From Investigation to Petition: How SC Ruling on Caste Discrimination in Prisons Came to Be

On October 3, a Supreme Court bench of Chief Justice of India D.Y. Chandrachud and Justices J.B. Pardiwala and Manoj Misra said that provisions in prison manuals across states that discriminate on the basis of caste are unconstitutional. The court dealt with provisions around labour in prisons, barrack segregation and the targeting of denotified tribes through the vague and arbitrary use of the term 'habitual offenders', and said that states must rework their manuals within three months in compliance with the court order.
The court was hearing the public interest litigation filed by The Wire’s Sukanya Shantha, following her investigative work on the state-sanctioned caste-based discrimination and segregation in Indian prisons. In conversation with Jahnavi Sen, Shantha talks about her investigation, the petition that came out of it and salient features of the Supreme Court judgment.

It is stunning blow to those who hold the hypocrisy that caste based discrimination doesn't matter in Indian Hindu society. Deeply embedded casteism of Indian hindu society has also been testified by the prison manuals of of states that must be changed within three months and authority responsible for caste based discrimination must be prosecuted as it is against the dignity of humans.Mam deserve gratitude for bringing the issue in the highest court of land❤❤❤.

I am shocked this happened on paper. On manuals. I thought there must be something like this only in secluded areas or with unwritten rules. But until now it was legitimised. This is shocking. And why finally an SC ruling to change it ? Why was discrimination not curbed by all IAS, politicians or PMs and Presidents until now? Don't they have the power to do it?
