    I have an appointment for fingerprints because USCIS put my birth year wrong on my green card. The appointment notification says I must bring a photo ID, in this case because it is an I90 application it says I must bring the green card. My question is: Are they going to keep the green card? Will they leave me without my green card? Thank you.

    My wife just received her green card but noticed it said CR6 instead of CF1. A few days later we received a letter in the mail from USCIS stating that they made an error and we will have to file an I-90. Can we still travel to her home country while we wait for the I-90 to be completed? We will submit the electronic version so she can keep the physical card. Any answers are greatly appreciated!

    My wife received an IR1 10 year green card even though we are married less than 2 years. USCIS made a mistake it seems. What do we do? My wife has already been working on her i551 passport stamp and her stamp will expire in May 2024. Will she have to leave the county and quit her job because it seems like i90 takes 5-14 months and that will most likely mean she won’t have updated card till after her i551 expires.

    Hello! I got my GC with wrong place of birth, I sent I-90 and GC back to USCIS. I checked all my forms filled correctly. I need to travel. Two months ago I call to USCIC, schedule an appointment to put a stamp I-551 in my passport, three weeks ago got am email with “not available appointments”. I have my work and travel authorization card. But some people said when I received status, this document doesn’t work anymore. Is that correct information or I can travel out states with this document till my correct card will come?

      I understand your frustration which why it's best to file the I-90 electronically and hold onto your green card until USCIS requests it. The reality is that you're a permanent resident even without your green card, but it'll be hard to re-enter the US without it. I've never seen anybody use an EAD to re-enter the US after becoming a permanent resident. I don't know whether or not that will work.

    Hi Darian - I recently received a 10 yr replacement Green Card and my name is spelt wrong. I believe I understand the process based on your video and the USCIS website, but I don't understand why the USCIS website has a section titled "Typographic Error' which you can fill out for a mistake made on a green card. It's a very straightforward eresponse and the page states "Did you receive a notice, document or card from USCIS and it contains a typographic error? We can assist you in correcting the error." To me this is confusing. Am I meant to a) Send in I-90, with Green Card, and other ID or b) Fill out this "Typographic Error" form on the USCIS website or c) Fill out both. Any insight would be appreciated.

If I picked "DHS made mistake" while filing I-90 (which I think is the case) but later it turns out that there was mistake in the I-485 (what if my lawyer made the mistake?) would it delay the process or can I just pay online (I submitted I-90 online) right away when they ask? Hi Darian, I have a question so I recently received my green card (10 year renewal) and I noticed that my first name is in the middle name section of the green card as well, (Emelin, Emelin Marte). The application I sent in for the renewal never had a middle name nor was I born with one, I’m not sure if I should get it removed in order to do the n-400 application or to deal with it. Also my full legal name is Emelin Marte Corporan so I’m not sure if I should include that in the application if I have to do it(when I came to the u.s it was just Emelin Marte), do you know what I should do?

      If this was caused by USCIS error then you have two options. (1) You can do nothing and live with the error until you become a US citizen, or (2) you can electronically file form I-90.

    Hi! I got my 10 years green card a couple years ago, but the birth place on it was wrong. I asked my lawyer, but she said it is fine. I don't need to correct it or do anything, but I doubt it. Is it really ok with the wrong birth place on my green card?

    • @DarianLaw
      @DarianLaw  ปีที่แล้ว

      Yeah it's not going to really affect anything, but nothing to lose by filing an I-90 electronically as long as it was USCIS' mistake (and not your attorney's mistake). If it was your attorney's mistake then you will have to pay the I-90 filing fee.

    Dear Darian, thanks for the great video. This is very helpful! I just received my green card and found that the issue date is wrong. It's a typo error made by USCIS and it is 1 year earlier than it shoud be. I've filed the I-90 online, but can you let me know what will happen next? Will they ask me to do another round of biometrics? And after they have processed my I-90 and ask me to send back the green card, is there a limited time to return the card? If so, what is the time limit? I'm asking these because I'm planning to travel outside of US early next year and I'm worried that when they ask me to go to an appointment or send back the card, what if I'm not in US at that time and can't make them happen in time, will that affect my green card or my status in any cases?

      Just a quick follow-up question on my post: If this typo error won't affect my travel and my work authorization, can I simply withdraw my I-90 request (given that it can take very months and even years to replace the card and the interium process may interfere my travel plan) and just live with it?

    Hi Darian, Myself and my wife got our Green cards yesterday. I had applied for EB2 employment-based I-140, so was expecting my Green card to be E26 because I am already in the country. However, when we got the card, the category on my card was E36 (Alien who is a skilled worker) while my wife was E27 (Spouse of an alien classified as E21 or E26). We have planned a trip to Canada next week and I was wondering if I can still make the trip with the error on the card. Can I need to fill out the I-90 form to correct this error after I return from the trip or I should ignore it? Am I qualified to fill the I-90 online as against paper application? Pending the correction, can I use the card for driver license renewal, I-9 verification and travels?

    • @DarianLaw

      In this situation I generally recommend electronically filing the I-90 (which will take MANY months to process before they ask you to mail in your green card). Bring the I-90 receipt notice with you as you travel. You can still travel and shouldn't have issues re-entering the US because, either way, you are a permanent resident. I doubt CBP will even notice the error as you re-enter the US.

      You can submit the I-90 electronically, but I personally wouldn't worry about the mistake because N-400 processing times are pretty fast at the moment (in most of the US) and she might be a citizen before the new green card is issued by USCIS.
