  • Following the recent Nintendo leaks, rejoicing video game historians were met with cynical debates on ethics. People were understandably weary of touching stolen material, but maybe that is tackling the issue from the wrong angle? Because on the other hand, it's futile to deny now public information. So shouldn't culture for once be liberated from the shackles of capitalism?

    this pretty much hit why i think moral conversations around this & piracy aren't worth as much as people think they are. especially when talking about huge companies

      Companies rarely care and simply do not have incentive to do it either. Most of the time at least, if it is not connected to money.

    I feel as though the only actual "problem" with the gigaleak is how there actually WAS some personal information in there, such as emails and passwords, but given how old some of them were we can hope that its all outdated and no one involved can be harmed, otherwise let the leaks flow. show me the all the goofy old pokemon sprites (though iirc in a tour of gamefreak's office they mentioned that most of the WIP pokemon art for the older games are gone due to the process they used at the time but they are better at preserving that now)

    Imagine if somehow we could materialize a full step by step video on how the Mona Lisa was painted and also scrapped early versions that show how the ideas for the painting and its meaning slowly formed and it was just out there for people to see but then we burned it down because it was all "stolen IP". Yeah. This video is great.

      @@Transparencyboo I keep basically everything i download or create for this very reason. Having copies of information in multiple places (even if the only other copy is my home computer other than the server the info is hosted on) can only be a good thing when it comes to preserving data.

    Your editing is some top-notch stuff, I love how much humor you seamlessly pack between all those tasty informationey chunks. And the Patreon read-outs were a blast. The true Geneva Convention breach is this channel not receiving more views.

      Aw, thanks! We think it is super fun to just add visual humor to our stuff rather than doing long skits. Makes it flow a lot better if you ask us. We find doing the patreon crawl is really fun, espeically if it is not the same thing everytime. Gives us an opportunity to put some work and effort into them and show that we really care! Also, yes, we should have more views. But alas, we are biased in the question, haha.

    I think the thing that baffles me the most about what was discovered in the Gigaleak is the uncompressed StarFox 64 voice acting, knowing they re-dubbed the game from the ground up for the 3DS version.
    It's bad enough when Konami and Square-Enix lose assets; it's just baffling when Nintendo HAS the assets and just arbitrarily refuses to use them.
    What was also weird was keeping all that unused Argonaut stuff when their actual claim to ownership of it is questionable. (especially considering Nintendo was outright accused of using those assets in their N64 material. Regardless of how true or false that may be, holding on to the stuff all these years kinda doesn't help their case.)
    It's particularly weird since Argonaut seems to be a special case in regard to Nintendo keeping their stuff; these leaks didn't include any huge databases of Rareware or Squaresoft content from the time.

      We suspect that Nintendo did not even know that they had the uncompressed voice lines. And that is a bit worrying in and of itself. They need curators and people to actually go through all this stuff and organize it properly.

    Didn't see many of the other leaks myself, but the Pokemon ones were pretty fun especially seeing unused models for older games that came back as/inspired new designs later on.

      The Pokémon stuff is always quite exciting to be honest. There is something just so charming about seeing creatures you love in a completely new context, or what could have been.

    Idk. It's a bit conflicting. I'm sure the developers of these games don't want people to see the brushes and buckets they use to make their game. They only want people to see the finished art piece. Perhaps they are not aware or do not want people to see what goes on for fear of companies or others copying their ideas. But in that same light, the ideas are so old they're practically obsolete at this point. I suppose a good median would to make a museum of this stuff to satisfy the people who are actually interested in this kind of stuff

      We think there is value in showing off the process and iterations famous games went through. There is a lot to be learned from how Nintendo make games. Sadly a lot of the times the artist does not even have that much to say on the matter either, Nintendo owns their creations and all the material that were created up to the point of release. That is a problem in and of itself.

    Great video! I didn't think of the gigaleak like this. While it would be undeniably awesome for Nintendo to share their archives, I don't think that will ever happen. If Nintendo would acknowledge the value of their unused material, they wouldn't share it, they would sell it.

      True. We absolutely, sadly, agree. They are a company first and foremost and as such they are not simply interested in providing for culture in and of itself. Maybe in a better world.

      They could make a museum and charge an entry fee, maybe. Then they'd be both sharing _and_ selling it. That seems a decent compromise to me, at least for now.

    I dont know why hearing about "Video games as a culture" almost makes me cry of feelings, but it does. I know im one of those people who think it is, Its so beautiful!

    first: i literally snort laughed at the pandora's box/mario bit, thank you v. much
    if anything nintendo should be able to share this kind of data to everyone with little issue. game archives are starving for more information, especially when old tech is dying and making it difficult to play/save data. I'd argue that the ethical thing to do here would be to save them as, like you mention, "important historical/cultural objects"
    (p.s. you bring up a great point comparing the Streisand effect and nintendo's reactions to leaks. they really should be able to better handle this kind of thing by now.)

      Not to mention if they release the stuff themselves, or give it to others for preservation and showcasing, then there can't really be leaks, hehe. Fool proof way of mending that leaking pipe.
      Really though, thanks, we are really glad we made you laugh. That Mario bit was actually added in last second because Kiki wanted to add the box visuals and then Alicia went there.

      The emails we had on screen were from Argonaut, who were involved in making Star Fox for SNES. The Fuck You from Pilot Wings is just amazing though. Bet it was Miyamoto.

    The fact that people who keep sprites on hand for every new game, can turn around and say it's "unethical" to look at old unused sprites is wild to me. This is the only fandom who's like.... Took that approach to unused content I've ever heard of. As someone who, sadly, is into Bethesda games... That's not a fuckin thing here

    Wish this was common practice among game devs, seeing the process behind art is always enlightening... even under the suffocating grip of capitalism, why not make a documentary and sell it as dlc?
    Imagine how much content video game trivia youtube videos would have. The possibilities are endless.

    This was a fantastic video Id love to see more of your work!
    I think the debate of if Nintendo is ethically obligated to preserve and show this work (at least many years later) is an interesting one. But the fact they even preserved it suggests that they do care to an extent (at least the developer side).
    I’m not sure I would go as far to say that they HAVE to show their work, I’m sure just like any artist, there are ideas that may have been scrapped for a variety of reasons and maybe we should respect that the artists and developers simply don’t want to show it, it’s like if I make a bad drawing on my sketchbook I wouldn’t wanna show it out of embarrassment or something. But it is a bit dumb that they don’t even showcase these more, after all there’s SO much content, I bet people would love to see more. I would at least heh.

      Of course it would have to be curated, it is just a shame that they don't really seem to interested to show this stuff off more in controlled environments. Like you could make entire video series where they show old concepts and talk about the thought process, why it changed and all that jazz. That is more what we're thinking. They have planned to open a museum at one of their sites by the way, who knows what they will have there exactly, but hopefully they'll have some obscure never before seen stuff there.

      I do agree they should talk about it more in their own controlled space because I know for a fact a lot of people would pay money just to see that. I totally see your point, hopefully that museum you mentioned does feature a lot of stuff we never knew!

    Beautiful video and argument. The discussion of the ethical imperative of developers to keep and share the fruits of the development process for larger cultural is not something I'd thought of before, but is so right.

      I am not sure we mentioned this in the video, because it probably hadn't been announced yet, but Nintendo is opening a museum in Japan. However we doubt it will reveal too many secrets, haha.

    I can see why Nintendo may want to keep most of their archive behind closed doors so competitors won't steal/copy them. But still, I would love to see all tge information! Imagining having a museum to commemorate all the info that helped shaped game development and game culture! I'd cry if I was a game historian to have this info public

    I really wish these companies just released old stuff so that people could just enjoy things that people spent so much time making, and understanding what went into it.
    An old game being your IP that only you can sell doesn’t really matter when it’s just as impossible for someone to play on your console these days as anyone else’s, and production material for games, like you said, is the stuff people would literally pay to see talked about, but it’s just sat on for decades where nobody can see it for the end goal of... maybe referencing it for a remaster in 20 years?

    I do think there's a line between what should and shouldn't be shared though. There were documents shared that had people's private info, right? I agree companies likely would never share something unless they had to, but idk if throwing all the info out without consideration of private info is the answer.

      Of course it would have to be curated and looked through by people with appropriate qualifications. We are of course not proposing that Nintendo simply throw their folders out on the internet like it is nothing, haha. This would require dedicated staff basically. We agree that private information (like the e-shop credit card leaks) is not to be taken lightly. There is much to consider.

    Even as a Nintendo fan watching this now, I am with you (mostly, I don't think the little jab to smash online was fair as that's more due to player connection than nintendo) there is no point debating ethics or emulation with the biggest company in Japan! However I feel we should still respect the developers at Nintendo. Because in most cases, leaks are just unfun spoilers, THIS is different since it's about games that came out 20-30 years ago!
    But again, I admit my bias as I love Nintendo!
    (Also one last thing, Nintendo love holding onto everything about a game, that hasn't changed, they would never burn away all that)

    The creative process tends to result in lots of scraps, preliminaries, rough drafts, etc. As long as the creator has the physical/digital space to keep these things, there might be little reason to destroy or throw them away. Even if there is fan interest in such artifacts, they might be awkward to publish; perusing material that was not meant to be seen in the first place, the novelty quickly wears off.
