FACT: A Charge off means the alleged creditor took a tax write off and was given a tax credit, and they also cashed in on the default insurance and were made whole. Therefore nothing is owed by the consumer, and the charge off should show a ZERO balance. However, a Charge off with an outstanding balance is a violation of the FCRA and the truth in lending act, because the creditor failed to adjust the balance to ZERO!!

You can have this removed because you do NOT have a contract with them and the account has been charged off by the original debtor sis there is no longer a contract with the lender. Legally you do not have a contract with the third party so you can demand it be removed by the credit bureaus.

Very true on all you have said, but one thing a collection agency has to do is proof they own the debt, and there is all kinds of legalities they have to abide by to prove to you that they are actually the real debt owners… ex: you sell a car, the car needs a title and has to be signed… if not signed or having proper documentation to support it is invalid…. But collection agencies can out off the blue contact you and say anything they want without proof of ownership is ridiculous!

I opened a loan for 4000 through Mariner finance and it became 6000 and they said they added interest on right away apparently. I went through identity theft by my own mother in 2021 and couldn’t pay anything so they charged it off and now it shows the balance going up every month? Why?

I am a truck driver and my last job paid me by the mile but they would not pay me the actual miles driven. I’m not sure how they would do their calculations. They also asked me to adjust my electronic log book so I could keep driving past the legal hours allotted on multiple occasions, which I refused to do. When the truck would break down and I had to wait overnight somewhere for the roadside assistance, those hours were not paid. They pay stopped as soon as the truck broke down. I worked an average of 70hrs per week for roughly $1300 gross pay. That’s less than minimum wage in CA. So once I finished off my year I quit. It’s been 2 months since I quit and I haven’t found another job so I thought I would try unemployment. Worse they can say is no right?

0:48 not true because the debt collector states they doing it behalf of the creditor. 4:10 now this the proof , to never give out your phone# and email, it should be against the law sell people personal information.

If you have a charge off account…make sure you then contact the original creditor and have them either, report your account as “Paid for, for less” or they have to remove it altogether!!!…because, if you personally paid them or the debt was sold off to a third party collection agency…THEY HAVE BEEN PAID!!!
