- सुप्रीम कोर्ट ने तलाकशुदा मुस्लिम महिलाओं के अधिकारों को लेकर बड़ा फैसला दिया है... फैसले में साफ किया है कि दूसरे धर्मों की तरह ही एक तलाकशुदा मुस्लिम महिला को भी सीआरपीसी की धारा 125 के तहत गुजारा भत्ता का दावा करने का अधिकार है... आपको बता दें शाहबानो मामले में भी सुप्रीम कोर्ट ने इसी तरह का फैसला सुनाया था... जस्टिस बीवी नागरत्ना और जस्टिस ऑगस्टिन जॉर्ज मसीह की बेंच ने ये फैसला दिया है... हालांकि दोनों जजों ने अलग-अलग फैसला सुनाया... लेकिन दोनों की राय एक ही थी... दोनों जजों ने अपने फैसले में कहा कि सीआरपीसी की धारा 125 के तहत तलाकशुदा मुस्लिम महिला अपने पूर्व पति से गुजारा भत्ता पाने की याचिका दायर करने की हकदार हैं.
The Supreme Court has given a big decision regarding the rights of divorced Muslim women... The decision clarifies that like other religions, a divorced Muslim woman also has the right to claim alimony under Section 125 of the CRPC... Let us tell you that the Supreme Court had given a similar decision in the Shahbano case as well... This decision has been given by a bench of Justice BV Nagarathna and Justice Augustin George Masih... Although both the judges gave different decisions... but both had the same opinion... Both the judges said in their decision that under Section 125 of the CRPC, a divorced Muslim woman is entitled to file a petition to get alimony from her former husband.

दे और उसके और उसके पैत्रिक संपति षर उसके पति का अधिकार छिनकर पत्नी के नाम कानूनी अधिकार प्राप्त हो,और उसे भी गुजारा भत्ता दिया जाए।

तो अगर पत्नी की मौत के बाद और पत्नी नोकरी करती थी तो पत्नी की नौकरी पति को दिया जाता है क्या और पैशन भी दिया जाता है

OK it's a good decision but if the women takes Qula at that time also her husband has to give her Talaaq so Qula means the Talaaq choosen by a women so at that time why the ex-husband has to give her maintenance.
