  • Usul al-fiqh has been defined as principles or methodology used by the jurists (mujtahid) to deduce the practical Shari`ah ruling from their sources.
    Thus the purpose of usul al-fiqh is to regulate the prosess of adjudication (ijtihad) and to guide the jurist (mujtahid) in his effort at deducing the rules from the sources. This would explain the issue of how do Muslim judges and jurists discover and apply the law.

    So this brother doesn't even bother giving the Hanafi evidences. Sorry to say, but this person is untrustworthy. He blatantly misrepresented the Hanafi position by saying they only have qiyas as evidence for their position about a woman being able to get married without a wali. This is an objectively false statement. There is no room dispute here, he is flat out wrong. Look in the Hanafi books of usul, in the fiqh book explanations such as Tabyin al-Haqaiq of Zayla'i, etc., you will see their evidences. They use the Quranic as evidence, as well as several hadiths and reports from Sahaba, and after that, they use analogy as well. But to say they only use analogy is clearly false.
    I'm not going to list the evidences, that would take too much time. But the person in the video should have at least bothered to look in the Hanafi books before he made such a reckless accusation. This brother clearly never bothered actually studying the what the Hanafi scholars say about this. Shameful. You can claim an evidence is weak if you want (even if you aren't qualified to say that), but to say evidences don't exist when they actually do kills your credibility.
    This is a reason why we should all learn Arabic. If you don't know it, it is easy for people to lie to you and say evidences don't exist, because without learning Arabic, it is very difficult to verify if what they are saying is true or not.
    And of course, this is an oversimplification of the Hanafi view in the first place. What they actually say is that the marriage of a free, sane, adult woman is valid if the person she is to marry is a match for her in terms of suitability (kuf'). So if the brother isn't suitable, a topic discussed in fiqh texts, the marriage would be invalid. So it isn't a free for all.
    A person of integrity will accurately present a view before he attempts to refute it. Those who are intellectually dishonest and manipulative will distort the views of their opponents, and create straw man arguments in an attempt to make their positions seem flimsy, when in reality, that is not the case. Be weary of people like this. You can't trust them when it comes to learning your religion.

      @Abū AbdulRahmān Regarding the clear cut hadith point, the Hanafis have their own hadith and Quran evidence which they deem stronger. This is why there are different madhabs, they interpret evidences differently. And while each madhab believes their interpretation is correct, they accept the others as all being legitimate. But as you said, you don’t know the Hanafi madhab, so you aren’t even in a position to comment on who is right or wrong. How can you critique something you know nothing about? The responsible thing to do would be to just remain silent about it.

      @@AH23232 I’m calm, but I appreciate your concern. The misrepresentation of the Hanafi school I mentioned is a fact, and it wasn’t vague. I strongly disagree based on facts, not my opinion. Anyone who has studied these things would agree with me. Ultimately, people can follow whatever they want, but we need to be honest when presenting opposing arguments, particularly from Muslims. We should hold ourselves to higher standards of academic integrity, and not misrepresent the views of fellow Muslims.

      100% agree, in general, too much layman talk or make statements about deen without even knowing proper ا ب ت in these fields.
      Moreover, following some videos on TH-cam (not referring to this one), won't gave you the same barakah of ilm that is to sacrifice your time money life to seek it from asaatiza that help you learn it with their suhbat.. Ect

    Such sciences are NOT for the general masses!! Anyone who is serious MUST FOLLOW THE SALAF in regards to being a student of knowledge! ARABIC IS THE LANGUAGE OF ISLAM AND SCHOLARSHIP and trying to go through another language that is the sworn enemy of Arabic is a double foul!! This is Totally totally wrong and will only create an opening for fitna! As a Hanbali I am not bound by some of the Hanafi principles in Usool that the عموم and إطلاق of the Quran are قطعية الدلالة and therefore cannot be يُخَصَّص أو يُقَيَّد by single narration hadith خبر الآحاد but this does not mean that Hanafi fiqh is restricted to Qiyyaas with no proofs for their positions!! This is also totally wrong!
    جاء في الاختيار لتعليل المختار: وَجْهُ قَوْلِ أَبِي حَنِيفَةَ قَوْله تَعَالَى: {حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ} [البقرة: 230] ، وَقَالَ تَعَالَى: {فَلا جُنَاحَ عَلَيْكُمْ فِيمَا فَعَلْنَ فِي أَنْفُسِهِنَّ بِالْمَعْرُوفِ} [البقرة: 234] ، وَفِي آيَةٍ أُخْرَى {مِنْ مَعْرُوفٍ} [البقرة: 240] أَضَافَ النِّكَاحَ وَالْفِعْلَ إِلَيْهِنَّ، وَذَلِكَ يَدُلُّ عَلَى صِحَّةِ عِبَارَتِهِنَّ وَنَفَاذِهَا؛ لِأَنَّهُ أَضَافَهُ إِلَيْهِنَّ عَلَى سَبِيلِ الِاسْتِقْلَالِ؛ إِذْ لَمْ يَذْكُرْ مَعَهَا غَيْرَهَا. وَهِيَ إِذَا زَوَّجَتْ نَفْسَهَا مِنْ كُفْءٍ بِمَهْرِ الْمِثْلِ فَقَدْ فَعَلَتْ فِي نَفْسِهَا بِالْمَعْرُوفِ، فَلَا جُنَاحَ عَلَى الْأَوْلِيَاءِ فِي ذَلِكَ. وَرَوَى ابْنُ عَبَّاسٍ «أَنَّ فَتَاةً جَاءَتْ إِلَى النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَقَالَتْ: يَا نَبِيَّ اللَّهِ، إِنَّ أَبِي زَوَّجَنِي مِنِ ابْنِ أَخٍ لَهُ؛ لِيَرْفَعَ خَسِيسَتَهُ، وَأَنَا لَهُ كَارِهَةٌ! فَقَالَ لَهَا: أَجِيزِي مَا صَنَعَ أَبُوكِ، فَقَالَتْ: لَا رَغْبَةَ لِي فِيمَا صَنَعَ أَبِي! قَالَ: فَاذْهَبِي، فَانْكِحِي مَنْ شِئْتِ! فَقَالَتْ: لَا رَغْبَةَ لِي عَمَّا صَنَعَ أَبِي يَا رَسُولَ اللَّهِ، وَلَكِنِّي أَرَدْتُ أَنْ أُعْلِمَ النِّسَاءَ أَنْ لَيْسَ لِلْآبَاءِ مِنْ أُمُورِ بَنَاتِهِمْ شَيْءٌ» . وَالِاسْتِدْلَالُ بِهِ مِنْ وُجُوهٍ: أَحَدُهَا: قَوْلُهُ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ -: «فَانْكِحِي مَنْ شِئْتِ» . الثَّانِي: قَوْلُهَا ذَلِكَ، وَلَمْ يُنْكِرْ عَلَيْهَا، فَعُلِمَ أَنَّهُ ثَابِتٌ؛ إِذْ لَوْ لَمْ يَكُنْ ثَابِتًا لَمَا سَكَتَ عَنْهُ. الثَّالِثُ: قَوْلُهُ: «أَجِيزِي مَا صَنَعَ أَبُوكِ» - يَدُلُّ عَلَى أَنَّ عَقْدَهُ غَيْرُ نَافِذٍ عَلَيْهَا، وَفِيهِ دَلِيلٌ لِأَصْحَابِنَا عَلَى أَنَّ الْعَقْدَ يَتَوَقَّفُ أَيْضًا. وَفِي الْبُخَارِيِّ: «أَنَّ خَنْسَاءَ بِنْتَ خِذََامٍ أَنْكَحَهَا أَبُوهَا، وَهِيَ كَارِهَةٌ، فَرَدَّهُ النَّبِيُّ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ -» . وَرُوِيَ أَنَّ امْرَأَةً زَوَّجَتْ بِنْتَهَا بِرِضَاهَا، فَجَاءَ الْأَوْلِيَاءُ وَخَاصَمُوهَا إِلَى عَلِيٍّ - رَضِيَ اللَّهُ عَنْهُ -، فَأَجَازَ النِّكَاحَ. وَهَذَا دَلِيلُ الِانْعِقَادِ بِعِبَارَةِ النِّسَاءِ، وَأَنَّهُ أَجَازَ النِّكَاحَ بِغَيْرِ وَلِيٍّ؛ لِأَنَّهُمْ كَانُوا غَائِبِينَ ; لِأَنَّهَا تَصَرَّفَتْ فِي خَالِصِ حَقِّهَا، وَلَا ضَرَرَ فِيهِ لِغَيْرِهَا، فَيَنْفُذُ كَتَصَرُّفِهَا فِي مَالِهَا. وَالْوِلَايَةُ فِي النِّكَاحِ أَسْرَعُ ثُبُوتًا مِنْهَا فِي الْمَالِ، وَلِهَذَا يَثْبُتُ لِغَيْرِ الْأَبِ وَالْجَدِّ، وَلَا يَثْبُتُ لَهُمْ فِي الْمَالِ. وَلِأَنَّ النِّكَاحَ خَالِصُ حَقِّهَا حَتَّى يُجْبَرَ الْوَلِيُّ عَلَيْهِ عِنْدَ طَلَبِهَا وَبَذْلِهِ لَهَا، وَهِيَ أَهْلٌ لِاسْتِيفَاءِ حُقُوقِهَا، إِلَّا أَنَّ الْكَفَاءَةَ حَقُّ الْأَوْلِيَاءِ، فَلَا تَقْدِرُ عَلَى إِسْقَاطِ حَقِّهِمْ. وَأَمَّا مَا ذُكِرَ مِنَ الْأَحَادِيثِ فَمُعَارَضَةٌ بِمَا رَوَيْنَا؛ فَإِمَّا أَنْ يُرْجَعَ إِلَى الْقِيَاسِ - وَهُوَ لَنَا - عَلَى الْمَالِ وَالرَّجُلِ، أَوْ يُوَفَّقَ بَيْنَ الْحَدِيثَيْنِ، فَيُحْمَلُ مَا رَوَيْنَاهُ عَلَى الْحُرَّةِ الْعَاقِلَةِ الْبَالِغَةِ، وَمَا رَوَيْتُمُوهُ عَلَى الْأَمَةِ تَوْفِيقًا. كَيْفَ وَقَدْ وَرَدَ فِي بَعْضِ الرِّوَايَاتِ «أَيُّمَا أَمَةٍ نَكَحَتْ نَفْسَهَا» ؟ فَيُحْمَلُ الْمُطْلَقُ عَلَى الْمُقَيَّدِ، أَوْ يُرَجَّحُ، وَالتَّرْجِيحُ مَعَنَا؛ لِأَنَّ مَا ذَكَرْنَاهُ سَالِمٌ عَنِ الطَّعْنِ، وَمَا رَوَاهُ مَطْعُونٌ فِيهِ؛ فَقَدْ حُكِيَ عَنْ أَبِي الْعَبَّاسِ الْمَرْوَزِيِّ قَالَ: سَمِعْتُ يَحْيَى بْنَ مَعِينٍ يَقُولُ: ثَلَاثَةُ أَحَادِيثَ لَمْ تَثْبُتْ عَنِ النَّبِيِّ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ - «كُلُّ مُسْكِرٍ حَرَامٌ» ، «وَمَنْ مَسَّ ذَكَرَهُ فَلْيَتَوَضَّأْ» ، «وَلَا نِكَاحَ إِلَّا بَوَلِيٍّ، وَشَاهِدَيْ عَدْلٍ» . وَوَافَقَهُ عَلَى ذَلِكَ أَحْمَدُ بْنُ حَنْبَلٍ وَإِسْحَاقُ بْنُ رَاهَوَيْهِ. عَلَى أَنَّا نَقُولُ: الْمَرْأَةُ وَلِيَّةُ نَفْسِهَا، فَلَا يَكُونُ نِكَاحًا بِلَا وَلِيٍّ، فَلِمَ قُلْتُمْ: إِنَّهَا لَيْسَتْ وَلِيًّا؟ وَلَوْ قُلْتُمْ ذَلِكَ اسْتَغْنَيْتُمْ عَنِ الْحَدِيثِ. وَكَذَا الْحَدِيثُ الْآخَرُ فَإِنَّهُ مِنْ رِوَايَةِ سُلَيْمَانَ بْنِ يَسَارٍ عَنِ الزُّهْرِيِّ، وَهُوَ ضَعِيفٌ ضَعَّفَهُ الْبُخَارِيُّ، وَأَسْقَطَ رِوَايَتَهُ. وَرُوِيَ أَنَّ مَالِكًا وَابْنَ جُرَيْجٍ سَأَلَا الزُّهْرِيَّ عَنْ هَذَا الْحَدِيثِ فَلَمْ يَعْرِفْهُ، وَالرَّاوِي إِذَا أَنْكَرَ الْخَبَرَ دَلَّ عَلَى بُطْلَانِهِ كَالْأُصُولِ مَعَ الْفُرُوعِ. وَلِأَنَّ مِنْ مَذْهَبِ عَائِشَةَ - رَضِيَ اللَّهُ عَنْهَا - جَوَازَ النِّكَاحِ بِعِبَارَةِ النِّسَاءِ؛ فَإِنَّهَا زَوَّجَتْ بِنْتَ أَخِيهَا عَبْدِ الرَّحْمَنِ حِينَ غَابَ بِالشَّامِ. دَلَّ ذَلِكَ عَلَى عَدَمِ صِحَّةِ الْحَدِيثِ، وَرِوَايَتِهَا لَهُ، أَوْ عَلَى نَسْخِهِ، أَوْ عَلَى رُجْحَانِ مَا ذَكَرْنَا."
    This is the main proof of the Ahnaaf and any real student of knowledge would check all 4 schools if only just to broaden ones knowledge!!

      How can Language be an Enemy of Allah? Languages are just tools, they are neither Good nor are they Bad inherently, it depends on how we use them. Every language has its virtue, Arabic is a beautiful language because Allah chose to speak in that language same way he spoke in Hebrew to Moses A.S, these languages are only sacred because Allah chose to speak in them, and that is their virtue. Modern English also has its virtues though they are not Theological like Arabic and Hebrew, rather English is the Language of Modern Science and International trade, and that is its virtue, nothing Bad with English at all, if Allah wanted he could of revealed the Quran in any Language, including English, but he chose to reveal it in Arabic because the Prophet Spoke Arabic etc.

      @@Therock151214 excuse me do not lie against me!! I said that English is the enemy of ARABIC and it is! Historically the British my race my people intentionally set out to remove Arabic from the the top language of the various sciences and replace it with English! Of course we even have others saying Arabic is dead and we must all learn urdu!! English is an inferior language and teaching the Islamic sciences in English is wrong totally wrong because Arabic is alive and I dont mean slang colloquial but classical Arabic and its grammar and I speak it fluently and write it so and so learning complex sciences of ijtihaad should only be taught in Arabic because Mastery of Arabic is the first obstacle before studying complex sciences! The only thing that should be in English is basic fiqh and stories and basic Hadith for those who dont aspire to become scholars! So please dont make me eat what I haven't eaten and keep your opinion to yourself! Have you studied to have an opinion? Who gave you Ijaazah ? Arabic and learning it is an obligation on every Muslim this is Shaikhul Islams fatwa and Imam Shaatibis and many others!! Arabic is holy and sacred ENGLISH SND URDU ARE NOT!! Arabic is far more than just a language and far more than just beautiful!!

      @ابو بكر ابن محمد البربري Wahabi is a slur against A man called Muhamad Ibn Abdul Wahab and his followers, he was a reviver of Tawheed during his time, and to this day faces slander. Anyone who defends this great Imam gets called a wahabi it’s nothing special. But people fail to realise firstly there’s no such groups as “Wahhabis” rather it’s a slur generally speaking used by the deviants. And also “Wahab” is a name of Allah. May Allah guide us all.

      @@user-br1qk6mt6k of course i will not put down my comment. i know he is a wahabi and i will always stand for the truth. this same guy says that calling upon Muhammad pbuh is shirk astaghfirullah. how can he say that when Allah swt has given the ability to Muhammad pbuh to suplicate for his ummah in the barzakh? when we make salam to Muhammad pbuh, he hears our salam and by the will and power of Allah swt, his sould returns to his body and he gives salam back. i can give you sahih hadith that the saudi scholars that this person favours can agree that they are authentic. may Allah swt guide you

      @@user-br1qk6mt6k when we say wahabi, we dont mean wahab astaghfirullah. great way to misinterpret me. wahabi is a sect within the ummah that currently has around 3 million followers and more.
