OOOOH, that’s why that doctor told me to try to push through it. That’s why the doctor never told me about flare ups! FIRST thing tomorrow, since i just got my second rating, i WILL be fighting it again. My 30% rating, that’s bullshit.
I have a C & P exam for my back. I filed for an increase for my C-spine and am also going in to hopefully have my L-spine claimed. I have 5+ years of chiropractic treatment, physical therapy and acupuncture treatment, and an assortment of over-the-counter and prescription medication (through the VA) for the pain. My chiropractor and acupuncturist also wrote a letter of recommendation to help my case by stating my injuries and pain are chronic and that continued treatment is recommended. My question is, my C & P exam letter states the exam is for the "lumbosacral" and will be examined by a NP (nurse practitioner), is it possible for the examiner to add an unclaimed disability (i.e. my thoracic spine and/or sciatica), because I have issues with my entire back, and also didn't receive treatment for what I believe to have, sciatica. Lastly, can this exam for the "lumbosacral" also re-determine or re-evaluate my mental health disabilities, like PTSD? I only received one letter and one appointment for C & P, which is supposedly for the L-spine examination. Thanks.
Submitted my claim for my service connected left knee injury. For years I had to compensate with my right leg now I have arthritis tournament discus a torn ACL in both knees. My range of motion in both knees are at 30 degrees that’s straightening and bending my knees. Will they rate each knee twice because I have torn Cartlidge and I can’t bend it or straighten it. Help
I have range of motion as my reason for service connection. Pain every day but only 10 percent per knee. Any suggestions on how to word this in an attempt in increase? I'm seem regularly for pain, in physical therapy and pain management for knees neck and back
I have an overall rating of 90% but only a 20% rating for my back and 20% for my knee. I have sent in multiple claims over the last 20+ years to get an increase but continue to get denied. I had major back surgery while on active duty, and have 2 pins and 5 screws in my lower back from that surgery. I have since recently had a second back surgery due to continued pain and that too has not relieved any of my problems. I now suffer with pain in my hips and both knees now due to having to constantly compensate how I walk due to my lower back pain, which in turn has caused severe pain and constant swelling in my knees. My most recent claim for rating on my hips and knees secondary to my low back was denied. I have other conditions as well that are secondary to my low back injury but have been denied on those claims as well. Just really frustrated with the whole process. Any thoughts or words of wisdom, and thanks for your time with reading this.
@@joeycarr1398 I did about a year and a half ago. I just had a call with them about a week ago to go over my case and where we are right now and what we are going to be doing going forward. They have already been able to get some more issues rated but it has not been enough yet to get me to that 95% mark. To be honest it is frustrating as they have been able to get more rated but according to my attorney with what got rated it only brought me to 94%. I am thinking really 1% you cant just go ahead and push it over.
For my knee exam. The dr asked me to take my pants off and lay on bed. He told me to straighten my legs when laying down. Why would he do that? I was in pain trying to straighten my knee all the way down.
I have been fighting the VA for over 15 years about my knee. They just keep rejecting a claim. I have recently had to quit work because of it. The pain at times is almost unbearable but will just have to live with it because they will just not do anything about it.
I am the SAME way. I told the head of our VA hospital that if I have to suffer another year of this, I will file SF95 to a federal tort division for withholding medical treatment and malpractice. It seems it got their attention to actually DO something.
@@DeborahElliott-mh5ru Good luck. Where and how do you file a SF95? I got out in 1968 and have been jerked around since then. I actually think they are waiting for me to pass away. Good luck and God Bless.
Brothers... I have a 49 year old brother-in-law who can not even get a health ID card because he makes over the allocated limits with three dependants. He can qualify for PTSD and back injury which are both service related but he can get into the VA system or talk to anyone because of his salary. We even tried to get an health card to use PX/BX privileges but that was turned down. Do anyone have any ideas of where to start...?
Currently service connected 100% since 1996 but the date of discharge was 1976 - had a medical board prior to discharge Doctor's recommended a rate was over ruled by my branch of service - received a honorable discharge and my service records were hidden till President Bill Clinton sent an executive order to the record achieve once the records were received 20 days later was rated 100% but only received 3 years back payment was told that was the maxium they could issue - is there any recourse after all these years?
Veterans Law Blog I bought a house in September 2019. After purchasing the house, I learned that the Blue Water Navy Veteran's Act had a change signed into law in June of 2019 allowing purple heart recipients on active duty weren't required to pay a VA funding fee. I contacted the agent at Veterans united to ask about it and she told me I would have to contact the VA about it. I have since emailed the VA Loan Branch in Atlanta at least 6 times with all my information as well as the orders and award certificate of my purple heart and continue to not get any response. I'm not sure if you deal with anything like this, but do you have any advice you could offer me?
I might of screwed up. I just had my VA C&P exam and my knees are messed up. My military records reflect bad knees and and personal doctor paperwork supports. I had everything in order and showed my worst day. The issue is when the older APN came to waiting room and called my name, she said how you doing and I mistakenly replied pretty good even though I was pretty bad. My knees had swelling, hard to walk, and my eval seemed to go great because I was so sore and it was truly one of my bad days. How much did the wrong greeting response hurt my case by mistakenly saying pretty good to her initial greeting???

My problem is they rate you by doing range of motion why u are sitting; my worst pain is when walking, bending and actually on my knees looking for my shoes under bed. My knee was actually swollen during the C&P exam. I was asked have I ever had them drained. And I stated VA never recommended that. No increase n my hips are now part of my disability. Can you recommend an attorney in the Raleigh - Durham NC area?
The max rating for tinnitus is 10%. You can get more than 10% for hearing loss though. The only way to get more than 50% hearing loss is that you are using a hearing aid, 100% you basically have to be totally deaf.
No due process in the decisions from the V.A and they reduced my rate from 20 to 10% which is bull cause they expect me to get boots to fix a knee problem. But yet, I AM THE LIAR HERE> My primary care don't care what number the pain is, they tell me its all in my head. Hmm. I guess this is why they gave me NAPROXIN.
