    So the $5 a day late fee doesn’t apply for residential tenants? Also is it true that late fee cannot be 5% ore of monthly rent.? Please confirm it’s so confusing on the internet

    My landlord is trying to evict our family because they don't want to fix our hot water heater. We told them it went out on the 4th of January 2024 and they tried having us leave in 5 days. Now they want us out on the 31st of January. Our lease isn't up till August 31st and we've done nothing unlawful whatsoever. We're not sure what to do. We've sent them a letter requesting repairs with the tenant laws that we're protected under. We just need our hot water heater fixed. HELP!

      @@DoorLoop We have and they said that the landlord might condemn the place. It's really just the water heater that needs to be fixed. The only person we got onto the phone said to just leave as if it was that easy right now. Can they really get away with this? We've never been a bother in any way and just need to finish our lease. All I know is that they need a court order to kick us out but what judge would do that in this situation.

    Deposits do not say “usually 1/2 months rents” usually 1 month rent up to 1-1/2

    If I've given 20 service requests, many emails and landlord telling me that the issue was going to be fixed and made an appointment. Never showed up and it had been going on for 5 months. Gave landlord a 10 day notice and then my notice to vacate. You can't get them on the phone. After I move out their attorney said that I'm not getting my deposit back and blah blah blah. I don't know how to proceed since it's a landlord friendly state and doesn't matter what the tenant has as proof the landlord usually wins. How do you think I should proceed?
