Witnesses:
Robert Durst stands trial for the 2000 murder of friend Susan Berman. The trial began just before the pandemic in early 2020 and was halted two weeks in. The restart happened on May 17, 2021, with the same jury panel.
The defendant’s wife Kathleen McCormack Durst went missing in 1982. Evidence and testimony would show that Robert Durst killed her, the prosecutor said. The defendant allegedly told Berman it was an accident and asked her for help. She served as his alibi.
Berman, 55, was shot execution-style at her Beverly Hills home in 2000, and the prosecution suggested that it was because of what she knew about Kathleen’s death and disappearance. As defense lawyer Dick DeGuerin would have it, however, Durst is innocent. His client only came across the body, panicked, and fled, he maintained.

This is one of the most exalted, praised and loved experts of the wrongful conviction movement. Anyone sending their hard earned money to the “Innocence Project” either hasn’t done their due diligence or is a fool.
The point on a memory expert not wanting to be recorded was priceless!!!!!! My favorite part! Such a great point.
This woman is so self-absorbed it's mortifying. To think our future generation is being taught by this woman is frightful.

Her testimony on the Hennis case is truly pathetic. Her refusal to give a simple answer makes her look so shady. I do not think her expressions and looking at the jury is accomplishing what she thinks it is. Good lord Weinstein and Sandusky, eww

Memory expert:”I don’t recall.“ This lady’s entire fortune and fame and reputation is based on her promoting a theory that came out during the McMartin scandal where it was used the very first time, that of the argument between repressed versus false memories. And she has used it to great effect to become wealthy and famous and have a very nice academic position at a UC university. She is gaming the whole interview here always replying with equivocals and never committing to her opinion or even her own memory of what she has said and done. She’s pathetic. It would be too damaging for her to admit that she was dead wrong on the case, derided the witnesses who in the end had a strong testimony against the defendant, and made a lot of money and a reputation off of it. How could she admit it?
Her husband and her originally dreamed up the False Memory Syndrome in their own defense when their daughter made allegations of most serious nature against them. However, as you said it was the1st time it was used in such a public trial.
Maybe everything she thinks she remembered is false...lol

In a way the prosecution is proving her theory Re memory- the fact she can’t remember, has varying memories of things she’s previously said etc just alludes to her theory that memory is unreliable. It’s ironic really.

@@Truth1561 I think she supports the prosecution. She remembers what’s important to her, her rankings and awards. But the rest is noise to her.
All these prosecution witnesses remember something that was important and memorable to them. She is doing the same thing. They just have different priorities.
The fact she couldn't remember important facts but was dead against being taped recorded speaks volumes

Memory can be fallible, yes...but this "expert" is fallible in her twisting things for defense only. An impartial expert would have credits on every side, throughout that lengthy history. Hard to have 40 years of every case being false memrories.

Defense made a mis-step by having her speak to memory in general. She would've been more useful if they would've had her do a witness by witness overview.

Dr Loftus is a geniune expert. The prosecutor is badgering to undermine credibility. Notice how little the actual memory evidence in the case is being discussed here.
She's an establishment hack and has been since the 90's. Expert gatekeeper, indeed.
That's the whole point, show she's not credible and her evidence is questioned and not taken seriously. He wasn't badgering her, he was pressing her.

The prosecutor's office needs to put up a better lawyer (I assume it's the prosecution). This witness is awful but the lawyer questioning her is fumbling and disorganized. It seems like the judge is having to remind him of basic procedures & tell him to calm down and "breathe". Looks bad.
John Lewin is one of the best prosecutors in la. Without a doubt, the best cold case prosecutor. He’s far from fumbling.

Enough is enough. Mr. Lewin needs to be found in contempt an forced to talk to a shrink. Maybe meds will settle him down. His team needs to replace him when it comes to the cross examination of Mr. Durst. He's going to lose the jury an case if he doesn't stop. His demeanor in the court room is unacceptable. Replace him before it's too late !!!!

Totally agree with you! Lewin is awful. Why is he berating her? She didn't want to be recorded for another reason; having to "remember" every word later on. She is not on trial. Who would want to be recorded by this guy? Not me. Durst not getting tried for Berman murder but, everything else but the kitchen sink.
Totally agree. It’s too much - he’s actually just arguing against the American legal system, not really impeaching her. Defendants require defence, which includes expert witnesses. If nobody agreed to interrogate the validity of witness testimony convictions would not be solid. It can be simultaneously true that Ted Bundy et al are heinous criminals AND true that a witness’s memory has been manipulated and shouldn’t be relied on.
The fact that the richer you are the better an expert you can afford is the fault of the American legal system, not Dr Loftus.
I totally agree. Also, the fact that DNA later proved Tim Hennis' guilt doesn't mean that the photo six pack shown to the eyewitness, plus the police's interview techniques weren't unduly suggestive. One doesn't flow from the other. And Lewintakes too long to make the point. Beating a dead horse.

Even if I strongly agree with lawyer point of view, it's still disgusting how manipulative and violent he is in this hearing.
Attacking person self-esteem and suggesting that is immoral in order to pressure other person to agree with you is disgusting, even if necessary in court.

Violent? More buzzwords. She was a high profile, high paid witness and didn't remember key facts important to the case. He pressured her because she's a witness in bad faith. I pray you're never on a jury because you clearly put emotions over facts.
