I didn’t get why people argued he didn’t deny it when he very clearly did. I gave people running with that narrative the side eye. These allegations, if untrue, are unfortunate. Whether he wins or not, his name will be forever tied to this. Most people don’t look at the facts, don’t follow the case as it plays out, and aren’t loud if it proves untrue. Michael Jackson’s fans have done documentaries, 20 episode podcasts, set up websites with trial transcripts and all original evidence and there are a lot of people who’ve never seen it and haven’t taken any of into account in forming their opinion. Ron you should look at the original filings. Some of the “facts” have been altered. Like at first the driver said be back by 9:30 then in the second filing there was no time since the award show didn’t end till later than that.
I find this very frustrating as a survivor. That lawyer is playing games with people's traumas and people's reputations for a quick buck. It's definitely extortion, and it's more harm. I don't believe JayZ had anything to do with it. And I believe she needs to go to the police if something this horrible happened. But there's SO many holes in her story. A 13yo walking half naked who-knows-how-far to a gas station in the middle of the night on the ONE night where police presence at afterparties was GUARANTEED, and no one noticed? Her dad did nothing? There's holes I could drive a semi through, and I'm not a lawyer. Her in a courtroom would be a disaster.

If this plays out and we do find that it’s a false accusation or a crooked lawyer, I do think it’s harmful for people who have real stories. We just gotta wait and see what’s what i guess

I’m afraid we’re going down a meg/tory esque lane with judgments based on partial info. Her account describes being at the party, interacting and then going to a room. We certainly cannot establish a timeline either way with the details that have been shared, even with what I’ve added here. But that works both ways. Can’t discount her story based on seeing him elsewhere that night. Bless.

If she were to go to law enforcement they’d say it’s too late. The only recourse now is civil suits. I see why Buzzbee would encourage anyone coming forward to go the civil route.
@ there’s also a federal case against Diddy for Rico. I don’t know why he won’t turn everything over to the Feds to help the prosecution of Diddy and others if true. The survivors can still sue the celebrities even with a criminal case ongoing. If you’re seeking justice, wouldn’t this be a good chance to pursue it? I don’t get it unless he wants to use the Feds as leverage for a payout to keep their names out of it. But it will only work if every celebrity pays. If someone takes it to trial, everyone’s name will have to come into through discovery.
@@coursecorrection4105 hey so I’ll have to disagree here. I’ve looked it up and this is technically incorrect. There is no statute of limitations to report the case. But there is a statute of limitations for the case to be prosecuted. In other words, feel free to report it but it won’t be prosecuted. The limitations were only extended after metoo in 2019. One of the goals of the metoo movement was to extend the statute of limitations of prosecution. This was extended only temporarily in NY in 2019 for adults and only civil suits can be brought. It was amended and I believe Cassie was able to file just before this law ended. Difference being Cassie was an adult. The law as it stands now has no statute of limitations for reporting case for underage. Previous to this, people who were assaulted underage could only file suit civilly if they were 23 y/o and under. It has been extended to 55 y/o and under. This is why now these suits are being filed. There is very little criminal or civil recourse to be had in sexual assault cases before 2019. I believe the statute of limitations for civil suits prior to this as minor was: has to be reported under 23 y/o and you have 1 year to file a civil suit.

And she still waited around for the driver to drop them off at the party, then come back to get her. What did she think would happen with a grown man that likes 13 yr old girls?? Just stop for a second and think about you sitting in tenth floor NYC apartment and you see what looks to be a 20-year-old woman screaming running down the street. The likelihood that anyone from your building is going to put on a jacket and go downstairs to find out what happened to her is very slim. Why do I say 20 because there are girls (and I was one of them) who looked like they were 17 or 18 at 12 .. looks to be all of 21 years old at 15 or 16 based on development/articulation. And secondly , we have no idea what she told her father or what happened after what evidence they have you’re not getting the whole story today because it’s not time to reveal that that’s what court is for, and the only reason we are hearing about it because he refused the mediation. Jay Z has a lot of power and influence. He could’ve easily sat down and listened, proving himself innocent and gave her nothing or gave her a dollar just to prove a point since he’s so outraged. However, because of how fast did he settled with Cassie there is no way that he was going to have his image tied to paying out any kind of money to anyone the likelihood that he could’ve harmed someone in the early 2000s is pretty high, especially if you take what we mean by harm at today’s standards.

If you’re innocent, you’re innocent period. Jay and his team trying to make this woman give up her anonymity is super suspect, why would you need to specifically prepare for this woman if you didn’t do anything. Her name coming out would almost certainly lead to her being harassed nonstop.
It could absolutely lead to harassment from crazed fans and general public but also he has a right to prepare a defense, no? What Jay’s team are saying is, with the identity revealed then they can find witnesses (partygoers, gas station attendant, limo driver, etc) It’s really up to the court to decide based on precedent. I think the question is does she legally have the right to remain anonymous.

She’s leveling this claim that has already damaged his reputation. Aside from that his children, his wife are all affected. You can’t swing in the dark and properly defend yourself. That is essentially what he’d be doing if her identity is kept under the layer of anonymity from his legal team. The point of naming there was no amount mentioned is to establish it doesn’t fit the definition of extortion wherein the request is coupled with an explicit monetary ask. Also most of us are still learning so it’s not me finger wagging but let’s be more mindful about not saying things like “to make it easier to have s*x with them,” when in reality the phrase is “to make it easier to r**e them.” Third, there’s a possibility that the alleged victim’s identity would be revealed just to Shawn/his legal team but not the public, which to me seems more responsible bc what value is there in us knowing her name? Lastly I’m really concerned about how anyone could have a genuine opinion on whether this is about justice or not when so few of the details of the actual even lt have been shared. That opinion seems like it could only be based on* high regard for the person being accused and that’s a really terrible way to operate mentally.

Excellent detailing of the facts here. It's also nice that when an opinion is stated amongst the facts, it is made clear that it's an opinion. That being said my only problem with Jay's route is that isn't making an accuser and or witnesses publicly known a good way to get them disappeared, or at the very least harrassed and bullied? I have a feeling that both sides aren't being compeletely transparent and facts/truth lie somewhere in the gray area.
Let's start to use critical thinking.. a 13 year old on a school night got into a limo the driver randomly just telling her puff like young girls without knowging her, goes to this party sign a NDA at 13 no ID which im sure is required l, gets drugged and rapped by 2 grown men somehow either fought them off or escaped while being drunk also made it to this gas station (drunk and physically/sexual assaulted) in 2000 where the use of cell phones and navigation even google is pretty much non-existent to a 13year but she made it to this gas station somehow and calls her dad to pick her up real late all on this school night in 2000.. ummm.. yeah ok.... make this make sense!!!
People are confused by the extortion part. Jayz fighting it shows hes willing to hold the alleged victim responsible for her accusations if they show not to be true. I never understood how people would be comfortable with a settlement or payout if their true goal was to get their abuser to serve justice. Ig we’ll see how it plays out. Accusers who are found to be lying should be held accountable and see jail time or fines.

Jay is sneaky, convincing and has a good poker face. He convinced people that him and Rhianna never had a sexual relationship when they did. He said that he didn't stab Un when he did. He's allegedly been behind artists being blackballed but doesn't speak about it etc. One part of his response letter that was weird was when he mentioned being from Brooklyn and something to the effect of "we don't do that kind of stuff..." Which was irrelevant and untrue. It had nothing to do with the case at hand and people from Brooklyn to commit these terrible acts and so do people in cities all across America. It seemed he stated this because it could cause people from Brooklyn to rely behind him. He also said some other things in that letter that were weird and irrelevant. It's very likely that Jay knew about the accusation before the rest of the public and had time to strategically craft that letter. It didn't sound like he quickly wrote it. The young lady wants money and I think she deserves it if she was a victim. Her lawyers also will get a nice cut Initially she didn't mention Jay's name but she also didn't mention the name of the celebrity woman who allegedly watched. Of course, her lawyers are handling the dealings of this case from start to finish so all of her moves are based off their advice
I believe everyone deserves their fair day in court; however, mechanisms and tools exist that allow a defendant to mount an effective defense without revealing the victim’s identity. It’s likely that a criminal case cannot be filed, as it is probably past the statute of limitations. My guess is that the plaintiff would prefer confidential mediation for two-thirds of the defendants because the first defendant’s alleged crimes are already public knowledge. By not naming the other defendants, they may avoid the case being thrown out due to their desired anonymity or the alleged victim being forced to publicly reveal their identity if the cases go to trial. This approach seems like a strategic compromise, allowing plaintiffs to keep the case private while avoiding public exposure. While extortion is always a possibility, most victims of these crimes are ordinary people who cannot shield themselves from the public scrutiny and vitriol that victims of grape and SA often endure. Whereas a billionaire like Jay-Z will likely still have the ability generate wealth, pay a high fine, and still not have to go to jail. Reputation is important, don’t get me wrong, but I just don’t believe Jay-Z’s life would dramatically worsen as compared to this normal person. However, he has the right to defend himself. Respect to Elliot, but we can already see how public opinion of this person is shifting-even though they are likely just trying to avoid having this lawsuit define their public identity for years. It’s important to remember to give alleged victims the same benefit of the doubt we extend to celebrity plaintiffs.

It’s not clear what’s going on with Celeb B, at this point Jay’s name is already attached. He absolutely made a decision by not adhering to the demand letter, he had to know it was gonna go public and seems willing to fight. Feels like he’s willing to fight public rather than pay for something he’s claiming he didn’t do privately.
Jay Z and his lawyers would have the identity of the accuser, the public would not. The letter confuses people who don’t know the law nor understand that what Jay Z wrote was not a denial it was an attack letter. He said don’t sue me civilly, take it to criminal court. Two things, rape convictions are about 6% in criminal court, that bodes well for Jay Z. The burden of proof is different in Civil court and he knows that but most of the public doesn’t. That letter told me more about Jay Z’s underhanded character than was clear before. Please reread it without reading into it.

There was never a Jumbotron outside Radio City. I used to work on 52nd and 6th at the time and we could see the awards and people pulling up from our floor. If that's the year Em did "The Real Slim Shady" with all the Em clones, there was MOST DEF no Jumbotron or screen outside. On a lighter note, Christina Aguilera gave me a hug that day lol.

Just playing Devil’s advocate the laws I believe in Ny/Nj is that it’s a 20 yr statue of limitation on a statutory 🍇 case I believe. Also, Jay already had ppl following the lawyer who is a big time lawyer and harassing the lawyers family! I didn’t get why people argued he didn’t deny it when he very clearly did. I gave people running with that narrative the side eye. These allegations, if untrue, are unfortunate. Whether he wins or not, his name will be forever tied to this. Most people don’t look at the facts, don’t follow the case as it plays out, and aren’t loud if it proves untrue. Michael Jackson’s fans have done documentaries, 20 episode podcasts, set up websites with trial transcripts and all original evidence and there are a lot of people who’ve never seen it and haven’t taken any of into account in forming their opinion. Ron you should look at the original filings. Some of the “facts” have been altered. Like at first the driver said be back by 9:30 then in the second filing there was no time since the award show didn’t end till later than that.

I find this very frustrating as a survivor. That lawyer is playing games with people's traumas and people's reputations for a quick buck. It's definitely extortion, and it's more harm. I don't believe JayZ had anything to do with it. And I believe she needs to go to the police if something this horrible happened. But there's SO many holes in her story. A 13yo walking half naked who-knows-how-far to a gas station in the middle of the night on the ONE night where police presence at afterparties was GUARANTEED, and no one noticed? Her dad did nothing? There's holes I could drive a semi through, and I'm not a lawyer. Her in a courtroom would be a disaster.

We certainly cannot establish a timeline either way with the details that have been shared, even with what I’ve added here. But that works both ways. The survivors can still sue the celebrities even with a criminal case ongoing. If you’re seeking justice, wouldn’t this be a good chance to pursue it? I don’t get it unless he wants to use the Feds as leverage for a payout to keep their names out of it. But it will only work if every celebrity pays. If someone takes it to trial, everyone’s name will have to come into through discovery.
@@coursecorrection4105 hey so I’ll have to disagree here. I’ve looked it up and this is technically incorrect. There is no statute of limitations to report the case. But there is a statute of limitations for the case to be prosecuted. In other words, feel free to report it but it won’t be prosecuted. The limitations were only extended after metoo in 2019.
One of the goals of the metoo movement was to extend the statute of limitations of prosecution. This was extended only temporarily in NY in 2019 for adults and only civil suits can be brought. It was amended and I believe Cassie was able to file just before this law ended. Difference being Cassie was an adult.
The law as it stands now has no statute of limitations for reporting case for underage. Previous to this, people who were assaulted underage could only file suit civilly if they were 23 y/o and under. It has been extended to 55 y/o and under. This is why now these suits are being filed. There is very little criminal or civil recourse to be had in sexual assault cases before 2019. I believe the statute of limitations for civil suits prior to this as minor was: has to be reported under 23 y/o and you have 1 year to file a civil suit.

And she still waited around for the driver to drop them off at the party, then come back to get her. What did she think would happen with a grown man that likes 13 yr old girls?? This makes absolutely no sense. If this is true, which I highly doubt….her parents/guardians, the driver, and every other adult that encountered her that night, needs to be held accountable, not just Jay Z.

Just stop for a second and think about you sitting in tenth floor NYC apartment and you see what looks to be a 20-year-old woman screaming running down the street. The likelihood that anyone from your building is going to put on a jacket and go downstairs to find out what happened to her is very slim.
Why do I say 20 because there are girls (and I was one of them) who looked like they were 17 or 18 at 12 .. looks to be all of 21 years old at 15 or 16 based on development/articulation.
And secondly , we have no idea what she told her father or what happened after what evidence they have you’re not getting the whole story today because it’s not time to reveal that that’s what court is for, and the only reason we are hearing about it because he refused the mediation.
Jay Z has a lot of power and influence. He could’ve easily sat down and listened, proving himself innocent and gave her nothing or gave her a dollar just to prove a point since he’s so outraged. However, because of how fast did he settled with Cassie there is no way that he was going to have his image tied to paying out any kind of money to anyone the likelihood that he could’ve harmed someone in the early 2000s is pretty high, especially if you take what we mean by harm at today’s standards.

If you’re innocent, you’re innocent period. Jay and his team trying to make this woman give up her anonymity is super suspect, why would you need to specifically prepare for this woman if you didn’t do anything. Her name coming out would almost certainly lead to her being harassed nonstop.
It could absolutely lead to harassment from crazed fans and general public but also he has a right to prepare a defense, no?
What Jay’s team are saying is, with the identity revealed then they can find witnesses (partygoers, gas station attendant, limo driver, etc)

She’s leveling this claim that has already damaged his reputation. Aside from that his children, his wife are all affected. You can’t swing in the dark and properly defend yourself. That is essentially what he’d be doing if her identity is kept under the layer of anonymity from his legal team. I understand what could happen as a result of the public finding out who she is but given the fact that she chose that guy to represent her--I’m not sold on her desire to avoid the spectacle.

Excellent detailing of the facts here. It's also nice that when an opinion is stated amongst the facts, it is made clear that it's an opinion. That being said my only problem with Jay's route is that isn't making an accuser and or witnesses publicly known a good way to get them disappeared, or at the very least harrassed and bullied? Let's start to use critical thinking.. a 13 year old on a school night got into a limo the driver randomly just telling her puff like young girls without knowging her, goes to this party sign a NDA at 13 no ID which im sure is required l, gets drugged and rapped by 2 grown men somehow either fought them off or escaped while being drunk also made it to this gas station (drunk and physically/sexual assaulted) in 2000 where the use of cell phones and navigation even google is pretty much non-existent to a 13year but she made it to this gas station somehow and calls her dad to pick her up real late all on this school night in 2000.. ummm.. yeah ok.... make this make sense!!!

People are confused by the extortion part. Jayz fighting it shows hes willing to hold the alleged victim responsible for her accusations if they show not to be true. I never understood how people would be comfortable with a settlement or payout if their true goal was to get their abuser to serve justice. Ig we’ll see how it plays out. Jay is sneaky, convincing and has a good poker face. He convinced people that him and Rhianna never had a sexual relationship when they did. He said that he didn't stab Un when he did. He's allegedly been behind artists being blackballed but doesn't speak about it etc.
One part of his response letter that was weird was when he mentioned being from Brooklyn and something to the effect of "we don't do that kind of stuff..." Which was irrelevant and untrue. It had nothing to do with the case at hand and people from Brooklyn to commit these terrible acts and so do people in cities all across America. It seemed he stated this because it could cause people from Brooklyn to rely behind him. He also said some other things in that letter that were weird and irrelevant. It's very likely that Jay knew about the accusation before the rest of the public and had time to strategically craft that letter. It didn't sound like he quickly wrote it.
The young lady wants money and I think she deserves it if she was a victim. Her lawyers also will get a nice cut

It’s not clear what’s going on with Celeb B, at this point Jay’s name is already attached. He absolutely made a decision by not adhering to the demand letter, he had to know it was gonna go public and seems willing to fight.

The letter confuses people who don’t know the law nor understand that what Jay Z wrote was not a denial it was an attack letter. He said don’t sue me civilly, take it to criminal court. Two things, rape convictions are about 6% in criminal court, that bodes well for Jay Z. The burden of proof is different in Civil court and he knows that but most of the public doesn’t. That letter told me more about Jay Z’s underhanded character than was clear before. Please reread it without reading into it.
