RTF Lawyer - Jesse Barton Speaks about RS2477
In June 2024, Jesse Barton, a landuse attorney at Gallery & Barton in Sacramento, gave a presentation to those on the RIG (Rubicon Information Group) call regarding RS2477 and how it works.
Users on the call were given opportunity to ask questions. This was paid for by the Rubicon Trail Foundation to enhance the knowledge of the user population on the legal status of the Rubicon Trail.

Winter Camp - Rock drop

In 2018, in order to stop water from accumlating at Winter Camp, El Dorado County used OHV Grant funds to drop rock using a Ericsson Crane helicopter. This project raised the road 3 feet in the water quality monitoring area from the 2012 Easement. Since this project was completed, the County has not closed the trail for Attachment C measurements.

    Do any of you remember my papa Billy McDonald? He passed in 08 but was a huge part of Jeepers Jamboree and rubicon trail every year for most of his 68 years.

    The fewer numbers you have, the less power you have. It is my understanding that model ts used to be able to use this trail/road. It became popular for use by surplus jeeps. How many of these vehicles could use this trail now? It's a number game and your putting yourself, us out of business. I have a stock 1976 CJ7 quardratrac, could it make it through there now?

    been going to the Rubicon for years and it is so cool to hear these stories. I just ran the trail again 3 weeks ago after 15 year hiatus and already cant wait to get back. I have always come in via Loon, but next trip is going to be the original route through Wentworth and I can hardly wait.

    Thanks for the video and I think I want to donate because this is how you work together with the community and I'm kind of excited because that part of trail is very boring We have a chance now to make actually more wheeling on the Rubicon where that's going through that is I don't believe that's a road so I mean this is could be a good thing and exciting thing and Barker pass is always been my favorite way out anyway

    This project is very expansive and more than what is needed. You are talking about a huge bypass to alleviate a section of trail which is only about 200 feet in length. This could be accomplished with a lot less money, which by the way RTF hasn’t spent that much money on the trail in years. Case law doesn’t mean you can bypass written contracts with the Forest Service which has to guarantee the RS2477 would be implemented on the new section of trail. If not then the FS can close that new section of trail when they wish to. As far as RTF funding, why are you refusing to show the financial records of your 501C3 corporation as requested. Another point should be how is Mike Barr getting a contract when it hasn’t been put out to bid? And I appreciate El Dorado County, but this project is in Placer County and on Forest Service land. Also, this project had a previous grant for planning with El Dorado County that was not fulfilled. There was an agreement in place for the FS to do the work and the County to reimburse about $25,000.00, but this did not happen and the grant was returned without an expense and was unfulfilled. Lastly, where is it documented that the RS2477 will be maintained for the bypasses that will be re-routed around? These areas should not be abandoned or closed. There can be alternates but the original trail should remain. The public should not give up any rights to the original trail. There are just too many questions about this issue that have not been addressed.

      There was a public zoom meeting with the Geologist, Legal and Forest to discuss the project. This will be posted for others to listen, so look for it soon. The basics are...anything other than a reroute, as the geologist stated would be problematic and expensive. Information we received regarding options like post pile driven for support would run into the millions. The forest service has no input in RS2477, and that is included in the meeting. El Dorado County has an maintenance MOU and started this project. TNF as the fee holder and operator of this portion of the road is managing the grant. There is no RS2477 in place by Placer County on this portion, this is addressed in the meeting by RTF RS2477 legal expert. We're hopeful that Placer County will assert their rights, but TNF would still be managing the grant as fee holder. Nothing would change for the project. Our attorney was very clear in the call that rerouting a trail is not legally the same as abandonment. I encourage you to listen when posted. As for RTF Financials, simply request them! We will be happy to provide them and have done so upon request. We don't get asked a lot, but when we do we're legally obligated to do so. It's not a burdensome request. We always have them available. We have 30 days to provide them, but typically it's less than 24 hours that we send them out. Thanks for the comment!

      I encourage you to listen to the Zoom call that took place last night when the recording is posted. The short version, the Geologist with California estimated within 10 years, this section of the trail will be closed. By proactively, creating a route around it, the Rubicon Trail remains open. That is why it's good news.

      I feel it is a double edged sword. It is great news the rubicon trail will stay open. I enjoy the trail at minimum, once a year, but are we opening Pandora’s box? Seeing they can threaten closure and we now have to change the route. When will the gov claim we need to close a major part of the trail. Can’t we do maintenance on the existing route to keep it open? I get it’s a balancing act of working with the evil groups and getting along with them but also putting our foot down when we need to as well.

    Are all routes that existed before the repeal of rs2477 in 1976 protected? Half of my clubs trail was closed by the CA wilderness expansion act of 1984. It seems like it should have been made a corridor like the other trails were in my area. Id love to get more info on this subject, do you know who i can talk to?

      That's a great question. So the County has to assert their RS2477 rights. In the case of the Rubicon, El Dorado County asserted their rights in 1989. Then in 2012, actually got an easement from the USFS. This is why the Rubicon Trail is still open. In the case of Panamint Valley (my understanding), the road was NOT claimed and users attempted to sue, but were denied. The reason none of them were land owners, so they weren't legal "injured". This is what makes the Rubicon Unique...the county claimed it and organizations like the Rubicon Trail Foundation actually own part of the trail, meaning if it ever tried to close we would be legally injured. So long answer to say....those Counties would have to claim those as Public Roads under RS2477. You'd need a land use attorney.

      For sure...that's typically true. The reason it is not required because TNF identified RTF as a sole source provider because we have the experience to build an off-road trail, not just a dirt road or a highway. It's not like they can go to Granite Construction or some other CalTrans road builder. Great question though...thanks.

      That is a good question. Id imagine there are. Im no expert on other RS2477 routes, but they helped shape the west starting with the mining act of 1866. RS2477 was stopped by the wilderness act of 1976, so no new rs2477 routes since then.

    100% agree but also keep a metal D-ring handy for rigs that are setup for those.

      Using a soft shackle with D ring properly anchored to the rig would keep metal out of the air. The soft shackle would fail way earlier than the D ring. We'll be doing a video about that this summer.

    Nice video !! Interesting that Steve mentioned his old Land Rover. There are several RTF videos that show 1960's Rubicon trips with a 1948-1950 Land Rover series I 80" wheelbase, and at least one of the videos shows a late 1950's / early 1960's Land Rover 109" station wagon. I wonder if either of those was his. On a side note, as awful as modern Land Rovers are, don't underestimate the rock climbing ability of the really old ones, even on 7.50x16 bias plies. I had just noticed a disbelieving chuckle by the interviewer when Steve mentioned climbing that hill in his old 1962 Land Rover 109" I've driven these obstacles and the rest of the Rubicon many times in my old Rovers, both in stock form and built.

    I made it through there on 31s with a 4” lift grand Cherokee around new years. We made it to the first pull off on the left. I didn’t want to get the family stranded so we hung for a little and had lunch and went back to the camper. Will be back with someone and spare parts shortly
