2nd comment. people HOAs are actually illegal in the US. oh sure most people think they are legal but they are not because they have no oversight like they are supposed to, they do way too many illegal things like the one in this story does and once the last home in that community or area is sold to someone, the developer who built all those homes no longer has any legal control over the property on which they sit meaning that their HOA must disband unless something like 90% of the community votes to keep it and that is 90% of the entire community, not just 90% of people who showed up to the meeting that night.

@@ToepnToep the name you are probably seeing is the wrong one, i have no idea how to change it back to the correct one and i tried contacting youtube to get them to change it but i am getting off topic a little. my actual name is repoman and i have over 20 years repo experience which means that i have dealt with property, property laws, financials, cars, loans, HOAs and etc. for over 20 years, i think i would have a good idea on what is and is not legal? why do you believe what your teachers or college professors say? all they are doing is reading out of a book that gives them the answers and they copy and paste it for you. now getting back on topic. 1. there are plenty of laws about HOAs, several of these are that HOAs are subject to the same laws that everyone else. they can not just make up their own laws and say they are the ones that are right i mean come on, you just heard a story in which the HOA had their ass handed to them for breaking several of these laws. 2. all HOAs have to be voluntary because you have to be allowed to skip over the "i agree to the HOA rules" if you do not agree with them and if you dont, you dont have to sign that section of the paperwork that is supposed to be given to you upon closing on the home or whatever it is. now with this, again is falls under that HOAs are typically started by a developer who bought a piece of property and decided to make some money by building and selling homes on that property. once one of those homes is sold, that developer has no more legal control over that property and once all the homes in that community are sold, then the developer has been paid in full for every house on that property and therefor has no more legal control over any of that property which is when the HOA is supposed to disbanded but most illegally just say that they are just converting to the homeowners and electing a new board, but again most people do not deal with this as often as i do.

Even if somehow a HOA somehow accomplished government redisdistricting, that would simply allow you to join, without a signed membership contract of joining you aint a member.

Also while they might try to apply their regulations to the area in dispute they have no right to apply them to the entire property

Don't the States have laws regulating them. Just recently Florida changed some HOA parking rules.
