      @@MSusername69 Not all countries have "Truth as an absolute defense" mechanism for defamation and libel lawsuits. Some countries take intent or malice more seriously than the truth of an allegedly defamatory statement.

      @@feistsorcerer2251In Sweden it's fine if the information you spread is of actual interest to the public but if it isn't then it's defamation (if you spread it with malicious intent, which depending on the circumstances can be difficult to prove). So, bringing things like corruption to light is not an issue as long as you can prove it but if you publicly post something terrible but true about your neighbor you might run into trouble.

      Going to court for this in Japan is hard, civil cases even more so. Like how at-will employment states in the USA have the "lowest" unemployment numbers because they have the largest barriers to filing for unemployment (ironically it is liberal blue states that do this), Japan toutes having low SA and "tape with letter t swapped for r at beginning" rates when it is really unsafe for lone women there.
      No country is a utopia. They all have issues they try to hide.

    I feel like family vlogs are just very problematic, there’s so many grey zones around them. As you said, there are just as many absolutely incorrect ways as correct ones to go about one.

      I will never vlog my family for everyone to see, its called a "personal life" for a reason, to disclose that information is akin to exhibitionism in my opinion, a very shameful act, especially if its for monetary reasons and most of the time it is, you would be hard pressed to actually find a family vlog channel that is actually informational or educational, we all know they need that cash money if they are that desperate to film their lives.

    Red flag, 100%. Kids aren't content. Kids' development is already negatively affected enough *consuming* social media, making them a source of entertainment without their input or consent is unconscionable. We have plenty of evidence from child actors that this level of attention can be bad for them *without* filming their private lives, and of how far some people will go for internet clout. Put them together and you get a recipe for abuse.

They don't have the wisdom, presence of mind, or authority to make an informed decision about what parts of their lives their parents share with the world.

      It’s not even just that. The moment you put your child’s image out there on the internet, you don’t know who’s going to see that, and you don’t know what they’re going to do with it. The idea of putting my hypothetical child’s image up on the internet where it may be seen, commented on and used by someone who might use fantasise about causing harm to that child is way out of my comfort zone.

      So many people were doing it that I almost felt like maybe I was paranoid, because there can't be THIS many piece of shit parents, right? But no, I was wrong, there are so many of them...

    I think a big part of family vlog channel controversy is also how they handle their young childrens privacy. Like a four year old can`t consent to their image, life, etc. being put out there on the internet for essentially forever. I personaly think it is better to not have the young children shown especialy in vulnerable moments like emotional outbursts when filming shouldn`t be the priority but guiding them through that.

    family vlogs channels sit in a very gray area for me, as it tends to lead families to breaking apart and having tension between members, specially when it comes not wanting certain private things being filmed and shown on youtube, amongst other things

    There is currently a family channel going through the works in the US rn. The channel (now deleted) called 8 Passengers is under fire bc one of the kids escaped the mother’s friend and therapist’s house with evidence of abuse and malnutrition. And that story is still developing.
    Family channels are wild, always handle them with care. Especially if someone does or does not want a camera in their face. I want to know what happens with this story. Defamation could go one way or another with how the situation is playing out. Keep us posted on this story, please!

      As of a week or so, Ruby Frank’s & the friend have both pled guilty. I can’t recall how many years they got, but they have officially been found guilty. Naturally Ruby claims the friend is the one who urged her to commit those heinous acts against her kids, barring the fact she spent YEARS displaying that abuse for millions to see.

      In India, it doesn't matter if the content is true for "defamation" to apply. As a natural consequence, India is pretty notorious for corrupt companies silencing criticism. I don't think Japan is like that, though.

Like jfc I thought US journalists were harsh over how celebrities can look and any drama that the celebs get into but it’s tame compared to Japan’s who don’t hesitate to tear a new one by shaming the celebrity so badly for it that you think they committed a murder or r@pe when in truth they just got caught with some drugs or were seen leaving a love hotel.

      They employ extremely vague language, such as referring to Mr. A from Prefecture X engaging in questionable activities. They use censored pictures and a robotic voice to avoid direct implication, yet craft it in a way that those in the public or nearby can infer the identity of the person being discussed.

    Thats insane... So let´s imagine my family did something horrible to me and I share this story with other people (friends, relatives etc.) I could be suit for defamation? Why are so many Japanese people siding with the perpetrator? That is really awful 😢

      Even if what you are saying is correct, who is to judge it as correct?
      For example, I could say the same thing and it might actually be someone who wants to embarrass you with lies or money, right?
      Until the facts come out, I am a suspect, not a perpetrator.
      If he had gone to court first and established that these were facts and said them on youtube, it wouldn't have been a problem.
      It is a problem because he published the videos on youtube first and it was unclear if these were facts.
      By the way, as others have said, if it is true, he will not be punished. But to prove it, there would have to be further steps, like interviews and a trial.

    Family Vlog Channels are in a downward spiral here in the US. The big one is the Ruby Franke case in the courts right now. She had a family vlog channel, called 8 Passengers. Look Up the case, it's a crazy one.

    I get the ick from all family vlog channels, 'happy' family or not.
    I think showing off your kid in a video every now and then is fine but making a whole channel around it always feels weird and exploitive to me.

    I've been watching this family vlog channel since around the beginning (from like one of their first videos)- and all of this law suits, cutting family ties, and alleged assassination attempt was to me extremely surprising. They seemed to be an close knit family that loved each other, and from their videos I couldn't possibly imagine any problems like this to be happening. Their family channel seemed to be quite genuine, and the things the family is alleging seems outrageous to me.
    As you mentioned, the theory that the girlfriend was the reason for the fall out I think is extremely unlikely. While yes, the videos after the girlfriends appearance didn't feature the little sister anymore, a deleted video explains that it was because she was getting busy with school and her parents and other brother was pressuring her to stop siding with Caleb and the youtube channel. It appears that they already started to fall apart before the girlfriend as their upload schedule has started to slow down.
    As a viewer, this channel falling apart was shocking and I would have never expected the things that were happening behind the scenes. In the deleted/ archived video, he mentions that his parents talked in place for his younger sister not allowing the two to communicate and told him that the younger sister always felt used and never actually smiled from the bottom of her heart in the videos. To me that was crazy, because I watched every single one of their videos and if that smile and emotions were fake idk what would be real.

    I do worry that there might be some mental health issues involved too. Paranioa that people are out to get you, a breakdown in relationships... there's often a lot going on behind the scenes that's never seen publicly (And that's probably for the best tbh)

    Japanese law's definition of defamation can prevent people from or punish them for giving honest testimony or accurate information to journalists or police. Also, family channels are creepy and invasive, especially when families feature content with their kids.

    In my opinion as a Japanese person, if a family member spreads false rumors on TH-cam such as ``My brother is planning to commit murder,'' it would have an immeasurable negative effect on work and interpersonal relationships.
    My guess is that his family asked him to delete the video, but he didn't.
    In principle, a crime of defamation can be committed even if the stated facts are true. However, as an exception, it can be proven that the content is "true" in addition to "relating to facts related to public interest (public nature) and whose purpose is exclusively to promote public interest (public interest)" If possible, the offense should not be punished for defamation (Article 230-2, Paragraph 1 of the Penal Code).
    Defamation of reputation is not something that is easily recognized.

    It's kind of a grey area for me. I appreciate the family vlogs that can highlight and educate the difficulties of navigating the health system and disabilities, but also I can see how putting up such a public face of your child/family can be VERY detrimental later on in life for everyone involved, good intentions or not. I only watch one family vlog channel (Beth and Coop) bc I find it super educational on child-rearing a deaf child with cochlear implants. After all, who's to say my future child will be hearing or deaf? I can prepare myself for that, at least.

    I feel like a lot of family channels seem to forget that the internet is not so different from the real world in a sense that not everybody watching these family vlogs have good intentions. Children shouldn't be exposed online because that'll definitely f*ck them in the head after they grow up and see very intimate memories of their younger self's being broadcast for millions of people for profit without their consent.
    Family vlogs are okay if you don't expose your young children for money. Just don't film the melt downs, don't film them taking a bath, don't film them in any way you yourself wouldn't like to be filmed.

    I have to wonder what would happen if there was defamation of a Japanese citizen but the misinformation came from another country. Would the perpetrator be tried in Japan or in their home country? I'm not familiar with defamation laws, let alone Japanese laws.

      They have to go through that other country’s court which is why I’ve seen many say that they don’t believe that the AkioAir CEO’s defamation lawsuit will go through as the vtuber he’s suing lives in the US or England so their case will be thrown out. Heck the judge will laugh them out after reading his counter to not paying his talent on time is pay by request which anyone with an actual brain can confirm to never be a thing that’s done for running any kind of business.

    The only way to ethically do a family vlog imho is to not record every second of your child's personal life for daily uploads. It is to tell stories of your fun events, share the occasional photo or short home video clip on a weekly or monthly basis, while only including your child in the actual vlogging if They say they want to, and respecting when they don't.
    When it comes to a family vlogging channel, the safety and well-being of the child should Always come first. If you're a parent doing or thinking of starting a family vlog, ask the child or children involved at every step and respect their answers. Things like "Do you mind if I show this picture? Would you be okay saying a few things to the people? It's okay if the answer's no, I just want to make sure. I don't want to hurt or upset you." If you can do that and respect your kids' wishes, then knock yourself out and have fun. But if you can't grasp the concept of basic respect for another human's autonomy, you probably shouldn't even own a camera.

It's not mutually exclusive but he does seem paranoid. Regarding family channels, the oldest son (12 maybe) of one youtuber asked, "How are you going to make a living when we're grown up and gone?"

    The reason I keep images of my son off of all social media's is because of officials sharing that when a child predator is caught the majority of their "indecent images" are actually mainly wholesome innocent photos/videos taken from the average persons account. That info stuck with me

    This is my view as a Japanese person.
    If there are any mistakes or incorrect translations, I apologize.
    I think it is a case by case basis whether it is defamation or not.
    The requirements to not be libelous are,
    (1)pertains to facts of public interest
    (2)It is recognized that the purpose was solely to serve the public interest.
    (3)That there was proof of truth.
    It takes money, time, and effort to sue in court, and even if defamation were applied, it would only be a minor crime or minor damage, so the hurdle for the media and TH-camrs with large numbers of subscribers to publicize the facts may be low.
    In addition, because of social credibility and reputation apart from the law, even if you sue for defamation and win, it does not necessarily mean that it will be positive for your future life.
    In fact, there are many cases where celebrities and activists who were exposed to facts did not sue because they did not think it was worth suing for defamation.
    On the other hand, in Japan, there are various arguments such as "it is strange to consider that exposing a celebrity's private life is a tax on celebrity.

      As for politicians, they are rather typical of those who are easily exposed.
      This is because they are the people who most meet the conditions for not being libelous as described above, and therefore are the easiest for the media to report.
      Although some major media outlets are hesitant in some cases to expose some celebrities and executives who have a vested interest in their own business,
      It is also impossible to keep the information hidden, as it leaks through other media and the Internet.
      (Shukan Bunshun and Korekore are comparatively well-known.)

    I used to be pretty neutral about family vloggers just not into them myself but now I am at an age where I am targeted with that content and it makes me deeply concerned. I don't need to know little billy's bedtime routine or little Lisa's first baby tooth falling out. These are IMO intimate family moments that I have absolutely no business seeing nor do I want to. Children are not content!

    Outside of extreme examples like this, the reason family vlog channels are generally problematic is because they more often than not ignore the value of consent. Small children cannot understand the long-term ramifications of having their face online, especially to an audience of thousands or even millions. Even if you ask your child "Do you want to be in my video?", they aren't of an age to truly consent. I'm sure there are family vlogs out there that either don't feature kids, or do right by their children by censoring their faces, but they are very few and far in between. Probably even more importantly, when you make a family vlog channel, your kids are becoming either a primary or secondary source of your revenue, and that leads to a whole mess of issues. Even the most well-intentioned parent could end up exploiting their child.
    All in all, there are a lot of gray areas to showing children on TH-cam, and I think there are instances where it can be done ethically and appropriately. However, family vlog channels are breeding grounds for child abuse and exploitation, and they should be avoided. Children also deserve privacy.

    Unless they were proactively posing for the camera or asking me to take a photo, I even hesitated just taking photos of my chidren once they passed toddlerhood 😅 I do watch a few family channels but all the ones I watch, I was following them before they had children, mostly Japan based as Ive been here a while 😅

    6:02 easy as hell to prove one way or another. Track where the youtube money got spent on. WAS it spent on lifting the family's financial burden? was it used to pay bills? buy food? What?
    Or did he buy himself a vacation, hotels, services in the red light distract, buy a second home...

    Japan’s defamation laws are bonkers.
    Also, I’d be careful about ever putting a child on TH-cam. A lot of family vloggers kids ended up on watch list for less than savoury people. They can also use AI and deepfakes to have them do really gross things using benign images and sound files the families put out.

    I think in the case of the channel mentioned here, it's clear he was just using his family for money and attention. Why would he suddenly add his girlfriend to his vlogs and remove his sister? Why in the world would that make his own family try to kill him? None of that makes sense, but it WILL garner him plenty of views.

    Family blog channels are the worst TH-cam channel ever. A lot of TH-cam controversy is those TH-cam family bloggers who seem perfect on camera but just scum of the earth in real life. They’ll do anything for their content and to make their channel grow. If you wanna make content on TH-cam don’t make a family channel.

    I just had a baby several months ago and refuse to even put a picture of him online, let alone start any type of internet presence. I think it's wise to keep your minor children offline as much as possible. Too many weirdos lurking and family vlogs probably attract some unsavory people who you don't want obsessing about your precious child.

    I feel like "family content" in general should not be available publicly and produced for monetization. Keep that on at least semi-private social media sites for your own extended family and friends to enjoy.
    If you have family member that take part in your content occasionally, fine, but don't make the family aspect teh focal point.

    I feel like it depends a lot on how much information the family is sharing. Young children who can’t understand what’s happening shouldn’t be filmed since they can’t give permission. The family should also avoid sharing any personal information. I remember awhile back a family vlogger decided to record her daughter ( who was maybe 12? ) shaving her legs for the first time. That kind of thing should be kept private. Families need to take into consideration that their content can be seen by anyone and avoid sharing anything that they wouldn’t feel comfortable sharing with a stranger.

    Family channels feel like a big grey zone to me. I think there are definitely ways to do it correctly and ways not to. I really like how John Wolfe is going about it now he's shared his little family with us. As his daughter grows up, it'll be her decision on whether she still wants to be doing videos or not. I like this because I feel like a lot of these channels don't give the option to their children on whether they're comfortable being filmed or not.

    The defamation aspect is very interesting.
    Reputation is everything. It's how others are more likely to risk a venture with you, whether it's business, entering a relationship or even just being willing to be friends with you.
    Damage to said reputation is in a way, actual harm. Actions such as deplatforming, cancel culture and the like are all attacks on your reputation, they are usually cowardly actions taken towards you that don't result in consequences for them. However, if Japan prosecutes those sorts of attacks, then that's a natural defense against such frivolous attacks.
    People think being respectful is being superficially courteous, especially based on characteristics, but in reality respect is about being humble and open minded.
    In this case it's sad that this 21 year old man is in a tough position and being punished for the actions of others, however it's too simply to simply say the system is wrong, because no matter how you set things up someone's going to be a victim.

    I hate "family channels" with a passion, especially as a psychology major ,the damage it does to the kids and lets not get into parents who film their children for predators online-knowingly or unknowingly. A child cannot consent to that and even if they want to be filmed and posted they still shouldnt be listened to because well....they are children. Even a small picture of a child from facebook ends up with predators. online. And we have examples today of the kids who grew up almost all of them hated it and it breaks their relationship with their family because they feel used (they are right)

    It could be that the idea is that the person receives their punishment for the wrongdoing, and therefore an additional punishment by the wronged party is unecessary and a type of vigilante justice. In cases where there is no proof that anything happened, then it makes sense to me that in those cases also , its not okay to publicly accuse someone of something.

    The problem with family vlog channels is that the children can't give consent. Even if they do want to be in the videos - it's not really consent since they haven't reached the age of consent and might regret that decision in thr future but have no power to change it.

    I followed a family who was from hong kong. Most of the time it was very wholesome but after the wife had her daughter they ended up getting a divorce because her husband cheated. Which is heartbreaking in itself but the fact that you could tell how bad things were going; the sadness in her face, the passive aggressive comments between the two of them and her kids being constantly filmed as all of this was going on was just sad to watch and I can just see her kids going on youtube in the future and witnessing their parents fighting all over again. Things like that should never be filmed and while it's entertaining for strangers to watch these are kids with feelings and they have zero privacy when their parents are filming. I can't bring myself to watch family vlog channels anymore.

    My old man died about a week back, put him out to sea yesterday. 4 kids from 3 mothers and I was the odd one out, definitely not part of the remaining family (my mom's dead too).
    I'm not really looking for sympathy, my point is that if you have family, even if you have strained relationships, then treasure them. Because I can assure you it's better than not having one.

I think that if the kid appears some times when they are filming a family vacation, or appears on a scene where they helping their parents in the garden or something like that, that's okay. But making the whole channel around the kids and filming everything on their lives is wrong.

      And this is why you should never get all your facts from a TH-camr. If you look up Japan's defamation law, it actually has a clause that no punishment will be given if the allegations are factual _and_ for the public good. So accusing someone of wanting to commit murder and being able to prove it is protected, while accusing someone of wanking off to yaoi, even if it turns out to be true, is not.
      To quote the relevant parts:
      *Article 230.*
      1. A person who defames another by publicly alleging facts shall, regardless of whether such facts are true or false, be punished with penal servitude or imprisonment not to exceed three years or a fine of not more than 500,000 yen.
      2. A person who defames a dead person shall not be punished unless such defamation is based on a falsehood.
      *Article 230-2.*
      1. When the act provided for in paragraph 1 of the preceding article is found to relate to matters of public interest and to have been done solely for the benefit of the public and, upon inquiry into the truth or falsity of the alleged facts, the truth is proved, punishment shall not be imposed.
      _2. In the application of the provisions of the preceding paragraph, matters concerning the criminal act of a person for which prosecution has not yet been instituted shall be deemed to be matters of public interest._

      @@NotAnInternetTroll I'm not defending Japan, I know they're fucked up in a lot of ways, but the reason I copy/pasted the law is because Joey literally just quoted the very top of the Google search result, which was a) just a summary of the law and b) not even the full summary (because if you click the link the second paragraph of the summary talks about exceptions for accusations about crimes). This has resulted in a lot of comments where people seem to think the law is worse than it actually is.
      That's not to say it hasn't been abused or the exceptions haven't been applied properly in the past (Ikeda v. Muranaka for example), but there's quite a bit of irony about people freaking out about how people can be sued for defamation despite presenting facts... when they're basing their reaction on partial facts.

    I think one place we can look at is in the film industry for inspiration and advice. However, I am not in that field.
    I think involvement of children requires a lot of thinking, consulting with family members and a lot of cutting out shots. You may cut out to many shots that it does not even fit your narrative any more or even your channel vibes.
    I think once they cross 4 years old, it is the point where you have to consider real hard. In fact, once they cross 4 years old, I personally wouldn't include them until they are old enough to understand what getting filmed means and give consent - which can differ from people to people.
    While I agree that children shouldn't be content, I think it depends on the type of content that the parent is making. I would say it is fine to include children in videos, or at least the presence but not necessarily face of the kid in the final cut that is published onto the internet (patreon, YT etc).
    This makes physical stream difficult.
    Also if the type of content that the parent is making requires a studio, I think it is easier for the kid to learn the rules as to when he/she can enter the room.

I find it unnecessary and the majority of them end negatively, for example, that one lady who recently got arrested for abusing her children and that lady who used her son crying for content.

    I've watched a couple of family vlog channels because there content is wholesome and enjoyable. So I think there's a place for them as long as everyone is down for it. It even extends to other media like The McElroys who have a whole line of family-hosted podcasts. It's possible but only after conversations and intent is made clear. Otherwise, your uncle is gonna hire Hitman Reborn to take you out I guess
