Advocate Mshololo is brilliant and knows exactly where her cross questioning needs to go. That is,to get Zandi to make some CONFESSION implicating her sister Kelly,so that Kelly can be ordered to appear before court and testify. But, I'm not at all impressed by the Judge's unnecessary intervention. Whatever he observes should be for his OWN record to help him arrive at a clear JUDGEMENT at the end of the trial. He should allow Advocate Mshololo to do her job that she's there for.
I’m happy to see that someone else feels the same way about the judge’s comments. His comments may be viewed as giving the impression that he has already decided the case, which may cast doubt on his objectivity and his willingness to reserve judgment until the end of the proceedings! The dialogues he’s been having with Zandile seem to suggest that he agrees with what she’s saying, which is not wrong that he does by the way, but such remarks can form part of his ratio decidendi! He is within his rights as a judge to make incidental statements, but to have a dialogue with a witness where you clearly ridicule a lawyer I find rather disturbing. They have a dialogue like they’re having tea, and there’s no decorum observed where a witness just speaks even when not spoken to. There are instances where I feel he could have also addressed this key witness where she didn’t answer the question asked but rather chose to be sarcastic. Perhaps the lawyers also missed that opportunity also, because I feel this witness is a key witness because she witnessed the murder of the victim. She was asked whether she agrees that the police haven’t arrested the right people and she started talking about how people lose and gain weight over the years, going as further as answering by asking a question to the lawyer whether he can see anyone with dreadlocks amongst the accused, instead of simply stating that she agrees or not! The judge and the lawyer at that moment, like in many such moments, just let her off the hook without answering one way or the other! And I’m in no way picking sides here, but merely giving my opinion that the lawyers missed the opportunity to really test the witness’ version of events a little more, unless she can still be called back for more questioning at a later stage! Be that as it may, it’s been an interesting case, where it appears the real perpetrator(s) may not necessarily be the accused!

This judge keeps butting in to save the witnesses for whatever reason. He did that on more than one occasion to help Zandi Khumalo, who actually is a SUSPECT in this case. But, I could watch Advocate Mshololo the whole day with pride and pleasure. She carries herself like a true LADY and PROFESSIONAL. She's undoubtedly a TOP ADVOCATE!!!
