      Not really. Far from it. Governmental corruption is almost exclusively the sole cause of the recollapse (the first collapse was after the Apartheid regime got the whole country sanctioned, which was one of the major reasons they surrendered to the anc to begin with) of the economy.
      Either politicians are blatantly stealing money, or SOE are failing to perform in a way that is profitable (such as sars refusing to perform lifestyle audits or municipalities letting people have access to water and electricity despite owing large bills).
      BEE on the other hand has been very successful. It is almost single handedly the sole reason for the boom of the new middle class where previously most of these people were squashed into homelands by the apartheid government and specifically prohibited from working in many higher profile roles as a result of their skin colour.
      BEE and similar initiatives is also the reason South Africa has so many working women compared to the male dominated industries of before.
      The only hiring practice that is failing the country is the companies in some industries failing to adhere to the "local first" principle.

    Honestly the damage BEE has caused even if removed right now, will take at least 2 generations to fix. Many of the most sought after skilled fields most graduates and professionals have left to greener pastures, including myself. As a white man in SA having had 10 years of IT experience and had a Masters degree at the time and many certifications, I was looked over in many positions, but the moment I applied internationally I got replies on most job applications within a week having my first interview already. Go where you are valued. SA doesn't value professionals and the dumb president keeps talking about 4th industrial revolution not realizing there are no professionals to fill the positions required for these skilled jobs. Many of the professionals in IT fields are from other countries and most people don't realize how many of SA's software engineering jobs are done by consultants from other countries as SA doesn't value software engineers as much as other nations. In fact if you go to jobs boards from SA right now and search software engineer and Netherlands you'd see how many of the engineers are being scooped up by other nations, this is on top of the fact that there is only a handful of software engineering graduates every year and the market growth is by orders of magnitude larger every year than the amount of graduates coming out of university. SA is only going to be left behind or have to pay a pretty penny to bring in skills as most people don't want to move to SA as it's one of the worst choices in the world.

      I think you mixing BBBEE and EE, your argument is on Employment Equity Act and the judgement is on BBBEE.

      @@tolanekotsi7939 I think you are skipping over the blatant problem that all of these are based on race, which is exactly what apartheid was. So it doesn't matter if you call it BEE/BBBEE/EE or affirmative action. The predicate stays the same that these policies are based on race purely to benefit a majority against a minority and should in actual fact be the other way around when looking at all 1st world nations. In other nations the minorities are given preference, but what most minorities in SA want is just to be treated equally which was agreed upon by all at the table at CODESSA and only the Bantu went against this agreement, all other groups have remained true on the agreement. Just think what uproar there would be in south africa if it was the other way around like if there was a thing called White economic empowerment and Broad based white economic empowerment, there would be riots in the streets, just think about it.

      @@kazykamakaze131 I totally disagree and it does matter because the scope is different. EE is a workplace policy in which both the previously and historically disadvantaged are given preference in the workplace. This is done to redress the ills of the past in which the minority had absolute monopoly of better positions based on their skin color. These minority group used to have better opportunities and the government of the day would spent R 9 more on their education than it would on a black child. It goes without saying that all workplace must reflect the demographics of the society in which it exist. Now I challenge you to read all comments and you will notice that almost 95% of these comments think the video/article is based on workplace EE policy which is not the case. This was only based on Preferential Procurement Regulations of 2017 and how did that kill the South African economy escape my mind. The question Is BEE helping or hurting South Africa's economy? and the heading BEE rule struck DOWN by Constitutional Court | Piet le Roux did not help. No mention of the Preferential Procurement Regulations of 2017 which only requested 51% ownership of the black people. So context and perspective are key here.

      Brilliant. I love your way of thinking brother. I wish there where many more like you around!!! BEE is an absolute sham, designed to serve those that are already connected. It causes normal people like you and me to don't even stand a chance. And dare I say it, the more "black" brothers we can get to stand up against BEE the sooner we will be able to defeat it! The whites, on their own, will have a much harder time, because they are constantly being shown the "red" (racial) card, which does nothing to move us forward as a nation!
      I longed for a free South Africa where black and white would finally stand on equal terms! I still long for a free South Africa where black and white can finally stand on equal terms! First it was captured by white elitist, now it is captured by black elitist, each serving their own interest!

    Good work, one down many more to go. The manner which BEE has been implemented has caused the destruction of the South African work force, SME and ultimately the economy. It may be realistic to allow that the intent of BEE was to share “wealth” in ZA, how it was implemented however was equivalent to people at a sale where the connected got richer.

      Because this is old news. The judgement was made last year already and was suspended for 12 to this day I think. The judgement was not against the BEE act but against an illigel framework called the PPPFA. I don't think the interviewer has a slightest clue what he is talking about, that Piet Le Roux is just accomodating his stupidity.

    BEE has irreversibly ruined the economy. Hitherto, RSA had an exemplary record of foreign debt repayment . However our trustworthiness and ability to repay , is in junk status like most economies on the dark continent.

    BEE is now entrenched in the business sector and its a little too late sadly. Minority candidates are no longer attractive prospects for companies to hire in SA since none of them can even be classified under 'critical skills' on the BEE-rating application. They have been excluded whereas only Black and Chinese can be used. These policies are some of the major contributors driving graduates and new business owners out of the country. Instead of it being a free-market which enables economic growth, BEE is the red-tape you can't avoid.

      @@dannyarcher6370 yes, they are considered for BEE'S critical skills registration. The Chinese govt wrote to SA to include their citizens for this policy and ANC approved. White, Indian and colored are excluded from being classified as 'critical skills', at a corporate level its virtually non-beneficial to employ minorities anymore.

      Only in low skills job. In other types of jobs they have went out of their way to avoid BEE and its values.
      The overall aim of BEE was to circumvent cultural favoritism (a black qualified female who does not speak a lick of Afrikaans and partake in the Afrikaans corporate culture would naturally usually lose out to even a lesser qualified candidate just because that candidate is of a certain ethnic group).
      Although this type of favoritism hiring is unethical, in first world countries it is not specifically outlawed or condemned since those being hired fall part of the majority populace anyway.
      In South Africa the opposite is true because those being marginalized are usually part of a previously disadvantaged group. and them not getting the job despite being qualified has heavier consequences to both that candidate and his community compared to the other who will simply go back home and keep playing video games until another opportunity arises.
      Same goes for gender policies. Women and especially women of colour come from positions of disadvantage far more than men. Same goes for foreign workers vs local workers.
      BEE, Gender diversity, and the "local first" directives exist to encourage hiring practices that have a positive impact to the immediate community where the business operates.

      Local Chinese weren't included, until 2008, when the Pretoria High Court ruled that the South African Chinese community were "black" for the purposes of the BBBEE Act, as well as the Employment Equity Act, after a legal challenge by the Chinese Association of South Africa.
      In fact pound for pound, given the size of the community, Indians have been possibly the prime beneficiary of this policy.

      @@agrid2608 Have you applied for BEE certification within the past year? As a business owner I have and what you arent aware of is that under "critical skills" and in terms of weighing points, black and chinese individuals can only be considered when populating information for employees in learnerships, apprenticeships, internships and graduate roles. What this simply means is that if you are a CEO and recruit 10 indians, 10 colored and 10 whites as juniors.. you technically cannot include them as part of your matrix when adding points for skills development. Somehow people who have been in this country for 20 years like chinese have more rights than people who have been here for centuries. None of these amendments are gazetted because govt know it will cause a shitstorm, you will only know this if you ever sat down and submitted documents for a BEE cert as a corporate business enterprise. My point being what incentive is there for businesses to now employ minorities, there is none. BEE is just reverse racism

    Many local manufacturing Businesses HAVE collapsed over the last 25 years, due to this Rule!
    Therefore In some spaces, Goods Have had to be imported from China and Jobs to South Africans have been LOST!!
    Tax has been Lost to our Country for infrastructure., Schools, university’s, Hospitals! Etc.

    The best equipped person should get the job. Unfortunately, South Africa has lost many proud South Africans, who cannot find jobs here, even though they are highly educated and skilled. This has also adversely effected our sportsmen and women , many of whom now represent other countries - not by choice but by force.

    Two points from the Constitution's Clause 9 on Equality (note my capitalized words):
    (2) Equality includes the full and equal enjoyment of all rights and freedoms. To promote the achievement of equality, legislative and other measures designed to protect or advance persons, or categories of persons, DISADVANTAGED by unfair discrimination MAY BE TAKEN.
    (5) Discrimination on one or more of the grounds listed in subsection (3) is unfair unless
    it is ESTABLISHED that the DISCRIMINATION IS FAIR.
    Bottom line: the Government (ANC) is left as sole arbitrator of who have been disadvantaged and is given carte blanche to enact legislation to "promote the achievement of "equality". The ANC is therefore FULLY entitled (by the Constitution) to discriminate against whoever for whatever reasons they may concoct. BEE is therefore Constitutionally sanctioned. And the Constitution is therefore not worth the bytes it occupies on computers.

    My family and I have suffered tremendously under BEE. After independence I returned home to SA to help build a new nation - bringing my wife and children with me. BEE directly discriminated against me and my family as I am a white male running my own business. My wife is from Senegal and all of us are South African. Our children came home from school one day horrified by having to raise their hand in class as the teacher asked the children in the class to identify with a race depending on their colour. They told me they did not know if they were... We had never thought of colour as a barrier in this great new nation. Constantly get calls from companies wanting to check our BEE status and so on. I tell them I refuse to support BEE and will never hire staff based on race - we hire the best staff according to their abilities. I recently emigrated from South Africa with my family to resettle abroad - a very sad ending to our dream of returning back home to SA to participate in nation building of a non-racial society in my home country. I would return home if BEE was found to be unconstitutional and I would sue SARS to get all my VAT back. I'm still owed over 870K in VAT by SARS who refuse to pay. SARS syphoned all the capital out of my business in the end by failing to return our VAT on exports for years. When my cashflow was exhausted I then lost my suppliers, my customers, my business, my marriage and family and my home.

    How to unwind BEE is the question...
    How to allow companies to reverse decisions on historical hiring practices that were made under threat of BEE sanctions...
    Quite simply if a person (especially in management) was a BEE "token" then businesses should be allowed to terminate such hires due to the fact that the hiring criteria was indeed unconstitutional.
    If the "BEE hire" has proven to be an asset to the company then no action should be taken.
    If however the "BEE hire" has not performed or is performing in a sub-standard way, the company should be allowed to replace them now with someone who is competent and who will be an asset to the company.
    *NO MORE "JOBS FOR POLITICAL FRIENDS"*

      All the damage started way back with Apartheid. The Apartheid demon trained and left us all, including the victims, with a horrible legacy of how to divide, discriminate, racial hatred, dehumanize, steal, be corrupt, murder and get away with it, degrade, disregard, classifying humans with labels etc etc.
      There is no place in the world who has more experience than we Souh Africans about apartheid, which scarred the more the soul of billions, than the mind. All who turned a blind eye to it, actually accepted it, enjoyed it, protected it and are guilty of it.
      All because of the demons like evil greed, power hungry, selfish, don't want sharing, other races are not allowed to flourish, slavery, rejection, jealousy, not allowing the sun to shine on us all, not loving our neighbour as we love ourselves and the list is never ending .
      What about the people of other colour that left and fleed this country through this very demon which tarnished generations way back then? What about the lingering damage which still continues through the past denials of education, equal rights etc.
      Be careful people of SA. Never forget the bad history and legacy which was now rekindled in this BEE way "what you do to others wil return to you". Never forget how it impacted humanity and the future of the majority. Many still suffer the impact as it ruined livelihoods of most generations.
      Sober up, history never goes away, instead it will rather repeat itsself.
      Dear evil Apartheid-your aftermath is greater than what you started. You humans who were not a victim since it's birth, you or our siblings won't have clue what this is all about. There is no pretty way of painting it and we still experience it daily. To this day sense, smell the odours of the apartheid designers inches away, leaving us with goose flesh. They look and act innocent, with a best interest in the welfare of all, but they are not since we know their strategies. All the good experienced leaders who would have made this world work for us, unfortunately were all laid to rest.
      The sad thing is, will we allow it to continue even after removing BEE? When you need to see the the true character of a man , give him Power: MLK. Will we victimised again?
      We fight not against flesh and blood, but against powers and principalities of evil in the heavenly realms. Where does that leave our precious souls? Will there ever be peace in this our beautiful land?.
      In the end, we are the course of our own destruction, which is why you get what we call the worst wars of all time , which is a war amongst ourselves. Civil wars.

    BBBEE and Affirmative Action and Quotas are the reasons myself and all my friends emmigrated.
    Massive loss for SARS and skills in SA, big win for transformation.
    Metaphorically, in Apartheid 1975, at least you had black toilets and black beaches, sub standard to white toillets and beaches, but they existed.
    With Apartheid 2022, BBBEE, you have no white toillets nor beaches, so not even substandard. Just no opportunities. So where else can white people go other than out of South Africa?

    It didn't help SA's economy at all. As a widow I am suppose to be a breadwinner. Because of BEE I am without a job and or ANY income whatsoever.       The intention behind it is sound, but it could be improved to serve its purpose better than it's been doing. I think it should have been combined with other measures, like a nationwide intentional racial integration.

    Vietnam has 309 hydro electrical power plants ,what about SA ,when we have Vaal & Sterkfontein dams.
    No qualified technicians, all the experienced folks , are sitting at home ,while BEE inexperienced folks
    are working & earning money 💰 but not knowing the job.
    I see stupid mistakes on documents all the time, but the state wants people to be whistleblower, when they cannot protect the parliament from arsonists.
