    The attorney and court involved probate process can be difficult. And heirs are sometimes misled by the attorney who wrote the will.
    Estate attorneys know that the real money in writing wills is not in the writing in the will, but in the probate of the will after the testator dies. Legal fees for probate typically far exceed the legal fees for the creation of the last will and testament.
    Some lawyer offer "as a courtesy" to their clients, to keep the client's original will. Lawyers know thta the original will must be produced upon the death of the testator. But by keeping the will, the attorney knows that the executor and heirs must "come through the attorney" to get access to any inheritance after the testator dies.
    Other lawyers, when drafting wills, include a provision that the attorney is appointed as the attorney for the executor or the estate. While the provision is nonbinding. the provision misleads executors and heirs into thinking that the heirs are "stuck" using the legal services of the attorney who wrote the will, and thus stuck with whatever arrangements the attorney makes up.
    Probate can be hard enough. Those in charge of completing it should not have to feel misled that they are forced to use the legal services of a particular attorney.

    Thanks for this. My mother's will is with her lawyer. I have no wish to use him for probate. Both my mother and myself thought he was sleezy.

    I'm still going through probate a year and 1/2 later. Just listening to your videos faithfully. It rang up huge amounts of probate charges to the lawyer in the midst of the trial my lawyer died and I had to find another one and that was a mess . Yep 95 he was.

    Thanks for the clarification. This is what happened in my father's case. His will was held at the lawyer's. When I went to retrieve it the paralegal sat me down and outlined their fee to probate the will. I told her that I planned to try doing it myself as I had a kit with all the forms and procedures. She said she was aware of someone who had tried but wasn't sure how it had turned out--possibly hoping I would conclude not that well. I went ahead anyway. It worked out and I learned a lot in the process.

      @@lotusriche4505 there is a community law group here that has a guide they developed for "small" estates but quite frankly it would work in most cases regardless of the size of the estate. If you can find such a resource in your locale start there. If you don't have such an organization, check your law society or justice department for any guides they may have. I had to prepare a list of estate assets and their valuation. This wasn't as hard as it sounds. As long values look reasonable who's going to argue? The tricky part is getting all the required forms just right. The first time I submitted them to court clerk wouldn't offer any advice or comment. They were returned to me with instructions for what needed fixing. When I returned to refile them it turned out that I still had one thing wrong but rather than send me away, the clerk helped me fix it and, since she was a commissioner of oaths, witnessed my signature. The refiling fee was $5 which is pretty cheap tuition.

      One thing I did get wrong was including bank account numbers rather than just the account balances. Once probated the will is a public document available to all. Not sure how Prince Philip's will can be kept confidential for 99 years.

    My siblings and I lost our dad and stepmom and her family is claiming ownership to everything. It’s a nightmare dealing with them and this whole process. We are also finding out the process doesn’t mean we have rights.

      telle me about it, no one wants heirs to get anything, lawyers probates etc... its a pack of wolves that you need to reduce the number, because it will remain some wolves anyways

    TY. As I've been watching all ur videos, I questioned why our attorney hadn't suggested a trust & did the will we requested. It makes much more sense now that he said it was customary for his clients to leave the original w him for safekeeping. More people need to be educated.

      This is very much true in Pennsylvania. Trust administration has many of the same rules, and much of the process is identical to probate. Probate fees are low, almost always less than the cost of preparing a revocable trust. Worse, if the person did not properly fund the trust (partially funded) which happens a lot, you’ll have to probate AND administer the trust and if you hire a lawyer to do it, you’re going to get charged more because it is more work. Avoiding probate with retirement accounts is great, but complete avoidance is difficult and an estate without liquidity puts the executor in a tough spot to pay bills and taxes (in states like PA that still have death taxes). Censorship is an extremely threatening matter today! The Delphi technique and backlighting has prevailed for too long now.       I hired a lawyer to read the nursing home contract where my father was placed .they scammed me and they thought I would hire them for probate court..lol they actually denied the fact that I gave them my father's signed will when I asked for it back.mafter I bitched up a storm at their business they produced the signed copy. My current lawyer is going to go after them for a refund of the 6k I paid.

    In Maryland, each county has a Register of Wills, which is part of the Orphan's Court and handles probate. The Register of Wills keeps wills on file. I don't know if lawyers are required to file wills with the RoW but it is best to see if your local probate court does the same.

    I’m battling my custodian of my UTMA account for access since I’m passed the age of majority and I was told by the clerk that the probate court is limited in its capacity. They refused to do my motion for summary judgment. I’m trying to get my case transferred to Civil court but the clerk isn’t returning my calls. They said they’d call back on Thursday and never did. I called and left a message. I also just placed a motion to transfer. I’m appalled how slow the probate courts are. I’ve been going in this a year so far. I heard it takes years. It shouldn’t be like this to get justice from an abusive custodian!

    I’m dealing with a nightmare executor that used his position to punish me with his power. Now it’s the accounting phase and I can’t sign off the shady stuff continues in that document. What do you do if you want your rightful inheritance but you’re being bullied to sign something shady to get it ? Even threatened that you will pay money for the right to not sign off on it. They said I will be forced into court. Did my mother want this when she drew up her will ???? Definitely NO !!!!!

      What exactly is shady that they want you to sign? If you can prove they are shady or have good reason, you can petition to the right court to have them removed. Is the executor a family member or family friend? Also they are entitled to 4 to 6%.

      My experience is not to trust solicitors. Dads solicitor of 40 years, who he trusted screwed us over royally th-cam.com/video/WegUHx9kMSI/w-d-xo.html probate fraud and theft is a big earner. What i have also found is that no-one holds them to account.

      So if you are writing your will... Share your wishes and keep people up to date! There are many misconceptions and unfortunately people rely on their friends instead of asking an attorney. Take a breather to consumer the information before engaging an attorney.

    Thankyou for all you do Paul. I have what may be an unusual question and it is this;
    What if the family of the deceased fails to file in probate for a property being managed by me?
    I was the renter/manager for a dear friend and she passed a few months ago and the family has shut me out completely. I am still carrying on as I have sense 2017 concerning this home which is in Nevada. I pay ALL bills etc. The deceased's primary home is in Washington State.

    I contacted the lawyer that was handling my mom's estate ,,he said he's not actually even a probate attorney and I should call another one and have me his number, so I called the other guy ,,I ended up paying him thousands of dollars and going through a bunch of bullshit for him to tell me three months later that the guy who originally told me to call him already did everything literally paid him over two thousand dollars to do nothing ,,is there any legal action I can take against him because it's obvious they were friends and I got played

      Yes, you can get justice. You can contact your state bar and file a complaint of deceptive, fraudulent, and unprofessional conduct. They will suspend or revoke the attorneys license and can sometimes get a court order to refund you with treble damages.

      My mom died and she left a will giving us the house and land.we haven't went through probate on it because our executor says his lawyer says he don't have to probate it. So now our stepfather went and got executor rights on the house and then to top it off he went and paid taxes on the place that wasn't even due yet. Then went to lawyer and got deed made for him. PLEASE TELL ME WHAT CAN I DO.

    My problem is not with heirs, its with the attorney who wants to control everything, move the money to his own bank, and has little time to answer questions to keep the executor updated.

    Yes, I had a cheesy money grabbing lawyer that pressured us HARD to have him hold the will for “safe keeping”. I wasn’t happy with him because he didn’t give full disclosure in stating his fees to write up the Will and POA. He was boarder line angry and gave me a hard time when I said I’m taking the will with me. He reminded me of a great joke. “What happens when you give a lawyer Viagara? He get taller😂”

    Thanks so much for sharing. In every industry are people who can give more of themselves. Equally there are many areas in which there are questionable behaviors. Thanks for being brave and standing in your truth, while arming the general public with the tools necessary to make informed decisions. My plan is to look into my own personal plan of action as well as paying it forward. So Patrick dies the attorney is holding onto the trust documents, does the attorney simply hand it over to wife Becky who is the name on the Trust? Then Becky simply take it to the various entities for disbursement? any help is greatly appreciated.

    My ex husband died 16 months ago, leaving everything to our daughter, now 27 but assigning his brother as PR.
    My daughter was never consulted on any of the estate decisions and she wants to challenge a lot of the charges the estate atty and PRs have made to the estate. To this point, they've taken around 60k (as far as we know because she's never gotten a full accounting).
    She'd hired two attys - one kept charging her for "asking the estate atty questions" but never coming up with any answers. The second one literally refused to submit any of her questions to either the estate atty or the magistrate.
    The magistrate told her to get an atty when she tried to ask the questions in court.
    The estate atty is now saying that if she insists on challenging the charges, it will "take longer" to close the estate.
    That was a month ago. So far, the estate atty has all of her inheritance and refuses to do anything to move forward.
    She's literally gving up on a 500k estate because she feels powerless. I don't know how else to help her.

    Yes it's a much better idea to give the original will to Billy Bob for safekeeping. Maybe Billy Bob will put the will with the spare tire for safekeeping. Or better yet, slip it into the headliner of the F-150 where it will be safe and sound, absolutely. Great idea; much better than in the lawyer's safe.

    My husband is the executor of his father's estate that never had a Will. His father owned lots of commercial properties and a couple ranches. There is an attorney in California claiming that he will not use the proceeds from the sale of a ranch to pay off the estate debt UNTIL HE GETS HIS CUT/PAYMENT!!! HUH?! He works for the estate and his job is to write checks to debtors and banks to pay off loans/debt but he wants his cut BEFORE THIS. Please tell me this is not real? Help me to understand what's going on! Thank you!!!!

    Is there a way of approaching an existing living trust without probate for simple questions no court. The original lawyer that created it won’t help or answer any questions. Example if the trustee was in parents account as a primary account holder since they were teenager and both parents pass away but in living trust that account was not added in living trust . Are you required to split that in living trust when it wasn’t listed in it?questions like this.wish every lawyer was nice and would explain it like this gentleman is doing.

    How about when a crooked attorney drafts the wills for a husband convicted of domestic assault, and his wife suffering from Alzheimer's, at the same time? How about when the same attorney copied the section for the bulk of the estate, from the husband's will; bequeathing the bulk of the estate to "my wife. Should she not survive me, to my daughter..."(the wife never had any wife or daughter, but the husband had a daughter from a previous marriage). How about when the challenger of the will brings up the wife's inability to understand that she had no wife or daughter, when reading the will to sign it, and the attorney who wrote the will, and employed those who witnessed the signatures, blurts out under penalty of perjury (yes, she was sworn in as a witness, even though she was also advocating the case) that her client was of sound mind, she just did NOT read the will that she signed? How hard is it to get someone so crooked and incompetent disbarred?

    If you put everything into a Living Trust... how is the trustee not have even less oversight than an Executor would in Probate? Sounds like a double-edged sword...

    We have a golden rule in the uk but the solicitors/lawyers don't observe it. Lawyers are sharks when they really don't need to. If they did some actual work we would pay them but they work for No.1. Which is scary when you think of all the things we need them for. Crikes Scoob!!

    I been trying to find a video on Lawyers named as Trust Protectors vs. Co-Trustee.
    The Lawyer I have said he normally writes it up as he is the "Co-Trustee" not "Trust Protector", is this normal or should I request he writes it as he is only the "Trust Protector" ?

      I've seen something about this. One thing is that stands out automatically is co-trustee typically must act with the other co-trustee.
      Living revokable trusts become irrevocable trusts upon death.

    This is URGENT; WE NEED HELP.
    What do I do if a lawyer not only kept a will and didn't give it to anyone else? She has held on to the choice and held it for seven months now. According to the State Bar, this lawyer is mainly doing everything unethical.
    The lawyer still has not submitted the will to probate.
    The lawyer tried getting my sibling and me to sign a waiver of consent she mailed to each of us.
    My siblings and I had no idea what this even meant, and luckily none of the siblings signed it because we were made aware of the lawyer's deception almost too late.
    Nowhere did it say if we signed this waiver of consent that, we would have given up our rights to contest the will. It appeared if we signed, it was a good thing on my siblings and my part.
    Approximately six months later, we each received a citation to appear in court in NY, giving us less than a month.
    We are all in different states across the other side of the US. We do not have the finances to fly, much less hire an attorney.
    A judge informed me that the things this lawyer is doing are unethical.
    DIFFERENT states react in different ways but I definitely should contact the district attorney's office to see if you can be of help because what is going on is usually not the typical practice of an upstanding, ethical and reputable estate lawyer.
    The lawyer will not answer any emails or calls either. We cannot afford an attorney. Our mother suffered from bipolar and out of nowhere, our mother up and left where she lived for years to move to NY, where she ended up injured and alone with the promise from a nephew he would be there for her if she moved.
    Somehow he got her to make a codicil/new will. She made a will in 2017; it was on her computer before she moved to NY.
    The things this lawyer is doing are, in most other lawyers and courts' eyes, VERY SHADY. CAN THIS LAWYER GET AWAY WITH NOT ONLY BEING THE ONE WHO DRAFTED THE WILL BUT KEPT THE WILL AND MADE HERSELF THE INTENDED EXECUTOR'S LAWYER, WHO ALSO CONVENIENTLY ALSO BECAME THE SOLE BENEFICIARY TO EVERYTHING OUR MOTHER OWNS.
    Please- I have to speak to the judge next week, I am contesting, but I am helpless. I cannot afford an attorney. I was recently put on a kidney and pancreas transplant list as we speak and just had surgery because my vocal cords were paralyzed and I was suffocating, so they had to cut my voice box, and I lost much of my ability to speak. This all has happened to me in the past few months. What are my options, and can this lawyer get away with this unethical behavior??

    At least the will is in safekeeping. I hoped my mother’s original estate attorney kept her will because we need to show previous will after some stranger talked her into naming her the sole beneficiary in a new will

    A lawyer dies and goes up to heaven. When he gets there. there's a queue - miles long waiting to see St Peter. He joins the queue and then a sedan chair supported by 4 angels turns up. They motion him inside and whisk him to the front. He days to St Peter - "This is really nice, but why all this just for me?" St Peter says - "I've just checked how many hours you've billed and by my reckoning you must be at least 135 years old". The lawyer says - "I made a lot of money but I made sure my wife and kids will be OK because I set up trust funds for them". St Peter says - "OK, go through those Pearly Gates". The next guy in line hears this and says to St Peter - "I was a stockbroker and I made a lot of money, but I I didn't keep it all for myself - I gave 4 million to charity".     My Uncle passed away late last year (2022) His partner is selling his property even though I don’t think it’s gone through probate. We cannot find the probate in the public domain. My uncle’s partner stands to benefit everything from this sale of the house. I’m not sure she has the legal right to sell the house. I would like to buy my uncle’s house but she will not sell it to me, she has accepted an offer on the property from someone else but I think she should be stopped as she does not have the legal right to sell the property. Can anyone offer any advice?

      They can’t just appoint themselves, it has to be ✅ok’d by the owner of the will. What they do is give strong or subtle suggestions and recommendations.

    I went to court yesterday my Mom has a collector car worth alot well my sister has a friend who's a lawyer we tried stopping my sister from selling the car we want the car sold just not by her.
    She wants storage fee's because she stored it in het garage there's gonna be a appraisal fee and on and on everything will turn out favorable for my sister. The judge would not even let us say anything it was a joke we don't have the money to hire a lawyer my sister's friend isn't charging her anything.
    The will say's the car was to be sold and money go to the grandchildren which that won't happen.
    Is there anything that can be done we will have no clue about ANYTHING!

      Also, get certified copies and give to all heirs (the post office in the uk can certify)
      think about making a video recording of the will/signing with the heirs and state your wishes
      Do not trust solicitors

    If my will is simple, my house, my car, my bank money, nothing more, and my son is the benefactor of the will, why would he need a lawyer in probate court? The judge can easily see that my house and property goes to my son.

    The estate attorney and closing attorney on my mom's house selling after she passed away did not think I was Nancy coniff Leonard Cardwell s son she and Jerry d cardwell and Nancy coniff Leonard Cardwell adopted from NC in 1975 Robeson county NC. The executor and power of attorney over the estate closed her estate illegally too like they closed jerry d cardwell s estate illegally in 1987.
