  • The plaintiff says while he was president of his social club, he renovated the club’s kitchen. He claims when the showoff defendant took over as president, he ripped off the plaintiff for the balance he’s owed, so he’s suing. The defendant says the plaintiff illegally loaned the club tens of thousands of dollars at a high interest rate, so he’s countersuing for overpaid interest.

      Completely agree! A person's ethnicity can be a big part of them and to be able to come together with other people who can relate and share stories and memories with can be really wonderful and enriching. It's not as if they are living their whole lives in those clubs anyway, probably only meeting once a week at the most but it's still a great place to meet some friends.

      Until it gets tribal as all groups tend to do, and start consolidating power and influence as groups tend to do, and before you know it, you have the KKK and the Democrats and Republicans... if you think the ethnic club that you might be apart of wouldn't start trying to taking advantage of "non-members" if they had the ability to do so, you're delusional. Tribalism is hard-wired in to our DNA, and we have to at least be vigilant and skeptical of our inclination to embrace it.... It's a slippery slope.

    The new leader doesn’t like the old leader. He got the assembly together and tried to find flaws in his old leadership. The new leader did the math and honestly thought that the old leader was getting paid too much from the loan and the judge corrected him and said the numbers were correct. Neither man was wrong, that’s what the courts are for. I’m not sure what happened btwn them two but one thing for sure, these guys wouldn’t spit on each other if the other man was on fire 🔥

      I like the old leader better, He got stuff done and even put his own skin in the game. The new guy doesn't understand amortization of loans and misrepresented the by laws to the membership in order to initiate a hostile overthrow based on personal disagreements.

      I used to be a member of a statewide school fund raising and advocacy association. There was an accusation by executive members against the president. Apparently she had authorised the lease of a company car without the ok of the executive committee (there was legitimate need of such but it hadn't been put to a vote according to the committee minutes). Anyway, she was savaged over the matter, publicly humiliated and lost her position. One of the people making the accusation was then unanimously voted in as President.
      It all turned out to be a twist of the facts. All of her accusers actually signed off on the lease. The only things the President did wrong was not putting the decision to the entire association (not legally required but recommended) and not making sure that the decision was properly minuted.
      It was all a power grab, not planned from the beginning though. The executive wanted to take power and looked hard for a reason to get rid of the President.

    As someone of Sicilian descent the plaintiff just melts my heart. Reminds me of the men who used to play cards around the table while the women would chat in the kitchen and make espresso in the little coffee tins.
    I've had to watch that generation fade and it's a real loss. But I'm lucky that I got to experience a part of it.

    The plaintiff looked like an old school guy who worked hard and gave a lot to thw club for TEN YEARS. The Def. Looks like a guy born into money who now wants to be a godfather character and throw some weight around and I think gearing rid of the plaintiff was revenge. But dang they don't have a treasurer who knows math or at least take in to the bank for a second look at the interest? Definitely looked dumb

    the judge is so smart, fast on her feet with these cases ..and business/ clubs like these can get ugly.. family or just friends.. once the cash starts rolling in everyone turns into a monster! outside people/ government getting involved with rules and regulations. makes things worse.. where people/ members be like, f this im done bye.

    This case boiled down to simple math?! Despite the judge having to clarify that the bylaws didn’t say what they thought it said, he hung his hat on the wrong argument. What a mess.

      An agreement? The plantiff loaned the club a small fortune and at a smaller percentage than what the bank was asking, probably saved them around 2k in interest. If someone wants to punch you in the face and you don't want to be punched in the face, do you think you compromise by getting punched in the stomach?

      They are not just two members, they are administrators of the club. This is a matter that was brought before the entire membership and was voted on. The dispute is not about the amount of money, it is about an accusation of misappropriation which the plaintiff proved was false.

      I donate directly to my local library, my kids schools, their classrooms and local fundraisers (a family lost everything in a fire, a little girl in my girls' school that had cancer).

    I hope the new president now has egg on his face from this. Before coming to court no one on his exec/admin team thought to ask anyone to consider how interest is calculated on loans?! This should have been as simple as a phone call or a couple letters back and forth to determine how interest was calculated, and whether it was in line with standard procedure for loans.

      Did you not hear the heavy accent? No matter how long someone has lived in the US after immigrating it can be hard for them to speak English fluently, especially if they speak mainly in their mother country's language on a daily bases. It doesn't mean that they are ignorant or something is wrong with them. At least on the plaintiff's behalf, it doesn't.

These guys are US born, IMHO, and just members of an Italian social club. They just don't communicate well. Listen to the new club president, the defendant, describe the club. He can't. JM has to fill in the blanks and guess that it's a social club.

    This shows how much he really loved his club and the people there.
    The defendant and two year President votes with the assembly to kick him out .
    😳 How crappy!
    I guess that this President and assembly really wanted the club house to close rather than the Plaintiff using his money and so on.
    That can't be it!
    The new President wanted him out because he probably wanted to be a big man on campus.
    And he talked to the assembly board about the ex-president in a bad way.
    I'm sure that his heart and soul were shattered when they gave him the 👢.

    Everyone on the street will shame the Italian club for being racist but they would celebrate an African-American club. They aren't loving, they just go along with whatever they think they are supposed to.

    Judge got this one mostly wrong IMO. I really don't like when judges get emotional and grandstand and fail to LISTEN. Harvey got the truth in a 20 second debrief at the end. The defendant said, and I believe him that the plaintiff was actually a BULLY and threw people out of the club for no reason. I knew there was more to it. She wrongly got hung up on the $3xx dollar amount. She threw her power around and got loud and failed to LISTEN. He was trying to explain and she emotionally cut him off. It was not about the money. Many people did not like the guy- it's that simple. The new president did what others wanted him to do.

      Disagree..people who have a common interest should be able to have a club unless its to promote harm to others. Granted, I have traveled oversees to many countries, worked with middle eastern people, asian, white, black, hispanic and serviced students from all over the world.

    If the group is to provide s sense of community through language and culture, why are cultural groups a bad thing... Brought together for the right reasons, these are good especially for older people and also younger people who want to learn more about their culture. Yes these groups are negative, if they act in a way that does promote segregation from the wider community and county they are in.
