Do i get Land Share while buying an Apartment in the Land Underneath ?

  • Usually while Purchasing an Apartment this is a Topic which does not get the Attention that it should.
    What happens if at a Later time you want to sell the whole building with the other co-owners as piece and parcel of land , how does the entire consideration get divided among everyone ?
    In an Act of God Situation where the building is Damaged beyond repair during an Earthquake , how does one divided the share of the property ?
    Its Important to understand the Concept and pay attention while buying the intended Floor , whether it is Commercial or Residential

    In a Co-operative Housing Society where members of the society has equal shares having equal share capital , is UDS equal for each member irrespective of area flat

    If a housing complex or a building is not registered but it’s on a share holdings basis, with the builder. Any issue buying flat in such buildings???

    Very informative sir. Please clear my doubt as i am very new in planning to buy a flat. What is the average life of the flat and what will happen when the building is demolished. Do the flat owners get any return.

      The average life of an independent apartment in a stand alone building ( basement plus four floors ) should be around 20 to 30 years after which it starts to give away , usually then the building has to be renovated the front elevation , structure repair where required , major electricity wiring has to be inspected and changed , same goes for water pipelines and waste disposal pipelines. Building can only be demolished if there are any new bye laws come in force which benifit most of the building owners and demolishing and rebuilding can be a win win for everyone involved.       You will be having undivided share in plot area and must demolish your apartment after 30-40 years...any builder will take contract and build new apartment and give it to you free...also he pays your rent till construction completion...but he will build more stories of apartment than before

      Yes it's not a good idea , one such example is Sujan singh park near Khan market , as there is no registered title that gets transferred to you , you will only be a beneficial owner through an understanding of a company and no clear rights will be transferred to you in any way, hope this helps otherwise you can call me at 9810101323

      @@gulshanestateagentspvt.ltd788 there is same issue with the Dimond District located in Domloor in Bangalore. The building is not registered, but everything looks and working fine for last 20 years. It has around 900 flats in it. And all are occupied and functional. Lawyer also said it’s ok to buy. But I was just worried about what if the place goes in to redevelopment? How will it affect our investment? And ho safe it will be for us as a flat owner .

      Yes that is also one of the concerns , have you tried talking to a banker will they provide you a home loan on this property ?

      @@gulshanestateagentspvt.ltd788 no the banks will not give lone . That’s not an issue. But I just want to be sure if I am investing money in that property my investment is secure.

      If I were you I would go with the perspective of the bankers , I would personally advice you not to go forward with this investment.
