That was jaw dropping. What an unfeeling judge, as well, to rubber stamp that interest rate. I wonder how many times this happens that we don't hear about.

Sadly the state allowed that interest and the attorney presented the law and contract to the judge

My wife just received a summons, IN THE MAIL, regarding the filing of a lawsuit from 'Credit One' for unpaid CC debt. Is it normal to receive a SUMMONS through the mail? I was under the impression that a summons has to be served (in person) by a Sheriff. Thank you for uploading these videos! You are REALLY helping us seniors understand the laws regarding debt collection!

Depends on the state. It is possible to serve a summons by mail in certain states. Here is a link: www.nolo.com/legal-encyclopedia/free-books/small-claims-book/chapter11-4.html

Isn't there a statute of limitations on such things? I looked up my state of Florida and there is one here. A lien expires after, if I remember correctly, 7 years. Don't they have to re-do the judgment before expiration of the statute of limitations or does it just continue in whatever state that was? If that lien was from 2010, that's 12 years! I should have listened to the end - you answered this.

Does this also apply to vehicles and property inside the house? My daughter owns the house. I really don't want her going through a lot of hassles when I am gone. Would it be best to put the car into her name also?

What happens if you simply walk away from a home that has a lien? Does that judgement follow you?

Depends on the lien, a judgment lien yes, but a mortgage lien no
