Not a lawyer, but while everyone will tell you that it is illegal in Ontario to lane split, I would challenge you to find the HTA that specifies splitting, filtering, etc. Just remember that laws tell you what you can not do, not what you can. An officer may try to jam you up by applying another HTA violation based on his interpretation, but it would be very difficult to prove in court that you committed that offense. My advice, is ride safely and with caution, and don't ride on the shoulder since that does violate the HTA.
Although the ON-HTA does not specifically state the legalities of lane splitting/filtering, they can slap you with a careless driving charge (ON-HTA) or dangerous driving charge (Criminal Code of Canada). All at the discretion of the arresting officer. Generally, squad cars/SUV in Toronto have forward facing cameras, and they will use that in court, alongside the officer's arresting comments and notes to prosecute you.
