    Agree with Prof. Tribe. Forget about impeaching Alito and Thomas, more important things to do, like preserving US democracy. Secure the independence of the DoJ from the executive; amend the Constitution where necessary, so that no one is immune from prosecution by virtue of the office he held; enlarge the SC and appoint an Inspector General to oversee its ethics, as it seems incapable of policing itself.

      Section 3 of the 14th Amendment was as simple and clear as anything in the document, but this Court decided to make it all up with that opinion as well. It is a caseload vs. workforce issue. A pragmatic structural analysis comparing the First Circuit to the Ninth Circuit, the number of Circuits to the number of Supreme Court Justices and the extensive backlog of cases at every level provides observable, measurable proof our judicial system is fractured. The structural integrity of the judicial branch is at risk. We need a seismic retrofit.

      I sincerely deeply hate to tell you this, but they just did. The Chevron ruling this past week was just as impactful as the immunity ruling, but it's getting less coverage. It basically guts all regulatory authority from experts in respective agencies (something that has worked in this country for over a hundred years) and puts it into the legislative branch.     The Constitution is fine. It directs the President to "take care that the laws are faithfully executed" which requires an independent Department of Justice.
    The Supreme Court has directed the Department of Justice not to faithfully execute the laws, which prevents the President from fulfilling his Constitutional mandate so this is a Constitutional Crisis.
    The Justices that voted for immunity are giving aid and comfort to an Insurrection. Since the 14th Amendment was determined unanimously to not be self executing, in regards to states, we need the President to call for immediate legislation for its implementation. When that is resisted the Republican Senators and Representatives have also given aid and comfort to an insurrection. Not the Jan 6th insurrection but the one led by the Supreme Court who have weaponized their positions to destroy the government. If you look at it as a Conspiracy against the United States you can see how their decisions on gerrymandering, bribes being allowable gratuities, pregnant woman and girls have no rights to life, liberty and the pursuit of happiness, and other decisions are meant to divide and weaken the country. Their intent is clear in how their decisions depart from the Constitution and founding principles.
    If legislation isn't passed, the President can declare the 14th amendment is self enacting, by him, since the ruling was about states. It is a Presidential necessity in critical times like this so he can begin removing Justices and office holders that have weaponized their official positions in a civil war to destroy the Constitution and prevent the President from his mandate to:
    "take care that the laws are faithfully executed".
    Biden can't use the immunity, which is unconstitutional, but he can use the powers the Constitutional powers he has to try and stop the traitors.

    Professor, your observations are timely. Just yesterday, the UK elected a new government. The Prime Minister is now Sir Kier Starmer. He only entered politics ten years ago. He was precluded from expressing his party preference publicly before that. Why? Because he was the Director of Public Prosecutions for England & Wales - a national DA if you like. Such public servants are explicity forbidden to belong to or publicly support any political party, to prevent criminal prosecutions even giving the appearance of being partisan.

    Mr. Tribe, do you think there should be a minimum age so that the justices have more experience in both the law and life . There should also be a certain period of time e.g. 60 days for checking a nominee and a maximum period during which a vote must be taken. McConnell flagrantly used his authority when he did not allow a vote on an Obama justice and quickly allowed a vote to take place on Trump justices.

    "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States." - the President's oath of office. Does that not mean he/she is promising to abide by the rule of law, as set out in the Constitution? (Equal justice for all under the law.) How can it be an official act, if the President then acts outside of the scope of the law, and tramples over equality under the law for e.g. Liz Cheney? He then acts outside of his oath.

    Agree with Tribe on all counts. Of course! BUT! The MOST important issue TODAY is the electoral college. It has been a solution for a problem that has NOT existed for 100 years. It needs to be abolished NOW! That will take care of a raft of deeply embedded issues. The popular vote will speak directly to the fundamentals of our democratic republic. The outcome IS the will of the people!

    Not sure why people love to quote "No one is above the law." There are plenty of people who enjoy immunity when doing their jobs, the immunity effectively means they operate "above the law."
    -- Judges: Have absolute immunity from civil suits for monetary damages for judicial acts performed within their jurisdiction.
    -- Members of Congress: Under the Speech or Debate Clause of the U.S. Constitution, Senators and Representatives have immunity for legislative acts.
    -- Prosecutors: Have absolute immunity from civil suits for actions that are intimately associated with the judicial phase of the criminal process, such as initiating and pursuing prosecution.
    -- Police Officers and Other Executive Officials: Have qualified immunity, which protects them from civil liability unless they violated clearly established statutory or constitutional rights of which a reasonable person would have known.
    -- Federal and State Governments: Have sovereign immunity, which protects them from being sued without their consent. This extends to various government agencies and officials acting within their official capacities.
    -- Administrative Law Judges and Other Similar Officials: Have immunity for actions taken in their adjudicative role, similar to judicial immunity.

      Bad analogies. All of these are restricted by conflict of interest. More importantly, they operate within a framework of balanced powers, i.e. other institutions check on their decisions/performance, and have the power to intervene. POTUS and SCOTUS are/do not, apparently. Impeachment has proven to be dysfunctional. Politics is tribal now.

      And about all of that stuff is the more trivial CIVIL immunity as opposed to CRIMINAL immunity. Heck, the Supreme Court itself in Nixon v. Fitzgerald gave the president civil immunity from lawsuits. It's CRIMINALS who place themselves above the law (far more so than people who wind up getting sued for one reason or other.)

    Article I, Section 3 of the U.S. Constitution reads as follows:
    "Clause 6 Impeachment Trials
    The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.
    Clause 7 Impeachment Judgments
    Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law."
    Though any intelligent person would say it doesn't get more clear cut than that, apparently there are 6 Supreme Court justices who think the President IS ABOVE THE LAW. This is worth reiterating. A President may or may not be impeached by the Senate for unlawful acts, but regardless of that outcome, the President is still "liable and subject to Indictment, Trial, Judgment and Punishment, according to Law".
    Professor Tribe is spot on. We need term limits instead of life-long appointments for federal judges and Supreme Court justices, an inspector general, and the DOJ needs to be separate from the Executive Branch. In the meantime, the 6 SC justices that made this immunity ruling for the US President should be impeached and disbarred for so blatantly eviscerating Article I, Section 3, Clause 7 of the Constitution.

    If we left the nation up to Kevin Roberts and the Heritage Foundation we would all be yeoman farmers as visioned by Jefferson and the nation would be administered by Mussolini and some oligarchs. Our national transportation system would wither as it would be administered and funded by each individual state so you might go from a four land freeway in one state to a one lane cowpath as you cross the border and the economy would tank. Our school system would cease to exist and we would have to pay for education out of our own pockets and send our children to an independent school where the main subjects would be: the Ten Commandments and the Bible. Competing with students from the rest of the world would be out of the question. Any ideas or opinions that differed with the "Leader" would be forbidden and if voiced would get you sent to a labor camp. Our incarceration rate (already the highest in the civilized world) would balloon. Our nation would open up all federal land including the National Parks to drilling, mining and clear cutting. The only things valued in the country would be agreement with the Leader and money. We would turn our back on the Ukraine and we would quit NATO. Putin would swallow up the Ukraine then he would follow that with Estonia, Latvia, Lithuania and Poland. China would swallow up Taiwan. We would eventually forget that elections ever existed, like much of us have forgotten the rotary phone and we would all wonder how the world got so bad. This is what Fascism means. If this sounds good to you, you have a chance to vote for it in the fall election.

    Article 3 section 2 of the constitution gives Congress the power to make regulations and exceptions for Supreme Court jurisdiction.
    Quoted:
    “In all the other cases before mentioned, the Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.”
    A democratic Congress could do this. It would only require a majority, not two thirds, and they could bring to heel those little kings and queens on the court.

    I like the idea of a Constitutional Amendment. If the professor could outline the steps of creating one and how it would be approved, I’d like to know more and get behind it. I’m also curious if a military tribunal could be formed to bring the People justice on the issue of treasonous acts by the former President and now the courts? It just seems that our justice system has failed to deliver justice to the People and so now another mechanism should be put in place before Nov to ensure timely due process.

Especially if he appoints justices who’ll agree “This was an official act. It was perhaps illegal…something we the SCOTUS ruled we may not even investigate… but we the SCOTUS have ruled that the POTUS can act boldly to govern and hence can apply illegal measures.
