    What if, Navient transferred your loan to another “company”, does that mean these people will be excluded from the lawsuit?

      I believe that if it was transferred, then your loan will not be forgiven.

    I have been with Navient for many years. I graduated in 2000. I deferred for many years however I’ve been paying back since 2002. I have FFEL loans. Navient never explained anything to me. My loans were originated by sallie mae- I recently on 1/14 consolidated to fedloan into direct loans in hopes of qualifying for PSLF waiver - I’ve worked in govnt for 17 years. I feel my loans will never end and surely it should not have taken 20 years to pay off 50k . Is there anything else I can do?

      I'm in the same boat... this program doesn't even exist anymore. That should be grounds for forgiveness right there. I'm sure there is a large number of people this applies to.

      UPDATE- my loans were forgiven under the PSLF - waiver program . All $37k- GONE. I submitted my employment verification after I consolidated. Whole process took about 2.5 months 🙌🏾

    This settlement leaves so many gaps out. I went to Everest institute/ Corinthian college and they were over inflating the job options and placement rates well before 2003 but people like me are screwed cause we weren't taken advantage of recently enough. I was never informed of the income based repayment, only forbearance. Had to go through a rehabilitation program after they started garnishing my pay in order to get into a positive status. My ibr is basically zero because the education i got there doesn't really help me in the job market. My request to discharge war rejected during betsy devos time as the education secretary so of course im screwed. Navient is paint money back in this settlement but it was well worth the trade off for them to pay this money when you compare it to how much government cash they got during this timeframe. Smh this sucks

    My husband only took one semester of classes through Devry that he never finished and now owes over $30,000. Did not receive a single credit. He was basically coerced into it telling him he would need it to become a contractor which we found out down the road was very untrue. When you're young and gullible you believe just about anything. We filed borrower defense over two years ago and still have not heard anything from anyone. Normally we're getting the regular we're going to sue your papers but for the last two years after we sent that in we've heard absolutely nothing. Navient was the original loan holder but it's been swapped around to a few different companies now. Come to the point with their own children that we don't even want them to consider college unless they are absolutely certain about it and it's needed to further what they're trying to do. We'll do everything in our power to make sure this never happens to our kids. Long hard life lesson learned.

    I have 3 private loans with Navient. One is still on my credit report and charged off. The other two were charged off, but fell off my credit report on Dec 2020. I cannot figure out if the 2 loans that already fell of my report are included or not. I attended a Career Education Corporation school and received these loans between 2003-2005 from Sallie Mae.

    I had SallieMae, fortunate enough to pay it all off in time. SallieMae apparently split and is now Navient. Due to the current atmosphere, they then “transferred” but practically the same entity and is now known as “Aidvantage”. Same BS, nothing new just a different name but same animal.

    Thank you. Last year Navient suddenly "uncovered" a 20 +/- yo private loan..already paid ..that disqualified me from any ID loans.

    Yes, they need to remove from this settlement the provision that the loan has to be in charged off status since June 30, 2021. This is unfair and as you mention in the presentation , I made those payments bc of fear of my credit scores which were going down and loosing everything else with it and I and my co-signer were receiving threatening calls from Navient . I froze all aspects of my life just to barely pay the forbearance and not the actual principle payment . I still have the loan and need help..

      This settlement hasn't been approved yet, you can contact your state's attorney general - I doubt, but still hope that this provision would be deleted from the final version.

    What about co-signers? Is there any relief for them with the private loans? It's very difficult for a co-signer to get removed.

    Please give me information on how to contact the Attorney General of my state to plead to have the (7 month no payments before June 2021 provision) removed before the finalization of the settlement.
    That is not fair to exclude someone who tried to repay on their private student loans, were told by Navient reps that they had to make payments even after being informed that you didn't have the money to pay on those loans.
    My school I attended was (IADT) International Academy of Design in Tampa, FL.
    My loans were taken out between 2003 - 2007.
    I have moved back to and live in Michigan since 2013.
    Please let me know who I need to reach out to about this ridiculous provision based off what I have listed above.
    Also, let me know how to contact whomever I need to in regards to this.

    So if you took out private loans with a co signer to attend a for profit school (I went to Art Institute) the provision of delinquency doesn’t apply? I obviously had a low enough credit score they required a co borrower. But I don’t know the exact score at time of the loan. 2007-2008

    I have an odd situation. I have Navient held FFEL loans that were consolidated in 2002 when I graduated. I worked in non-profits while paying 120 payments on those FFEL loans but left that job in 2017 to work for a govt contractor that I still work for. I used the PSLF tool before the cutoff and its saying there are problems with certifying one of my non-profits since it closed (that was how I lost my job there). Im wondering if I should even bother Consolidating my loans to a direct loan and trying for PSLF and am now wondering if I would qualify for the PSLF or if I would be eligible for this. I went to the Art Institute of Ft. Lauderdale which was one of the schools that closed but I made payments.

    Thanks for this video. Nelnet does the same thing. They never told me anything about PSLF and I work for a non-profit company since college. These loan companies are awful. They are out to make money rather than encouraging younger generations to get a college degree.

    This was a very helpful breakdown! To clarify, if you did attend one of the schools (and you had a private loan disbursed during the time frame), did the loans still need be past due or charged off prior to June 30, 2021? There has been a lot of confusion surrounding this. Many have speculated that attending the school alone qualifies discharge (if all other criteria has been met, outside of the past due provision). Would love to know your take on this. Thank you!!

      Yes, you need to meet all the requirements, not just attending a listed school. I feel that it's unfair to only apply to those who are in charge off status. But that's what it is.

    I attended The Chef's Academy in 2007 in Indiana and moved to Virginia in 2013. My question is I paid my private loan off in 2019 through then Sallie Mae/Navient would those of us that did that receive some kind of refund for the payments we made? And what do we have to do to have it discharged Federal education wise because they say I still owe. I was one that did bankruptcy in 2013 and the lawyer then said my student loan along equal the amount of three new homes.

    Greetings from Florida. My loans were transferred from Navient to AidVantage as well and when contacted. Both companies stated that if I wasn't contacted by the Attorney General it's a loss cause. -_- I don't know what to do now.

    I just refied my house to pay off my student loans. I have been making payments for years. Navient sold my loans to Fed loans years ago. When the refi settled, the payment to Fedloan was more than what why loans where. Fedloan still has not released the refund of the over payment. I am one of the people that was under the loan forgiveness if you work for the government for the impoverished. I went to University of Phoenix and Cappella, and Ashford university. My question is now that I have paid off my loans do I get a refund of the money I paid in.

After DISCHARGE is approved - I read the IRS will have us report the DISCHARGE as Income, Please provide advice or Guidance if this happens ???     What happens if Navient put everything in default when you asked for income driven plan after being in forebearance for 10 years, then they find they tripled your accounts (7 to 21 accounts) and closed all but one account and return it to Navient. Navient during covid said account was up to date and then passes it to advantage? Sounds like more of the same. My loans were UofPhoenix (Sallie Mae, NJ) 2008? Can Navient pay on your behalf just to say you are current so they don't have to discharge?

    Anything in the works for other servicers like AES? I fall in the same exact criteria but my loans were with AES, defaulted after been in forbearance after graduating from one of those for profit schools in Tampa.

    I covered all of those except I actually kept up with my private loan payments. She even mentioned my college. Completely unfair. A loan is a loan and I needed to make sure those payments were kept up. It feels like I got 9 out of 10 and there is still a possibility of being denied.

    I had Sallie Mae and I believe at one point Navient and then it moved to Nelnet and my loan amount is high 6 figures and it's due to continuous forbearance... I'm in Human Services and had an IBR plan of $0 and now the forbearance...It just keeps growing...smh

    I’m in Nc it sounds like you’re describing me and my situation to a T. But I went to ECPI- I didn’t see my school on the list 😩 after some time I was put on income drive so I guess I wouldn’t qualify because of that! My FICO score was LOW at the time I got the loan - putting myself in this massive debt for a useless degree was the most irresponsible decision of my life!

    Sounds like I qualify for this settlement on my private loans, yet am confused because they been sending letters to my cosigner about being sue if no payments are made in the next 14 days as of Jan 12; yet I am getting emails about a repayment settlement to be discharged at 70% of what I still owe! What should I do? Should I wait it out or settle because I can't have my cosigner or me get sue, please help me thank you

    I don't understand why the fed loans aren't getting the cancellation benefit of this settlement. My loans with them are federal, but everything you just described happened to me. When I was in my early 20's and did not have a great income, they directed me to forbearance instead of income driven payments. My paid interest capitalization has quadrupled my paid principal. I still owe a ridiculous amount when you consider I have been paying on these loans since 2007. I feel I've been cheated by Navient, even though I take full responsibility for my loans, I don't think these terms are in any way fair.

    Can i ge clarification. I had a part time job and i belive no credit score when i took out my first Sallie Mae loans for a private no-profit collage not listed (Ringling Collage of Art and Design). Do I have to meet both qualifications, both a FICO below 669 and attended a listed school, or can it be any collage and a below 669 FICO? I've read the listing on the navientagsettlement website and still don't understand. thanks for the video btw!

    Navient just discharged my loan. I owe nothing, I paid so much money for so many years and went into forbearance couple times. I even went from paying my loan and having nothing to eat.

      @@rn4life297 nothing, they sent me an email saying my balance was forgiven and I owe $0 dollars. They also reported it to the credit bureau. So in June my credit score will adjust

    I was in chapter 13 and was told couldn't dismiss in bankruptcy. Then when bankruptcy was over navient started sending letters. When o investigated no one had answers I could not figure out why this company I didn't borrow from got my loan and no one could tell me how navient got my loan. Ended up they forced me to do rehabilitation even though I didn't owe them. Then they forced me to go to rehab and agree to immediate 17% interest added. They told me I couldn't do forbearance if i did not agree to the extra interest and my wages would be garnished. So I was forced to agree to rehab by a company that didn't really own my loan. By the way nelnet said my loan was paid and it was forgiven by them when I filed chapter 13. But navient claimed it and strong armed me into paying them for it when I never borrowed from them.

    We've been paying since 2015-2016 and still owe the same thing 7k..and they got us to forbearance 2 times for a year each and we filed bankruptcy in 2020 and they didn't help us at all!! Now they sent out loan to fed loan a month ago....because we asked for help during covid with student loan forgiveness for the public service workers and we are so confused.

    I filed bankruptcy in 2015 and was told I couldn't include my Naviet loans and my Fico score was low. I hope that means my loan will get discharged. I went to University of Phoenix

    I meet all the requirements but during the 7 months prior June 30th, 2021 my loans were in deferment due to furthering my education in a master's degree program.       Based on what she said, unfortunately sounds like your loan(s) would not apply, but contact your attorney general office??? Good luck. I don't qualify at all ..don't live in a qualifying state

    They took money out my check every week and i tried to tell them i need a lower payment but they did not want to. Then they switch my loans to somebody else and i still owe the same amount if not more than when i started paying. And of course i dont qualify because im in texas and i went to the art institute of dallas and they also did not teach me what i went thereto learn. So many issues with the education system. The teachers there even said i dont know why ya are in these classes they are a waste of time and ya dont learn anything. Went for 3 years part time for animation and never learned animation...

    I did not know Navient used to be called Sallie Mae. If that is the case, this is exactly what happened to me when I was under Sallie Mae. The amount of interest capitalized is due to this exact tactic, they would always offer me a forbearance rather than the income driven program which I knew nothing about until much later. However, I incurred my loans before 2003. This is predatory behavior.

    My friend meets every condition discharge under the private loan discharge, except the 7 mo continuous charge-off because they were in the Covid relief program. Now they are 7 mo past due, in pre-default, and recently homeless living in their vehicle. This is SOOOOOOOOOOO unfair. 13k is now 36k, such BS.

    I'm from Florida and took out private and federal loans in 2003 to attend International Academy of design Technology but the school closed in 2015 because of fraud allegations. I was delinquent on my loans last year buy not sure about the dates prior to June 2021. I used up all my forbearance and they put my on an temporary income repayment plan.

      I would definitely consider filing a Borrower Defense app for the federal loans for IADT. We have several of those pending, and expect that ED will include IADT to the discharge list much like it did with ITT Tech in June. It doesn't sound like you were in charge off status as of 6/30/21 so your private loans would not be discharged in this settlement. One option is a settlement or filing bankruptcy and claiming a partial or full discharge of the private loans however and you may want to discuss with with us.

      @@ArkovichLaw Navient sold my student loans. All they did was change their name from Sallie Mae to Navient and now Aidvantage. My private loan was 5K and accrued up to 10k, never could pay it down. Same with Federal 50k is now close to 100k...I can never pay this off. I did file with Borrowers Defense 2 months ago and nothing happened yet. I paid extra every month and nothing went down. Your help is greatly appreciated. I hope it still will cancel even though they transferred my loans. I have written a lot of folks in office and it is like they went ghost

    I have never heard of Navient. Who are they? My student loan is 34 years old. The contract I signed in 1989 for this loan states, "Upon successful completion of this course the student will be given job placement. If for any reason the student does not receive job placement the student is under no obligation to repay this loan." Yet, the US Department has been fraudulently stealing my money since 1992 and I have repaid the entire balance of the loan plus all of the interest and the US Department of Education is still stealing my money, 34 years later. I have filed, four times, forms that the US Department of Education has sent me to stop this theft and of course even though I complied with all of their demands they have not stopped defrauding me. I have met with the IRS, to no avail. The US Department of Education attached my federal tax returns and then slapped this debt onto my credit reports in the 1990's and destroyed my credit and my career claiming I was not paying when I was. I have lived in Colorado since 1992 and I filed a lawsuit against the US Department of Education here in Colorado but the Judge called me on the phone to tell me he was dismissing it without prejudice because I have to file in Sacramento. Exactly one year ago I filed additional forms that the US Department of Education sent me to not only stop this but to receive a negotiated settlement from their Borrower Defense office in Kentucky. I have received a total of 6 emails from them, all stating 'we're still working on it' until last week on 18 August 2022 advising me that they tried to lump my claim (which exceeds $4Million at this point) in with other such claims (because they thought they could get out of this on the cheap) but on 18 August the Judge threw their case out. This 8 page email does not mention anything called Navient? Now, I did try to file this myself via California's 'self-help' website but there are 63 different forms listed on California's self-help website and not being an attorney I don't know which to use. I did write to Dianne Feinstein and Alex Padilla and both wrote me back to say its not their problem. I contacted the Court in Sacramento who told me to call any attorney in Sacramento and I called 9 law firms all of whom told me they have never filed a lawsuit in Sacramento and as such could not tell me the form number i need to use to file my lawsuit. There is no federal agency more corrupt than the US Department of Education and it needs to be shut down completely before they destroy anyone else's life. I will not settle and I will not walk away from this.

    I’m from Oklahoma and my beauty school experience was HORROR. My instructors were drug addicts and pedos. An I probably won’t get loan forgiveness just cause I live in Oklahoma.

    I got screwed by forebearing my "student loan" which added a good chunk on top of my origional principle and they charged me monthly to have it in forbearance. 10+ years after originating the loan, I still have the original principle + $1000 i owe.... finally start making money, and inflation hits lol. I haven't received 1 cent of student debt relief for my private or federal student loans, and it looks like I never will. Federal student loan doesn't qualify because it's the wrong kind lol. Not to mention if I had been paying on it for 10 years and hadn't missed any payments, it would probably be almost gone anyways. This is a joke!
