    I know a senior who gave one child temporary pow this child wiped him clean took the home title, bank accts, investments, cd's insurance benefits. It was a massive battle getting it back

    Hey Paul, thanks for your channel. You relay a lot of great info but nothing has really hit the nail on the head for me yet. I'm having trouble finding answers and help in understanding my situation. I'm the beneficiary of a trust left by my Father. He left the lawyer in control and the trust pays out $5000.00 once a year. What are my rights and or options when I don't know what might be happening with the fund. I know you're going to say I should first have representation but I simply haven't the resources to do so. Or would they take payment from the Trust? Also, what kind of information can I personally ask for? Thanks again for what you do here!

    My step sister got power of attorney from my mother after she was diagnosed with severe dementia. She also got a health care surrogate from my mother's doctor. This was in Florida. She then put my mother in a nursing home. When I attempted to take my mother out of the nursing home to live with me, I was told I had no right and would need power of attorney. Is this legal? Can a person with dementia be capable of choosing a power of attorney if they are incapacitated?

      I think that's terrible and I really think they're need to be more secure login play to think about making somebody not just a a commodity because of course that are sing home doesn't want to lose the money I suppose and then you know it's like shouldn't each person you know if your legally her child and why can they want child overstep the boundaries of another child it's is it doesn't seem right seems like they're should be more laws in place to protect the right of all involve because after all that's your mother just as much as it's someone else's mother so it's is it's a Harbor all the I'm sorry you're going through that

    Great video question if you have a living trust and you are incapacitated and you do have I guess called an executor to the trust and they could turn around and sell property and manager estate, is it possible that that second person in the trust can sell property even if you are capable and not ill I can handle your property and sell it underneath you sort of say . So how do I protect myself if I have a trust and I have a executor to my trust not sell assets from underneath me? Thank you

    Perhaps I missed it. Wouldn't/Shouldn't the Trust require that the Successor Trustee obtain a written statement from the Trustee's primary physician that he, the Trustee, is incapacitated and unable to handle his financial affairs?

    Upon the death of the trust owner, the trustee distributes the assets according to the trust instrument. Of course, probate is avoided, However, do the recipients of the trust assets have to pay state inheritance tax in those states that have such a tax?

    Thank you for this. Hoping you can answer a question. I’m 53, never married, no kids. I set up a trust over 10 years ago for which my little sister is executor. The attorney filed it in LA County CA. But my parents are assigned to my health directive. DNR etc. They are now in their 90s and fragile I don’t want them to make such decisions. Do I need to get an attorney to refile a new health directive (not sure if correct term) or would it be sufficient to put my sister’s name on what I file with my medical insurance company? Big ask, I know, but I just don’t know how legal this medical care stuff needs to be.

      Personally I’d get a new health directive written up by an attorney. I had to watch my grandmother die in trauma care over 5 days time because hers was not properly updated. Also, all family members need to be prepared for how you want things at the end, so they don’t argue as we had, it was torture

      Also, the person you give the health decisions to needs a hard copy in their possession, probably needs to be notarized. I had not heard of it needing to be on file with your health insurance

      I had a very good friend we were friends for years if he needed a loaf bread I would make sure he got it he loved me so much he lived alone I did a lot for him anyone who would meet him his conversation would have me in it he met my daughter and husband and grand children he adored them when he got sick last year and before he died he told my daughter he didn't know what is life would be without me and he gave his nephew power of attorney and his lawyer order for money for me he wanted it a surprise his neice I have been calling his attorney the same never met his nephew only the sister his neice it one year the ending of this month and the refuse to call me can I get your help

    my wife and I both have separate trust.. the unincorporated person is beneficiary....
    and we are Absolute Grantee Grantor of our trust.....
    Cab she appoint me as Settlor and Settle a court case for her trust?😏☕
