If the car backing out has it's view blocked by, for example, a van with no windows, people coming down the street should recognize their view is blocked and stop when they see the car easing out. If the car trying to back out has a passenger, that person can get out and serve as the driver's eyes to tell them when it's safe to back out. This situation is more about reading the environment and being courteous than what a specific law states.

There are 3 lane positions for a biker to occupy. The car does not have the right to take any part of biker's space. Why do you think the person in the car would not take half or 1/3 of the biker's lane if the biker had been in a more "dominant" position ?
