    Pirating a netflix show when you have a netflix subscription would be like pirating a game you bought on steam. Its not really pirating if you're technically paying it.

    • @ClokworkGremlin
      @ClokworkGremlin 5 ปีที่แล้ว +285

      That's how I feel about it. You already paid for it. You're already supporting the creator. I own Blu-Rays for Lord of War and 47 Ronin, but they don't want to play in my Blu-Ray player (they're legit copies) so I just downloaded and watched them instead.
      Way less morally questionable than downloading anime. You're allowed to have a backup copy. You're not required to be the person who *made* that backup copy.

    • @tiki2tgt
      @tiki2tgt 5 ปีที่แล้ว +12

      i think the reason why they pirate it is for everyone else who does not want to pay or whatever

    • @MattMcConaha
      @MattMcConaha 5 ปีที่แล้ว +107

      Kinda depends on the specifics of the platform. If you are paying for Spotify and choose to pirate your favorite artist's album and listen to it outside of Spotify, then Spotify doesn't give a fuck. Why would they, they still get your money. But guess who doesn't get the money? Your favorite artist. Spotify doesn't have to pay your favorite artist, because you didn't stream the music through Spotify. Spotify is still getting your 10 bucks per month, but now they just don't have to forward it to the artists. Hell, they even get the advantage of not having to store as much of your user data or expand their servers.
      I don't know the monetization system of other services like Netflix, but there are similar ramifications. A show you like is on Netflix, but you choose to pirate it anyway. Netflix still gets your money, they don't care. But the show you like doesn't get your stream numbers. If a significant number of people are like you and choose to pirate something instead of watching on the intended platform, then the platform will see that the show is not performing well. If the platform has to pay to keep the license for that show, then they might drop the license or negotiate down the licensing fees, and now the makers of your favorite show are fucked. They might stop making the show, or they might stop putting the same amount of effort into the show because it's not bringing in the same amount of revenue.
      I agree with what you're saying as far as non-streaming media is concerned, but paying for a streaming service is not the same thing as paying for or owning any of the content which is on that streaming service.

    • @dragon1130
      @dragon1130 5 ปีที่แล้ว +48

      Actually I think this practice is technically protected by law here in the states. If you already own a product you are allowed to make/obtain as many digital copies as you want so long as A) you do not sell or give away said product, and B) you erase or get rid of any and all copies when you relinquish control of the original product (in this case, Canceling your netflix subscription).

    You left one question open: WHY does Netflix strictly refrain from using the word binge?

    • @hayakagi
      @hayakagi 5 ปีที่แล้ว +564

      It's because of negative associations with eating disorders. They are afraid to be construed as normalizing bulimia, or even binge drinking, and so they are distancing themselves from the term. In addition one could argue that binge-ing anything is a form of addiction and they obviously would like to avoid being labeled as actively encouraging an addictive behavior. It's why Netflix does the whole binge watch thing in the first place. Because it can be addictive, its increases their retention numbers and is good for their bottom line.

    This situation somewhat mimics my experience with the Mandalorian series on Disney+. It released back in 2019 for the US, but here in the UK we couldn't legally watch it until the 24th of March. Not only was the whole show spoilt over that period, but when we finally got it... they forced the one-episode a week system into place. I personally enjoy a week to week episode system, what I don't like is being made to wait 6-months while a show is spoiled, then to only have to sit through an artificial watch-a-long. It's like they wanted you to go out and use 3rd parties to access it.

      I pirated the Mandalorian because there was no legal way for me to watch it, I have friends that decided to wait a year until the service was available in Mexico, it gets here and then, a year old show, that had been subbed and dubbed for months, came as a weekly release

      @@aurorasowerbii Digital Rights Management. Think of Denuvo, a company that works with major game publishers to make pirating their games extra difficult, and you should get an idea of what it is. There are arguments for and against DRM, but the general consensus is that it's a mostly anti-consumer practice as pirates have no problem getting rid of it while the people who legitimately pay are left with an inferior product. In terms of gaming, games with DRM patched in can struggle with performance problems and some require you to always be online, even if the game is meant to be singleplayer. DRM was way worse before digital marketplaces were more popular, with CD Keys, limits on how many computers you could install a game on, and more invasive DRM that slowed down both your game and your computer being frequent practices. In terms of streaming services, you have issues like the one outlined in this video.

      @@vaudevillain_2 It's essentially why EA had such a huge problem with piracy when SimCity came out. The DRM was so invasive yet unreliable that the only way to reliably play the game is to pirate it. If you bought a legal copy you would constantly be dropped from the game, losing all of your progress simply because their servers were unreliable, that way one of the "features" of trying to be honest and actually respect EA's property rights. With a cracked copy that wasn't an issue, you never had to worry about putting several hours of work into your city only to be booted to the main menu and lose all of that progress simply because EA had unreliable servers.

      True. And media companies somehow got to the point where they thought, or maybe just thought that they could convince people, that if you see or listen to something without paying for it, it is a lost profit for them. Well.. no. All the time that record stores existed, you could listen to an album in the store - and then not buy it - because you heard what it had to offer, and it wasn't for you. If it was for you however, you would actually buy it. I have a huge DVD collection, and it is thanks to the ability to pirate. Sure, I watched a lot more than I bought, but it is no different from the record store phenomenon. The company would never have gotten my money, anyways, for the movies that I did not buy. Yet, somehow they go to courts, pretending that they lost a sale.
      And lets not forget about all the purchases they gain from people watching/listening for free, becoming walking talking, free, billboards, - as they talk to people about what they saw and heard. These media companies should just sit down and thank people for not suing them for not paying for advertising for them.

Clearly people will pay for service when the media they want is easy to find and stream in good quality. It's just nowadays the market is so fractured that it's not only far more difficult to find the right sites with the right IPs, you have to pay for the service and remember to cancel it before the next billing cycle if that's all you wanted.

    Piracy is only unethical when there's a lost sale, and even then it could be argued it's ethically justifiable if the business in question is doing anticompetitive or anticonsumer practices and will reap a large profit anyways. That being said I generally buy all my media anyways unless it's like 2 decades old and out of print anyways.

    • @DairunCates
      @DairunCates 5 ปีที่แล้ว +8

      100% not true. Piracy doesn't need to "lose a sale" to do damage to an industry.
      Firstly, an increased amount of piracy makes it more common which makes it easier for people where it can be lost sale. The increase in piracy also crushes smaller competitors that can't afford piracy protections. This means that you're often helping solidify the monopoly of companies you intend to punish. If you look at the game industry, this is why SEVERAL indie games have straight up been destroyed by piracy.
      Secondly, the "no lost sale" idea isn't always accurate. Special pleading insures that a good amount of people will tell themselves they wouldn't have paid for a product when they would have.
      Thirdly, there is basically no respected ethics model where doing an unethical thing to punish an unethical thing is ethical. That action is, at best, neutral. Often though, you're providing a strong moral argument for the companies you intend to punish.
      Finally, in the case of anime, specifically, a lot of the piracy sites do specifically make money off your information and since they're a black market, they don't really have to have a TOS to protect your data in any reasonable way. So, when you use a certain russian site, you're actually funding sime illicit activities you might not want to, and you're giving away free information.
      That isn't to say there aren't times where piracy is justified. Game developers will often say that, "if there's no other way to play my game, then go ahead." That's the big difference though. There has to be no legal way to consume the product first. Not expensive. Nonexistent. At that point, piracy can help bring demand to a product. That's pretty much the line though.
      That said, the Little Witch Academia example is STILL a gray area. It technically is a case where you had no other option, but you would if you waited. There's no real indication of when or even if things will release. Netflix drops things all the time.
      So, I don't think Nick was in the wrong here. I am glad he didn't just assume he was justified though.

      Aren't there studies that show piracy actually increases sales? Cos its not a lost sale, its like people demoing whatever it is and ending up buying it where they never would have if they didn't have the demo to try. So it creates a sale.

    Netflix wants you to binge watch because it maximizes the amount of time you spend on Netflix. If you release shows gradually, people will only tune in every now and again for new episodes on the shows they want to see. Maybe they'll explore other shows after each episode, maybe they won't. However, if you dump entire seasons all at once, people will get accustomed to that and, rather than tuning in elsewhere or stepping away from the screen altogether, their next move upon finishing one show will be to find something else to binge. It is a conscious effort to shape the way audiences watch their content. That's why they don't like talking about it.

    • @p0rq
      @p0rq 5 ปีที่แล้ว +52

      This is a double edged sword, however. If people binge watch, they'll behave like I do: subscribe for a couple months, watch the content they want, and then dump it. Come back a year later, watch the new stuff, dump it again. That's basically an 80% dip in revenue, for a company that's already hurtling towards bankruptcy or else being bought-out.
      If you drip-feed, or wait 6 months to drop something, or release half now and half later, it gives people less reason to drop their subscription, as it's less hassle to just hang around to wait for the next bit of content.
      That's why, I think, they're actually moving away from the binge concept

    "No group is more accustomed to piracy than weebs" Ik Nick already explained why but I feel like this needs more attention. It is a really frustrating talking point, especially when legally watching anime, and reading manga/light novels is still a pain in the ass. Between Funimation and Crunchyroll there's still a lot of contention, especially because their business practices are being called into question near constantly. Manga is even more difficult to access legally, and light novel access here in the west is basically non existent, even with piracy.

      If you want to access media "legally" (studios get very little to no money from airing anyway) BUY MERCH, official merch, that's the actual way japanese entertainment industry makes money.

    I think binge watching should be a customer choice, not a provider forced choice, it's just bad customer service.

    • @ReneePrower
      @ReneePrower 4 ปีที่แล้ว +10

      A lot of people would argue that the classic method of releasing shows with singular weekly episodes is antiquated and frustrating. It's true that Netflix's binge culture can be grating, but the issue isn't having it all released together; it's when they hold back content which already exists elsewhere, as seen in this video. You can still choose to watch at your own pace when a whole season is released at once.

    US Netflix has already been doing that forever. Usually shows that don't get brought to US Netflix right away have copyright issues or royalties issues that haven't been resolved, and sometimes the original airing TV station bakes it into their contracts that the show can't be uploaded in certain regions outside of their own until it's all aired locally.

      Jeremy Testicleman Netflix “originals” are just shows Netflix has the exclusive rights to distribute online. E.G Little Witch Academia is a Netflix “original” despite existing before and Netflix having very little to do with the production. Another good example is Violet Evergarden, a show developed by Kyoto Animation based on a book that won their book prize, animated and produced independently of Netflix, and the marketed as an “original” work by Netflix. A lot of these IPs are independent franchises that Netflix really has no rights over other than distribution.
