    I've been black for 64 years.i can honestly say I prefer to live with the white people.its more productive and safer.

      I don't know if that's entirely fair. I believe you, but there are are majority black cities which are a lot safer than other inner city housing projects or the hood. There are also majority white cities here in Canada which are extremely dangerous and violent. So it's not that white people are inherently safer than black people to be around, it really just depends on where you live. I would say that on average, the poorer the people are in the area, the more crime there will be, whether they're white or black. I've only ever had a gun pulled on me 2 or 3 times, and they were all by Native people in Canada. But I've also lived with and worked with Native people who were some of the best people I've ever met. When I had guns pulled on me, it's because I was in the bad part of town doing bad things. It had nothing to do with the fact that they were Native, it had to do with the fact that I was surrounding myself with criminals.
      I'm not saying that's what you were doing, because it probably isn't. In all probability, You've likely never been involved with drugs and crime. My point is that race doesn't determine violence. Poverty, single mother families, lack of education, and substance abuse are what determines violence. There are very peaceful black people who have never hurt anyone and will never hurt anyone. There are also very violent criminals who are white, and you should avoid those people.
      I respect that you're older than me and you have a lot more experience living in the US. I just wanted to point out that it's not because of someone's race that they commit violence or not.

      I now live in NJ, but was once NYPD. I was having a conversation with a neighbor, who liked to drink, He was a very nice guy even when drunk. We wee having a conversation one day when he related an experience he had had some time in the past. He was stopped and arrested for DRUNK DRIVING, His comment to me is what actually struck a chord. He said "the police" should be out catching "REAL CRIMINALS". I honestly almost LOST IT. I explained to him, DRUNK DRIVERS are more then likely responsible for the injury an death of more INNOCENT people, than every ROBBERY in the US in any given year.

      So long as they take off the badge. We don't see much police here in my red state. We certainly don't need more. Everyone is armed so situations usually are quickly resolved. Just don't ask why someone was out digging holes with their tractor in the middle of the night.

    My brother got arrested a couple of years ago after falsely being accused of assault and he was so patient, calm, and polite with the cops that they allowed him to go back into the house to grab his phone and didn't even cuff him because he was clearly innocent in their eyes, this is not the behavior of an innocent man

      This happened a couple years ago where I'm from. A couple of kids, I think they were around 9-12 years old, stole a car and were speeding around town. They could have easily killed a pedestrian or another driver. The cops were called and were in pursuit when the kid driving ended up in a high speed crash, trying to evade the cops, both boys died. Quite a few people including the dead boys parents blamed the police saying it was their fault the boys died "because they were just scared and didn't know what to do". I don't think the cops knew they were kids at the time, but it's not like they would have been exempt from the law anyway. I felt bad that they died but also what were they doing stealing a car and driving underage too...
      Also happens quite often with drunk teens too and the cops always get the blame.

      And if the cop on scene saw him get out of his truck, that's a DUI right there. Cops can make an arrest, period! No conversation necessary at that point. They might need to take him in to determine just how impaired he is, but they can for sure take him in.

    It's so fucked that the poster wrote "the police escalated the situation, blah blah". The suspect escalated the situation by pulling a gun. The officer literally just wanted to talk to him to get to the bottom of the reckless driving calls, nothing more. He pulled a firearm for no reason, its 1000% his own fault everything that followed.

      @@THXx1138 Incorrect. As Tatum stated, you don't know what they saw. However, the moment he pulled that gun and was verbally belligerent he committed the crime known in Texas as "deadly conduct." It is also a crime to be carrying a firearm while drunk.
      And finally, the cop doesn't need to personally witness a crime to investigate a report of a potential crime. When the suspect became belligerent and throwing "offensive language", he became guilty of "disorderly conduct" which became the aforementioned "deadly conduct" the moment he pulled the gun and put it on display while being belligerent.

    Constructive criticism: police did a good job, but female officer needed to remain silent and let the initial officer do all the talking. That is standard practice in these situations. Again, the officers are not to blame. It's just a point of learning for the future.

      Did they come onto his property and shriek at him to get on the ground, at his own house, for no reason? Contrary to Tatum's assertions there is no gun in his hand when the supposedly white female officer shows up and starts screaming at him. Studies show female cops make things worse. They know they can't take most men in a fight, so they are quicker to draw their guns, and they want men down on the ground and helpless, so they can feel safe. They are also quicker to use their guns than male cops. When talking to the male cop, he put the gun away. When the woman starts screaming at him and demanding that he get on the ground on his own property, his hands are clearly visible and empty. If the cops don't want to deal with a man who has a gun on his person, they should GO AWAY LIKE HE TOLD THEM TO!

      Doesn't justify their **initial** lies to the press that he began shooting at them and that is when they shot him. No reason legitimate reason to falsely smear him, no legitimate reason to injure his wife either as she wasn't armed and didn't approach them. Also what Mr. Tatum claims is an initial reach for the gun, other reports say he forcefully clapped his hands together. But even if so, such a quick movement would probably justify an initial shot from police until they noticed the gun was still in his waistband. But no matter what his conduct was, NO REASON FOR POLICE TO LIE about it.

    As a former law enforcement officer and now attorney this one presents itself in many different lights. But in the end the suspect was wrong..
    Former policer officer in me: I am investigating a crime. I have RS to conduct an investigatory stop. You are not free to leave. When you refuse to cooperate and brandish a gun, you are now obstructing, committing another crime (e.g. menacing), and placing me and others in imminent danger of death or SBI. No, I am not trespassing as I have a lawful right to enter private property to investigate a crime. When you reach for a gun and come towards me in an aggressive manner after I have repeatedly told you to not do so, I am justified in stopping the threat.
    Attorney: While a citizen has a right to walk away and ignore an officer during a consensual contact, one does not have the right to do so during an investigatory stop. Even if the stop is eventually deemed unconstitutional or unlawful, in Colorado you must still stop and cooperate. Your remedy is in the civil courts. With very few exceptions you do not get to invoke self defense even when the stop is unlawful. An example would be he was walking into his house after exiting his vehicle and the officer began shooting at him while his back was turned while never identifying himself as an officer. Next, you will find no legal protections under the self defense theory when you are the aggressor. Again, there are some very limited circumstances where you may be able to claim self defense even though you are the aggressor but that did not happen here. Finally, as the citizen you had every opportunity to simply walk in your house. At that point the officers would have been faced with a very difficult decision. Do they rush in an arrest you because there was a exigency (exception to 4th amendment). In all likelihood they would not have done so and would have explored seeking a search or arrest warrant. In my opinion, given the tendencies of the courts these days had the officers rushed the house to arrest him the court would likely have sided with the homeowner that a reckless driving offense does not rise to the level of a justifiably exigency to invade someone’s home to arrest them as well as to preserve evidence. In sum as a citizen your remedy is in the civil courts and possibly criminal courts should the actions of the officer be so egregious and abhorrent. However you do not get to create the situation and then seek those remedies.

      Had a kid in my high school about 3 years after we graduated he ran from state police went back to His house and got naked and laid in his bed and was acting like he was sleeping when they broke in. We were all like idiot they litterly followed you there and watched you run in and lock the door. Some people just have no brains.

      In this case it does actually. All he had to do was go inside and lock the door. The cops could not enter his house without a warrant. All they had was a neighbor calling in reckless driving. The cops did not see anything. That is not enough to violate someone's 4th amendment. No judge in the world would have signed a warrant because the neighbor might have seen reckless driving(a traffic violation). The neighbor might just be an asshole, or no clue what reckless driving even is. The guy screwed up going outside waving a gun and talking to the cops.
      I had a friend that got a DUI in a similar way. His wife(sober) drove him to the store to get more beer, he had been drinking. The neighbor called the cops because they hated them. Cops showed up and gave him a DUI. He had not drove or done anything wrong. He beat it, but it cost him over 10k in lawyers and getting his arrest record cleaned. You think that is okay? He is in the middle of a civil rights lawsuit against the PD. He will most likely win. "In the dissent, Justice Scalia called the majority opinion a “freedom-destroying cocktail” that puts everyone on the road at risk of false reports called in by malevolent tipsters." Reckless driving is a traffic violation anyway, not a crime. Either you support the constitution, or you don't.

    That guy is the king of all idiots, how he made it this far is a miracle. The moment he brandished that firearm the police were not going anywhere regardless of whether he was driving reckless or not. He is intoxicated and in posession of a firearm, which it would seem he was carrying concealed by his version of events. His behavior was obviously aggressive and irrational as well so they are not going to leave him in posession of that weapon. Not to mention it's a crime to brandish a firearm and threaten someone which is exactly what he did to those police officers. To ne the only tragedy is that he is still alive and his wife got hit.

    You cannot open carry while intoxicated, so he was ILLEGALLY in possession OF a firearm by being intoxicated. Self defense is thrown out the window

      He pulled the gun out of his sweater, that he was wearing (I think) and before I get blasted for this statement, please read it fully... something tells me he doesn't own a CCW (concealed carry permit) and that so.ethi g is NOT his skin color, but rather his attitude, because law abiding CCW permit holders are more law abiding than the average citizen! And the suspicion that he was carrying illegal, leads me to believe he did wait no 10 days (in CA) for that firearm!

      @@RoLaAus-Robert this is in Texas where he does not need a CCL to carry a concealed weapon on his own property. However, he’s still illegally in possession because he’s noticeably intoxicated . In Texas, You can possess a firearm while drinking but the person can’t be intoxicated

    THE POLICE ONLY NEED PROBABLE CAUSE. IF SOMEONE IS IN THE COMMISSION OF A CRIME, IT IS THE DUTY OF THE OFFICERS TO ARREST THE PERSON AND THE ARREST MOST TIMES IS TO PROTECT THE PUBLIC.

      @@jamesm6469 He was drunk, refused to co-operate, brandishing his weapon, making aggressive statements in an unreasonable circumstance, the cops only wanted to ask some reasonable questions and bring him to the station based on suspicion and response to anonymous police calls of a reckless driver, which is enough for a police warrant, if it wasn't the guy they were after they would let him go, but no he carried on and drag it on.
      He was also very hostile and being racist, telling the white police officer to get off his property.
      If he did nothing wrong then why would act and behave like that?

      The only argument they have is the female cop escalated things by jumping in when the first cop already had a loose handle on things. She should have just kept her mouth shut and let the initiating officer handle things.
      Regardless of that, drunk guy is bad guy, wins bad guy prize of seven new orifices.

    How did this guy go from wreckless driving to pulling out a gun!! He was drunk or out of his mind or maybe both. What ended in a shootout could have easily been resolved with a conversation
