      I'd probably chalk it up to "good faith" since any reasonable person would believe that the black-robed person administering their oath really is a judge in good standing in the state of New Mexico. Honestly, who would even question it? I've taken numerous oaths in my life, and not once have I checked the background of the person administering it. It's a bit unreasonable to expect anyone to do that. Were they technically impersonating police officers? Definitely. But with the information they had available to them, they had no reason to believe that when they were sworn in, it wasn't official. It's not so much a case of ignorance on their part, as it is malfeasance on the part of the people who knew very well he wasn't a judge. That's probably why the officers themselves wouldn't be named in the lawsuit in their individual capacity (as non-officers), or in their professional capacity (since they weren't officers). It's enough that the cases are all being reviewed and people who were falsely arrested are being released.

      All lawsuits won against the police should come out of their retirement program or at least 50% of the award. If this were to happen, then peer pressure within the police department would affect how police do their job.     Here in Australia, the same thing happened. In the state of Victoria over 1000 police officers for a period of up to 4 years had never become police officers. They misunderstood the law and were never sworn in correctly. During that time, of covid restrictions were in place. They imposed lookdowns, conducted violent assaults, cracked down on covid protests ect. While a good portion of there police force weren't empowered to do so. Their only defence was ignorance or the law... lol

      You'd think, but then you would be wrong. Every male of the age of majority is part of the Sheriff's posse, and the sheriff can call them up and deputize them as he see's fit, no swearing in required.

      @@wesKEVQJ If he won the election he was sheriff, unless I totally missed what was going on here and these are city cops. Deputy usually means Sheriff. A Sheriff is elected, the dispute is he wasn't properly sworn in after the election right? Which invalidates all of the swearing in of the deputies correct? I am following the argument here right?
      My guess is the judge is going to say he was duly elected, and will just make everyone swear in again, this time with the proper pomp and circumstance. That is my guess, the released people should still be good though, and they have potential lawsuits for false imprisonment etc...

      @wesKEVQJ Not true! I’ve been a Police Officer since I was 6 years old! Even though my badge is a little small now I wear it daily on my patrols because my dad pinned it on me when he swore me in and it means a lot to me. Still carry the Six-Shooter cap gun he gave me too. ( honestly it’s a lot safer than the ones they use these days, I haven’t killed a single suspect! I practice non-lethal policing.)

    The Sheriff and all of his deputies need to payback all income, insurance, and any benefits such as pensions received for the time they weren't sworn in, and every one of them need to be charged with impersonating an officer.
    The Sheriff's Father was impersonating a Judge or public official. 3 years and big fine.

    Out of all the stories I've heard over the years,this one I have to have updates on. I grew up around jails courthouses and federal buildings because my father was one of a few that designed those types of buildings. I unfortunately grew up around some of the biggest criminals in the country and I'm not talking about the people in the jails my dad built. I have never heard of anything like this happening. Ever. Please keep up with this story. The sheriff needs to be impeached and the "judge" needs to go to jail himself.

    Im retired deputy in Virginia. If the deputies have not been sworn over 2 years dont have the proper schooling [ACADEMY] in my state you need 40hr continuing law. This is a horrible fricken mess. OMG false imprisonment, hope no one got shot. Dam list will go on for a long time WOW

    Every speeding ticket and fine assessed by these bogus officers will have to be refunded. It will pale in comparison over the false imprisonment lawsuits since no one was arrested by an actual law enforcement officer and any testimony given as a law enforcement officer is null and void.
