    Two key factors related to the Amended Privacy Act is that it is technologically neutral regulation and the distinguishment of identifiable versus reasonably identifiable information.
    Technologically Neutral Regulation:
    The Privacy Act does not focus on the use of specific technologies related to the privacy principals. This means there is no outline or differentiation within the Act on different types of technology. This is a contentious area as an organisation’s systems technological power has a major impact in relation to the capacity to collect, store, process and secure data.
    Identifiable Vs. Reasonably Identifiable Information:
    Identifiable information specifically relates to a person and includes details such as any record where a person's name appears. This could be an individuals Medicare records or newsletter article about a group of students. The Privacy Act specifies identifiable as where an individual is the subject matter of the information.
    Reasonably identifiable information is when an individual may not be the direct subject matter of data, but it may be possible two link and distinguish information about any individual from the data. This may include information about an individual in another person's records, such as being recorded as the person's spouse or as an emergency contact for an individual.
