but this PC moved me as close to doing so as I’ve ever been.
    That stop and search was purely antagonist, as was the over tightened cuffs and the attitude.

    A supposed officer of the law ignorant of the terrorism act and his application of stop and search. So arrogant as to think he is above the law. After admitting he knew who AB was, before stopping him, has basically admitted to abusing his power and was prepared to cause his department as much trouble as he possibly can, to make himself look good. He should be fired as he will bring disrepute on everyone he associates with. A contemptible little man.

    Without a doubt the worst interaction I have witnessed while watching audit video's. I have never felt a need to make a complaint before but this officers actions were so bad I have officially made a complaint to Thames Valley police and would ask others to do so. Keep at it AB.
