I remember this case. It was so sad that this young mans parents where out digging every week looking for their sons remains. I can't imagine anything worse for any parent to have to go through.
As an Australian, I often shake my head in disbelief over all the travesties of justice I hear about happening in America (usually as a result of over zealous and punitive measures used inappropriately against vulnerable people), but then occasionally this sort of thing happens and I remember that this is the price some people have to pay for our more lenient and frankly completely incompetent and slack judicial system.
Or rather perhaps the fault as Dr Grande seemed to point out- wasn't so much in the judicial process itself but with an an absence of effective collaboration between police and prosecutors to achieve the correct outcome.

It just seems like lazy police work. Instead of some justice being served they decided to make their jobs easier.

There's a podcast I listened to a while ago called 'Matty', which gives a massive insight into this case and his parents pleading for information. I listened to the whole thing in 2 days. It's heartbreaking for Matt's parents to not have their son. He deserves justice.

Coming from Sydney I remember this case clearly. It was a really shocking case and was in the news for a long time. So often in gay crime cases the Police make huge mistakes or don't seem to care. As per usual the legal system seems to be geared to protect the guilty. So often the victim of a crime ends up being painted as the criminal.
Here in Seppo land, we have civil suits for wrongful death. You may win the criminal case beyond the shadow of doubt, and I have never seen anyone get away in the civil suit that follows. It even wrecks innocent people, innocent cops all the time. Do they have anything like that in Bogan land?

At this stage of the game for me, hard drugs is a dealbreaker in even casual friendships. I've watched the slow death those make in people and their relationships before and I've had enough of that in my life. I'm not going to get butthurt over a little pot, or even a semi functional alkie, but any more than that and snip.

There was a similar case not long before, around the back of an industrial property aligning the train tracks in Tempe-St. Peters. There was kind of a big waste water reservoir about that spot. I used to go past on the train all the time and think the abandoned back lot next to it looked creepy. When they excavated it to build they found the body of a 14 year old who had been working as a male prostitute, he'd been reported missing in the 1970s or 1980s.
Knew both these guys from the gym I was working/training at. Still can’t believe he got away with it. He was very odd to say the least and they certainly were a unique couple.

Aussies have been heartbroken over every development in this case for years. There were so many times where the parents begged Michael to please just give them the location of Matt's body. They also asked the police to give him immunity so they could get his body back. I'm glad they did in the end, but it was something like 7 years. 7 years of that pos walking around free, saying he didn't know where Matt was. Everyone knew he at least knew where Matt's body was, even if he didn't actively kill him, which a lot of us still have doubts about.

The whole concept of "inadmissible evidence" really needs to get re-examined. Every time I ever heard of that, the judge was leaving out things that have obvious relevance, and any argument that the jury cant interpret it well even with the defence lawyer helping are extremely weak. It was only when I searched for examples that i finally saw some that seemed ok. It should be up to the defence lawyer to convince the jury "it's not how it looks", not convince a judge that evidence meets intentionally vague criteria for inadmissible.
Absolutely not. What you are suggesting is essentially legalizing abuse of power. The problem isn’t that the evidence was inadmissible, it’s that the authorities abused someone’s rights and made the evidence inadmissible. What you’ve basically suggested is that no one should have rights.

Dear Dr Grande as you know when one has a parent who has a hard time regulating alcohol and is abusive it often has a profound impact on personality and choices. They don't really prosecute for perjury here. The police often violate peoples rights or more simply they charge like wounded bulls and hope that most of it sticks. When I was a trial lawyer - the police at one of Melbourne's major courts stopped trying it on with me. As they knew they had no hope.
Pure Evil! Murderer. Creep. It is an absolute outage that this crook is free. *_Acquittal_*_ laws need to change. How is _*_double jeopardy_*_ justice, when new evidence comes forth? Also, it is so frustrating when important evidence has to be left out of a trial. _*_ALL evidence_*_ should be admissible! Laws need to change._
Not sure how it is in the UK, but in the US, prohibition of double jeopardy is in the constitution, so the constitution would need to be changed. Double jeopardy in the past was used far more to harrass people and to convict innocent people, than to convict a guilty person who got away with the crime. In the US, prosecutors will often sit on a case for years, until more evidence can be found. Or they will just go for some charges. Like in this case, if the prosecutor had just charged him with manslaughter, and then he was found innocent, they could later charge with murder (or vice versa, since the manslaughter and murder are 2 different charges.)

I understand the need for a prohibition of double jeopardy-otherwise some prosecutors would simply prosecute people over and over again with little justification-but there need to be exceptions.
@@jamesbowman6925 I think you could make a case for that, but realistically in today's environment, I don't think a constitutional amendment would ever pass. There are toddler states (like TX) whose representatives would refuse to vote for anything that a Democrat run state was voting for, no matter how good an amendment was. Which doesn't mean people shouldn't try, but it would be an uphill battle. The Equal Rights Amendment in 1972 was the last time a constitutional amendment was started, but it didn't get the necessary threshhold of states to vote for it until 2020 (at which point the amendment had already expired, so the whole process would have to start anew.)
Matt’s parents wanted to know where his body was buried. I always thought that this had a lot to do with the deal that his killer received. ( Note that it was the Royal National Park where he was found, which is not like a little suburban park ; )

Great video. Dr. G would you possibly consider revisiting some of the disasters of American history: like 9/11 or the OK City Bombing and bombing of Centinnial Park in Atl in 1996. The criminals behind these events had severe mental health problems. Most of them seem to be lacking the empathy gene. Just a thought.

Dr Todd, I went to the same clubs as Matt in the 2000's in Sydney. The drugs that were around at the time were really scary and highly toxic. We always felt that it was most likely an overdose as there were so many happening at the time. It's likely Michael panicked when he saw Matt overdosed and the rest is history. So tragic. The law was very hostile to gay people, especially then. Its not completely out of the question that Michael was concerned that he would be blamed for an overdose, according to the law, not of his making. This is the same when a female dies, any heterosexual man close by will always be a suspect. This needs to change.

Hearing about the drugs Matthew and Mike were selling doesn't make me think either of the two were all that innocent - knowing what at least one of those drugs has been used for. Sounds like Matthew had a caring family who would have protected him from abuse if he had reached out to them. No one will ever know what really happened to Matthew but at least they located his remains.
I have seen a documentary or footage somewhere with him again partying with young gay guys still after all this happened, maybe if they are backpackers or drunk/high they won’t know who he is
I don't harbor much sympathy for a situation like this. When you constantly put yourself in risky situations, you are inviting terrible people, places, and things into your life.
In this case there are not many exculpatory factors. Just a cold hearted killer, who used his marshal arts to kill a 20 year old, then proceeded to meet other young men as if murder was a blip on an otherwise perfect day.
Of course Michael controlling. That is usually the sole reason someone as old as Michael would want a relationship with a 17 year old boy. The same is true in hetero relationships as well. The older person wants to control the younger person and it’s easier to do when they are very young rather than closer to their own age.

The whole concept of "inadmissible evidence" really needs to get re-examined. Every time I ever heard of that, the judge was leaving out things that have obvious relevance, and any argument that the jury cant interpret it well even with the defence lawyer helping are extremely weak.
It was only when I searched for examples that i finally saw some that seemed ok.
It should be up to the defence lawyer to convince the jury "it's not how it looks", not convince a judge that evidence meets intentionally vague criteria for inadmissible.
Absolutely not. What you are suggesting is essentially legalizing abuse of power. The problem isn’t that the evidence was inadmissible, it’s that the authorities abused someone’s rights and made the evidence inadmissible.
What you’ve basically suggested is that no one should have rights.

Dear Dr Grande as you know when one has a parent who has a hard time regulating alcohol and is abusive it often has a profound impact on personality and choices. They don't really prosecute for perjury here. The police often violate peoples rights or more simply they charge like wounded bulls and hope that most of it sticks. When I was a trial lawyer - the police at one of Melbourne's major courts stopped trying it on with me. As they knew they had no hope.

Pure Evil! Murderer. Creep. It is an absolute outage that this crook is free. *_Acquittal_*_ laws need to change. How is _*_double jeopardy_*_ justice, when new evidence comes forth? Also, it is so frustrating when important evidence has to be left out of a trial. _*_ALL evidence_*_ should be admissible! Laws need to change._
Not sure how it is in the UK, but in the US, prohibition of double jeopardy is in the constitution, so the constitution would need to be changed. Double jeopardy in the past was used far more to harrass people and to convict innocent people, than to convict a guilty person who got away with the crime. In the US, prosecutors will often sit on a case for years, until more evidence can be found. Or they will just go for some charges. Like in this case, if the prosecutor had just charged him with manslaughter, and then he was found innocent, they could later charge with murder (or vice versa, since the manslaughter and murder are 2 different charges.)

@@thelogicaldanger I support changing the Constitution so that double jeopardy can be set aside if significant new evidence is found. I understand the need for a prohibition of double jeopardy-otherwise some prosecutors would simply prosecute people over and over again with little justification-but there need to be exceptions.
This is also on the police. They should have followed the law. It's their fault as well.
@@jamesbowman6925 I think you could make a case for that, but realistically in today's environment, I don't think a constitutional amendment would ever pass. There are toddler states (like TX) whose representatives would refuse to vote for anything that a Democrat run state was voting for, no matter how good an amendment was. Which doesn't mean people shouldn't try, but it would be an uphill battle. The Equal Rights Amendment in 1972 was the last time a constitutional amendment was started, but it didn't get the necessary threshhold of states to vote for it until 2020 (at which point the amendment had already expired, so the whole process would have to start anew.)

This case reminds me of a great joke: Red Riding Hood and the big bad wolf are walking through the deep, dark forest in the middle of the night. The family should have sued the police for their incompetence.
Couldn't they charge him with improper disposal of a body? Maybe that was part of the plea deal though... It's seriously hope they asked the pants first if they'd rather get their son's body back or charge that person for 10 years.

I'm so sorry for Matt's family. This is so wrong in all kinds of ways. I agree with the guilty verdict you've come up with, Dr G. This is just so, so wrong. I feel for the jury too. They must be gutted.
Dr Todd, I went to the same clubs as Matt in the 2000's in Sydney. The drugs that were around at the time were really scary and highly toxic. We always felt that it was most likely an overdose as there were so many happening at the time. It's likely Michael panicked when he saw Matt overdosed and the rest is history. So tragic. The law was very hostile to gay people, especially then. Its not completely out of the question that Michael was concerned that he would be blamed for an overdose, according to the law, not of his making. This is the same when a female dies, any heterosexual man close by will always be a suspect. This needs to change.

There it is. That’s the piece that just sickens me. That there are people who can take a life and then just continue on as if nothing happened. I just hope it torments him but like others have said, we’ll just never know.

Wow. I don’t understand why juries don’t get all the evidence. If they had , the outcome could have been very different. The police were sure he’d killed Matt but he still got Immunity. Wrong . Hearing about the drugs Matthew and Mike were selling doesn't make me think either of the two were all that innocent - knowing what at least one of those drugs has been used for. Sounds like Matthew had a caring family who would have protected him from abuse if he had reached out to them. No one will ever know what really happened to Matthew but at least they located his remains.
He’ll be a pariah for the rest of his life and pay socially for what he did. What a coward you are Michael.
I have seen a documentary or footage somewhere with him again partying with young gay guys still after all this happened, maybe if they are backpackers or drunk/high they won’t know who he is

Laws and trials outside of the U.S. always seem to be lax
In this case there are not many exculpatory factors.
Just a cold hearted killer, who used his marshal arts to kill a 20 year old, then proceeded to meet other young men as if murder was a blip on an otherwise perfect day.
Of course Michael controlling. That is usually the sole reason someone as old as Michael would want a relationship with a 17 year old boy. The same is true in hetero relationships as well. The older person wants to control the younger person and it’s easier to do when they are very young rather than closer to their own age.
