      What needs to be used literally? The term jurisdiction has a specific legal meaning, if a person is not subject to jurisdiction, then they cannot be brought before a civil or criminal court. These are issues dealt with in the first year of law school (I am an attorney). "Anchor babies" as a phenomenon can be easily controlled by prosecuting birth tourism, making the parents permanently inadmissible, and securing the border. If Trump succeeds in stopping illegal immigration, why do we need to change the Constitution that can only end in all sorts of problems.

      Would you trade that for the progressives wanting to amend the 2nd Amendment as well? I am not willing to make that trade. Enforce and secure the border, prosecute people who come here for birth tourism and that will mostly take care of the problem. No need to mess with the Constitution.

    Not Going to Happen: Its simple its the 14th Amendment; so you have to propose a new Amendment redefining citizenship; you have to get a super majority of Congress 2/3 66% of agree from both chambers and get 3/4 of the states to agree to ratify it 38 states its mathematically not going to happen

      birthright citizenship was created by SCOTUS in 1896. Congress never wanted it and the executive branch fought against it. "Subject to the jurisdiction"

    An illegal alien is not subject to the jurisdiction thereof - therefore their child is not unless they are legal citizens. My understanding is that the 14th amendment was passed to grant citizenship to the children of slaves after the civil war. I believe the Supreme Court could interpret the 14th Amendment based on it's original intention. Personally I'm very in favor of legal immigration but not illegal immigration.

      Your understanding is incorrect and in conflict with the plain legal meaning of the term "jurisdiction". The attorney in the video explained it clearly, if an illegal alien is not subject to our jurisdiction, then they cannot be prosecuted or even sued in civil court. Illegal immigration can be solved without having to mess with the Constitution and open up a dangerous can of worms.

    I get what this guy is saying, but he's glossing over the original intent of this policy. The politicians back then made a huge mistake by putting that into the Constitution - it should have just been a temporary law to help those who came out slavery.

      The 14th Amendment is not just a "law", it has governed due process protections and even second amendment rights on an individual level in the states. Before the 14th Amendment it was possible for states to restrict all sorts of rights on the basis that the bill of rights was not "incorporated" and was supposed to only deal with federal laws.

    This guy needs to go back to law school. This amendment is a misinterpretation issue and doesn’t need to be ratified. “subject to the jurisdiction thereof” needs to be clarified. A foreign alien here illegally is not under our jurisdiction because that person’s allegiance is to a foreign nation.

      It doesn’t have to end- then 2nd part just needs to be upheld- subject to the jurisdiction of- illegal immigrants are not subject to the same laws because they are not lawfully here. Meaning we can’t force them to join the military or do jury duty. Their citizenship is with another country & thus should be their loyalty. That is all we have to do is enforce it. Meaning the millions of undocumented immigrants- people who deliberately hid from our Govt while illegally entering the country-who had babies here on purpose to take advantage of the laxxed enforcement- where neither parent is a citizen- those children are not US Citizens. We don’t have to change anything. Just read the law

    Being a legal tourist, work, or study visa is NOT good enough under European Union rules. And The European Court of Human Rights approves of this law. It is worth nothing that both the United Kingdom and the Republic of Ireland had to terminate what Americans are calling "birthright citizenship" in order to join and remain in the European Union (EU). Their national laws had to be changed so that citizenship was only gained by being born there is the mother or mother's husband were in the country as citizens or permenant residents. Again, being a legal tourist, work, or study visa is NOT good enough under EU rules.
    The UK has since left the EU, but not because of this issue.

    My grandparents were born in Arizona in the late 1860’s but not granted US citizenship so the birth certificates say Mexico. Native Americans were not recognized until 1924. My father their son, was born in Arizona in 1924 as a US citizen.

    This is the second most absurd situation after the open border policy. I know individuals overseas with no ties to the U.S. who work with agencies to arrange accommodations and necessities for pregnant women traveling here on tourist visas. These visas, intended for tourism, are being exploited to give birth in the U.S. The women then return to their home countries, ends up with a U.S. citizen child whose upbringing and circumstances remain unknown. This practice isn’t just fraudulent, it’s deeply unfair to those who invest hundreds of thousands of dollars for visas or green cards, endure years long waits to become citizens, and spend thousands more on immigration lawyers

    Birthright citizenship doesn't only apply to kids from illegal immigrants or tourists but also applies to kids born from legal-resident, non-citizen parents (like anyone here on a legal visa, like work visa, green card, ...). Many of those parents became citizens themselves after long wait times and complying with the many rules. Many kids never lived in the country of origin and don't even speak that language. That is the result of those parents integrating in the US and raising their kids to be good US citizens.
    Trump's description about given citizenship when hitting US shores doesn't even apply to 'birthright citizenship'. He talked about an unrelated rule that allowed Cuban refugees citizenship as soon as they reached the Florida beach. Nothing to do with births.

    Factcheck: America was not founded by immigrants nor was it created for immigrants. The founders all came from families that had already been in the eastern USA for multiple centuries.
    The term "under the jurisdiction thereof" at the time of its ratification meant you are loyal to, not whether you are exempt from the law. It was never intended to apply to children born on airplane in the sky to foreign nationals nor was it intended to born to anyone else here on a temporary basis such as temporary workers.
    Further the act of being born on American soil and getting citizenship as a result is something you do for yourself. A birthright is something you get from your parents and grandparents and ancestors. It is not something you earn nor is it something you acquire on your own without any kind of input from your biological family. The citizenship accorded by the 14th IS NOT birthright citizenship but is in actuality Constitutional Citizenship. People need to learn what a birthright is.

    He is wrong when he says constitutional amendments must go through Congress. The US Constitution itself contradicts this claim. Congress doesn't have the power to change the Constitution, only the states have that power. What Congress can do is propose amendments and the Constitution says they need a 3/4ths majority to do so. But Congress is not the only branch or even the only people who can propose and submit amendments for ratification. The states can also propose amendment as can groups of Americans and individual Americans. Even the president and members of the Supreme Court can suggest or propose amendments but only the states can actually ratify and enact such amendments. Trump as a US citizen is within his rights to propose an amendment. Congress can debate and endorse the proposal but none of that means anything. Only the states can change the Constitution.
