'Shows a lack of respect:' Judge steps off bench after 'rude' line of questioning by Travis McMichae

- Judge Timothy Walmsley says he had to step off the bench after 'rude' comments were made. According to the pool reporter, Jason Sheffield began filling a couple of big pages on his board and it was all very visible to the gallery.
Judge Timothy Walmsley was not pleased with this and said this type of behavior will not be tolerated. Says he had to step off the bench.
Ahmaud Arbery was shot and killed on Feb. 23, 2020.
Cellphone video leaked to the public shows two armed white men in a truck approaching the 25-year-old Black man as he runs down the road. One of the men, later identified as Travis McMichael, and Arbery struggle over McMichael's shotgun before Arbery is shot and collapses.
Travis McMichael, his father Gregory McMichael and William "Roddy" Bryan, who recorded the video, are all charged with murder in Arbery's death.
I respect this Judge as a man and a human being. This is what a balanced scale of justice looks like.
And everyone was worried this judge would be too lenient on defense cause usually he is more more lenient to defendants. And I am guessing he is that way because he sees a wrong in other cases.
I, also respect this Judge! If only there were ways to clone him for all courts throughout this corrupt system

They should aspire to be able to read a simple statute correctly and not give the wrong jury instructions that result in conviction of 3 innocent men.
All that was required to stop Arbery was reasonable suspicion, which despite the DAs attempt to obscure was exactly what they had.
Their conviction was wrong and it should be reversed on appeal

If that is the case anyone can accuse anyone of anything and be allowed to kill them when they tell you to get out of their face. The young lady that accosted the black chiod in New York is facing 10 years because she left her phone in an UBER and accused the young man of theft, she attacked that young man she is charged with assault and battery and several others. No one is playing with you crazy people that think you can harm someone over what you THINK. TRY it and see what happens. You can end up in jail for false imprisonment, assault and battery and murder.

@@annocsunamoon according to the previous Citizens arrest statute reasonable suspicion was all that was required to detain a person.
The question is whether or not the Mcmichaels shooter pointed his gun before Arbery tried to take it and did that nullify the lawful Citizens arrest .
At most the shooter was at jeopardy but neither of the other men should have been convicted... very possibly not even the shooter

This guy has been one of the best judges I’ve seen in a major televised trial. He isn’t playing games with either side’s lawyers

People forget just how bad Judge Ito was. That guy allowed a clown fiesta to take place in his court room.
He doesn't have to play games at this point, all the games were played already, before the trial started in discovery when he handcuffed the defense lawyers with the things were able to talk about, example, Arbery has ran from law enforcement 10 times in the past already, he had no idea if the McMichaels were law enforcement or not, however the state got to show that law enforcement normally wears uniforms on patrol when we all know there's undercover cops everywhere... I won't go into the other things at this point because I'm sure if there's a guilty verdict it will be overturned for these and several other things
The more I see of this judge, the more I like and would love to see him advance to an even higher position in the judicial system. We need many many more judges like him.

Basically since Ahmaud didn’t steal/burglarize anything, the defense attorney basically is trying to get the officer to say that he responded to the house because Ahmaud burglarized. It’s all about how they ask the questions. Instead of asking the officer if what Ahmaud did could be considered burglary; the defense attorney made a statement and tried to get the officer to agree. At the point it’s like the defense attorney is testifying and that’s a big NO.
What is important to remember here is, the defense attorney cannot answer questions that he just asks for the wittness. He had been repeatedly warned about his outrageous behavior. He cannot tell untruths such as, Mr. Aubrey was stealing because the home owner said he did not. The video of him in the home proves he did not. They cannot link this murder to another robbery had happened by unknown person and without evidence because it is not relevant. The question before the Jury is ONLY if these three defendants committed a crime not the police, not Mr. Aubrey.

WTF are you talking about? Just because "them guys" claimed there had been robberies in the neighbourhood doesn't mean its true! No home robberies were witnessed by the McMichael's or anyone else in the area. Travis reported his gun missing (from his *car* it should've been locked away in his home) but again there were no witnesses. Just lots of assumptions because they'd seen a black guy jogging in the neighbourhood.
"Them cops" can't just apprehend a person because someone believed (without evidence) that he might’ve done something illegal! That would be like me telling police I saw you in my neighbourhood and you seemed strange. In addition a few cars had been stolen and I'm sure you did it. Would you expect the police to run over to your home and question you? Would that be fair?
And no, the defence lawyer cannot sue the judge, prosecution team or the police for defamation or anything else. That's madness! Apart from the fact he wasn't defamed, the defence lawyer did not follow the judges direction correctly and deserved the dressing down he received. As for "them cops" they did their job well once they got the necessary evidence. You do realise this murder was covered up for about 2 months because the incriminating video wasn't handed in? Active duty police apparently knew about it but didn't investigate because McMichael Snr was a retired police officer and had worked for the DA.

This judge takes his position seriously and exercises his role with decorum and fairness. I have nothing but respect for him. I think the way he conducted himself, and this trial, should be a model for all criminal proceedings in the US. I've never seen one on a highly publicized, televised trial such as this be less controversial. He was personable, polite, ultimately professional, and even showed a sense of humor when appropriate. What a great man.
The plaintiff’s lawyer is very keen too. I’d not be surprised if the judge makes it to the Supreme Court in less than 10 years!

A Judge has a duty to maintain decorum in the Courtroom. We attorneys sometimes allow our passion to overcome our common sense, which leads to getting checked by the Judge. I think the Judge handled this very well and made his point.
Not an easy job. Trying to maintain grace and composure when the other side is either just plain lying, or creating such a distortion it is beyond belief. I get it is their job. But still.

The police should never have allowed McMichael to clean his hands at the crime scene, or his neck for that matter.
Why? I mean they were upfront that they shot him after a scuffle, so the blood isn't really telling them anything new. And cleaning wounds is not only an important part of first aid, it also gives a better view of what wounds are actually there.

I'm confused also as to when pre-February 23, 2020 information "completeness the defence has" the police are told by the state they don't need to collect (and only casually and don't need to follow up on McMichael's three times stated claims many burglary, car break-ins, etc. are going on besides just the eight this detective has done since 2015. If the state wants that to be Gregg McMichaels "3xlies" then why are they then so interested in keeping all the rest of Gregg McMichael's information following Ahmad's shooting to the two months before they get arrested. That is keep only the facts that condemn them and throw out facts in this case that may be evidentiary support to "justified citizen's arrest" in any way! Very confusing!

“Reserved” is a better term for what you are saying. “Conservative” (and yes, I am referring to the word in an apolitical manner) means adverse to changes or innovations over tradition or status quo. That is not this judge. He was very clear about his tolerance of unorthodox methods and approaches… he has a long leash. It just goes to show you how far this attorney abused that tolerance. In the face of that disrespect, the judge regulated his own emotions very well. He is the opposite of the judge in the Rittenhouse case, where the judge (who likely favors traditional methods) was not at all reserved and regulated in his responses.

@@sherrienale9974 I’ve asked defense lawyers about that. They say that everyone is entitled to a fair trial; they say everyone is presumed innocent until proven guilty; and most of all they say it’s the duty of the prosecution to prove their case.

I'm an attorney. Because of my type of practice, I rarely enter a courtroom. Nonetheless, I've had enough experience to see good and bad judges. I won't comment on the bad ones -- there are plenty -- but as for the good ones, they are admirable. A good judge not only needs to have a good handle on the law (especially evidence), but s/he really needs a certain type of balanced temperament that is not easy to manage and does not simply come with intelligence. It is a different quality.
And why we can't get a Judge like this on the Supreme Court? Much respect for this Judge for his understanding, compassion and upholding the law.

This judge is a true professional and cares about what he’s doing. I’ve watched this trial from start to finish almost and the way the Judge conducted himself was top notch. Exactly what you want to see in the justice system.

@@dcan5012 Both the judge and the prosecutor in this trial were on point. And I agree with this outcome. I don't like the outcome for the Kyle Rittenhouse trial but from a law perspective I thought it was right. I respected the judge in that one too, and the prosecutor was just terrible.

Everytime the prosecutor asks questions and a response from the witnesses..one of the defense start coughing because they don't want the jury to hear it. . I thought I was the only one noticed it because I haven't seen any comments about it.

I have never in my life heard counsel accuse a judge of being confused in that manner. Completely disrespectful. The judge handled it as a judge should. No theatrics, no threats, just a calm reminder that some restraint might be in the attorney's best interest. Firm, fair, and leaves no doubt in anyone's mind as to who is running the show. Well done.

Wow, this judge is very impressive and can see through the shenanigans to forcefully and respectfully let the attorney know the tactics will not be tolerated. We need more judges of his caliber.

I love this judge. Very fair, very respectful, and you can tell he has a real love for the law. You can tell he was one of those law students that wanted to make a difference. We totally need more judges like this.
As a person with a criminal record and who's been in jail a few times, I must say that I absolutely love Miss Donakowski! That woman is so knowledgeable and so very articulate. And the judge too, this man is incredible!

@@mougen4138 Rittenhouse's judge wasn't biased, this one wasn't either. Rittenhouse's counsel generally played it very cool in the courtroom while Binger did some very questionable things that raised questions among some people about prosecutorial misconduct. If you can think of an instance where the judge showed clear bias I'd like to see it. For the most part the issue was that the law and the facts were biased against the prosecution, not the judge.
