    The boaters access Lake Winterset through the Chain of Canals system, so legally anyone can use the lake if they go through the canals. There are no public boat ramps, so the homeowner in the news story is TECHNICALLY correct, but LEGALLY they can’t stop anyone from using the lake. If you’re a boater, you cannot lawfully enter onto any part of the shoreline there or any permitted structure abutting from the shoreline, which includes docks, bulkheads, floating docks, boat ramps. The bad behavior of boaters is disappointing and reflects a serious, callous lack of respect and disregard for private property. At the same time, the homeowners need to understand they don’t own the lake; it’s a public resource. The noise and use comes with the sunshine and the view.

      You may also not be able to anchor, but most fishing boats are always underway or drifting, so there's really nothing that the land owners can do beyond forbid the use of ground tackle on their bottom-land.

I know I always end up with found trash in my pockets on a hike, probably those quiet fisherman do the same. I cannot stand hearing music over the water though. Drives me crazy

      @@D4nnypery I live in GA and fish the Altamaha river almost exclusively and I hate seeing trash on it. We always carry a couple extra trash bags for the beer cans and other crap the party people leave behind. Hell theres alot of people I know who do the same thing but theres always more trash. We take home plastic barrels, boats, coolers, fishing gear, camping gear, plain ole trash and even a freezer once. We get maybe 2% of the number of people yall get down in FL so I can just imagine the mess that gets left behind and the frustration it generates

    As long as the boaters don't step onto private property they are not trespassing. Nobody owns the water.
    I've been a fisherman for 60 years and what pisses me off about a lot of my fellows is the fishing line and trash they leave behind.

    The boats shown as a part of this story are predominatly bass boats which are strictly policed by tournament officials and all tournament organizations ban the use of alcohol and narcotics. Get the story straight or at least show those who are actually at fault.

People are not "strictly policed" as you put it, by tournament officials unless they are part of the tournament. Seriously, you have to be extremely dumb to need that explained to you. I own two bass boats and I wish a clown like you would try and tell me I have to follow bass tournament rules and regulations in order to use my boat. You would be swimming with the fishes.

      I don't know about you, but when I was a kid we took my buddies bass boat everywhere, it was the main boat we had access to. Used it for transportation, wakeboarding, fishing, anything we needed a boat for, no one was policing us at all. 16' with 150HP, more than one near death experience in that thing as kids..

      I didnt see a single bass boat fishing in a tournament in this news story. So if you're gonna talk about something at least use something factual. I can own a bass boat and fish from it even while a tournament is going on and the tournament officials wouldn't be able to do a damn thing if I wasn't entered into that tournament.

      The HOA could be the owner. If you aren't part of it and don't have permission from someone who lives there or the HOA itself you are trespassing.

      If the lake is situated completely within the land's perimeter, then the owner of the land also owns the lake. The lake is considered to be private property, and the owner can do with it as they wish.

    I live on Lake Maitland and I fully understand that it's a public lake.
    I wish when the bass fisherman hang up on my dock they would come and get it. I stepped on a lure barefoot and hooked myself.
    I understand if I leave small chairs out they will disappear. It's not the end of the world.
    Those fisherman they showed in the article I guarantee are not playing loud music.
    The residents need to chill out...

    Where are the game wardens? You can’t own the water boaters have the right to be on the lake. The problems with drunkenness, trespassing on the docks and land, the littering, noise issues are all issues that game wardens need to enforce. The reality is they can’t be out there 24/7 so my advice to people living by the lake instead of immediately wanting to infringe on peoples freedom on a public waterway move somewhere else if it’s bothering you that much.

    All lakes in Florida besides ones in private developments are PUBLIC PROPERTY !! No one owns these water’s except all residents of Florida. Overdeveloped has caused the problem of not being able to sit on your precious waterfront property with peace and quiet.

    On one hand, I feel for them, the public sucks and crowds trash everything. On the other hand, just because they built a house on a lake doesn't mean they own the lake. But the public should not be trespassing on private land. I do have empathy for them, not sure what the solution would be other than a lot of general law enforcement on the water to clamp down on drunks, trash and trespassing.

      No. It is legal for people to use the lake and operate boats. It is not legal for people to exit their boats and get on dry land anywhere on the shoreline of this particular lake. All of the shorelines are private property. There's no public parks or marina services on the lake, only private property. Apparently, there is a canal into the lake that connects to another body of water that has a public boat ramp. People are sitting in their boats, drinking and eating. Eventually, they get desperate for a place to relieve themselves.

    Reminds me of the Californians who bought all of the property on the Mckenzie river, east of Springfield, OR, in the late 80's.... They tried to stop the driftboat fishermen from fishing in the river from their boats.... So lucky when the Calfornians come to YOUR town.......

      Here in FL it's the NY and NJ people. I was fishing with my family when some rich NY transplant came down screaming about her pet fish and her water, and starting spraying the garden hose at us. We knew we had the legal right to be there so we didn't back down either and I was really getting concerned where it was going to end up. The sandbar across the channel was getting busy so a marine patrol came by and we flagged him down and first verified with him that my understanding of the law was correct (no private person owns the water in that location), then explained what was happening and he was nice enough to come have a chat with the lady. If looks could kill she would have killed us all, but she didn't bother us anymore. But it also ruined the fishing spot as that's no longer a pleasurable place to take my family fishing.

      I'm pretty sure that you don't have to do a lot of homework to know that someone coming onto your property to pee and poop in your bushes is illegal. Once you touch dry land or some's dock, you are trespassing. That's the issue that they are trying to address, not the fact that boats are on the lake. Littering, public intoxication, and trespassing are all illegal even if you have a legal right to operate your boat on a waterway. I'm not sure if you took the time to watch the whole video?

They are complaining about the fact that the boaters are coming onto dry land, which is private property, to piss and crap in people's yards. They are complaining about people who are cutting across private property to join people in their boats. They are complaining about the boorish behavior of public intoxication and littering.
      Yes, boaters have a right to be on public waters. No, they don't have a right to enter private property adjacent to public waters. No, they are not exempt from laws regarding public intoxication, operating a watercraft while intoxicated or littering.

      There's an adjoining lake which has one, a canal joins the 2 lakes , they are navigable waters and can be accessed legally . 👍😎😎

    Sounds like an HOA owned lake if there is no PUBLIC ramp. If people need to trespass to get their boat in the water it's a privately owned lake.

      I have a fishing shack on a point on a lake in NC. The parking is limited especially on weekends. So when someone new buys a place on the point we initiate them. We throw them a big Welcome to the Point party. Everyone’s house is open for the nosy ladies to walk through and we get them drunk AF. It’s hard to get pissed at somebody about their boat trailer being in your parking spot when you come in late at night or about parties that go on all night once you’ve been in their house and partied with them. Lol

    It's been awhile and probably should be fact checked but this is what I remember .
    I'mRead about navigable waters in fact . These folks have riparian rights but they cannot exclude people from these waters . But they cannot step foot on private land above the high water mark in non tidally affected waters . If you read about the history of the Internal Improvement Trust Fund here in Florida you will see property rights have always been corrupt . The sovereign does not own the lake but it holds it in trust for we the people .

      This lake has no public boat ramps but is connected to a chain of lakes by canal that do . So these boaters can enjoy these waters .

      And to clarify a bit . The state has title to the land beneath navigable waters when the state became a state . It is held in trust for the residents of Florida . The waters ( and probably the fish and wildlife ) are a resource that we all own but is managed by the state for us .

      The issue raised by the property owners is the fact that the boaters are, in fact, entering their yards to use the restroom and allowing their dogs to do the same. It also sounds like people are cutting across private property in order to meet people on boats (who did legally enter the lake). Once you touch dry land or a dock, that's trespassing. Additionally, the boaters are leaving a mess of discarded items in the lake, which is illegal.

    You can't own water ways. It's public. The fact that there isn't a boat tamp for the public, should be what this news station is focused on. The fact that their isn't a public boat ramp is why these people think they own the lake. Petition wintehaven for a public boat ramp, because it should already be in place.

    If it's "Navigable Water" then the homeowners can't stop people from boating on the lake but stepping off onto private property is not allowed.
    Some people think they own the Lake.

    All lakes are property of government, there should be a government boat launch area and sufficient parking. Unless the lake was privately dug out by a privately owned company/owner

      The entire lake is surrounded by private property. It’s connected to other lakes there by a canal system, which the boaters access the lake through. If the public wants, a petition can be started to get a referendum on the state ballot to have the Winter Haven city government, the county government or the state government to exercise imminent domain to have property condemned to install a boat ramp because it’s in the public’s interest. These homeowners need to be careful of griping too loudly or some citizen is going to mobilize the public and get a boat ramp installed.
