In a series of interviews, Nicola Palmer, Marketing Manager at The Rural Planning Co interviews its Founder and Strategic Planning Consultant, Hannah Moule.

Hannah then talks through her thought process behind her decision to start The Rural Planning Co in the middle of the world pandemic in early 2020 as part of an ambitious business plan.

    Thanx for that! Question. I am buying a barn of 250 Sq.M. and I want to use it as one sole dwelling. From what you say here however, I can't and will have to divide it up. So the question is this, can I have 150 SQ m as a dwelling and the remaining 100 Sq.M as a holiday let?

    Could you use the Part 6 PD rights by cutting up a farm into separate legal holding vehicles? For example, you have a 37.5 acres farm, Farm A, cut that up into farm A.1, A.2 and A.3. Each with independent AGDR, thereby loosing ADGR in sections, rather than as a whole. ?

    This is fantastic to see, thank you for sharing. We're exploring similar ourselves. Do you offer drafting rental / option agreements? We're looking to start out with rental agreement with an embedded option to purchase at a pre-agreed rate, index linked. Any strategies (apart from marketing for sale at 40% below OMV or, never living in it as an agri occupancy) to remove a tie like that in 10 years?

    Crazy to think that humans need to ‘ask permission’ to build … a pigeon dosnt. A badger dosnt Even a worms can create a home for themselves without asking permission…😂. Anyway. Great information thank you for sharing

    Hi - so do you mean to say that if the land is 5 hectares or more then i can build a maximum 1000 square meter agricultural building? Based on this, suppose if i own 12.5 hectares agricultural land this means i can build 2 separate agricultural buildings each 1000 square meters? Is there a guarantee that after 10 years the buildings can be converted to residential/commercial storage use under class Q development? Lastly in your experience, how much can such agricultural buildings be rented out for per month/ year?

    Really enjoyed this - thank you for sharing. I'm both surprised and very impressed by what you have achieved - from scratch! Amazing! It's particularly interesting to me because you hear a lot of the negatives and people trying to beat the system but it seems you've played by the rules and won? Can I ask though, if they did reject anything at any point? I'm guessing sometimes this is down to ones specific council and very much depends on your neighbours! Thanks again. I hoping to possibly need your services in the future.

      Hi Dan. Yes the house has got an 'occupancy condition' which restricts the occupiers to being employed in agriculture. Often referred to as an agricultural tie. If you want to know more about Agricultural Ties, we are holding webinar on this topic on Monday 13th November at 7pm.

    Hi Hanna, am I right in thinking that for one of the tests to live onsite, you have to have at least 40 hours of work for a rural worker, and different animals have different hours of care assigned to them by the council. Do you know where these hours per animal are published, please? Kind Regards Jeff.

      Hi Jeff. Yes, one of the common tests to justify an agricultural workers dwelling is to show that there is a need for a full time worker. The widely accepted test is that you have to show 275 days per year of work. Different consultants use different data to calculate the days of work. One of the common sources of data is John Nix Farm Management Pocketbook. But, use with caution as there are variations and some things don't entirely fit (ask a good planning consultant to help!) We seem to be doing more and more Ag Workers Dwellings as our knowledge is extensive on this topic.

    Hi I’m looking a put a shepherds hut in my garden I come under Christchurch Council uk. I’m a short walk to the beach and there’s somebody about 400 m away has done exactly the same thing though I don’t know whether they have planning permission or not but they’re on Airbnb. Your opinion would be greatly appreciated

      The policy referred to generally relates to England, but many of the 'principles' of what we discuss would also be relevant. Things like access, flooding etc would all be equally applicable in Scotland.

    Great video! Do you know if the Certified Caravan and Camping Club also works in the US? I've been seriously thinking about putting up 2-3 tents in my backyard, but don't know if its legal. If business doesn't work out, my kids will have super cool backyard camping haha

    Hey, great video. I want a Glamping site in the south west. Ie cornwall/devon. Do you think I'm wasting my time researching buying land with barns/stables to live in a static and gradually start a Glamping site and planning to turn barn/stable into a residential property.       Hello Andrew, Thanks for your message. As with any site careful consideration must be made regarding local designations; AONB's SSSI's and historic monuments make applications more tricky. Matters such as siting, access, visual impact, water management, drainage, sustainability and business need are all factors that the planners will consider.     Hello there, Can I ask you a question, please? After I submitted the Prior approval application a few days. The council gave the Notification of Decision " the Prior Notification Prior Approval is required " what does it mean? After 2 months (passed 56 days ) We asked them again that " The barn is granted after 56 days?" The council said " No" They just told me they are making the refund. Next day, They sent e-mail again that they have made the refund. Why ? What does it mean? Can they just do like this ?
