Every time I watch the updates about your divorce I realise that your divorce is way beyond just cheating and it would be naive for anyone (that heard your stories about him and your in-laws) to think that. The cheating was an 'out' for you from a highly toxic relationship, and I say this with all due respect but the way you described snakey is who your husband was to you. You were living with one in your house. You couldn't have stayed in a marriage with someone that seemed to have hated you the way he did. Owamie I have just one question as a sister: Did he receive the summons / divorce papers from the sheriff? In my understanding if he received the papers he has some days (30 or so) to provide a response to the court on whether he agrees to your settlement or not. And if he doesn’t respond within those days the lawyer or you can be able to apply for an uncontested divorce and the court will grant you without any issues. I would suggest that you visit a family court in order to get an advice on the matter. Family courts are free of charge and very helpful, but you should be patient because there will be lines to stand in. I know one efficient family court in Johannesburg (1655 Albertina Sisulu) not far from John Foster Police Station. Lastly, just remember that the longer the case takes the lawyer makes more money. I suspect some foul play in your case.

Why do you need the next person to sign in order to be free from a situation you no longer want to be a part of, especially if you don't want anything from them. One person wanting out of the marriage should be enough to grant the divorce especially when there are no kids nor obligations from either party. This is when there is a Settlement Agreement. If there is no agreement you can just serve the other party, if they don't pull through on their part (ie respond) you have avenues to just proceed and go to court for a divorcee decree. In this situation it's because they have a settlement agreement in place.

I went about my divorce process without a lawyer. I went to my Civil Law Court and filed for divorce. Had to take papers to the Sheriff to serve him. The Sheriff then stamped the documents as proof that he was served, he didn't have to sign anything. That took 2 months then everything just rolled from there onwards, the whole process took me 11 months. Yes, it takes long but it's way more cheaper than getting a lawyer.

Everyone around me knows me as this good person but as soon as I got with my ex boyfriend (father of my baby) he kept on telling me how bad of a person I was and I was like dude you are literally the only one that sees me like that. We ended up breaking up, his mother used to call and check on the baby now no one from that family checks on the baby even though we have opened doors and said they could check on the baby anytime. Serve him with Signed Summons and a Settlement Agreement via sheriff, and take the sheriff's return back to court. 2. He should serve you back with a Notice to defend within 10 days when you both live within the jurisdiction of the court or 20 days if you live in different provinces. 3. If the he doesn't defend the divorce after the lapse of those days, 4. Go back to court and Apply for the trial date, serve him again with the notice of trial date via sheriff and registered mail. 5. Take the sheriff's return back to court again and the registered mail slip. 6. On the day of the court/trial should he not pitch, your divorce will be granted in his absence because the proof of him (Sheriif's return) receiving the documents would be there.

True, she does not need to wait for him, my husband divorced his ex wife without her consent because it was taking long on her side the lawyers handled everything. Check your lawyers hope they are not wasting your time so that you can be paying them more.
But they need to put some more effort, which is concrete evidence in court that this person got papers, messages, emails, and even go to such extent to write on newspapers, then the court can favor her bcoz she tried her level best to reach him. Even these TH-cam videos can be evident.

Hi Owamie, I'm sorry that you are going through such a terrible divorce but thank God that you have this platform to let it all out because I'm sure it's a form of therapy (even though dealing with it publicly may not be ideal in some cases). Every time I watch the updates about your divorce I realise that your divorce is way beyond just cheating and it would be naive for anyone (that heard your stories about him and your in-laws) to think that. The cheating was an 'out' for you from a highly toxic relationship, and I say this with all due respect but the way you described snakey is who your husband was to you. You were living with one in your house. You couldn't have stayed in a marriage with someone that seemed to have hated you the way he did. His behaviour seems to also stem from his mom, he behaves like her but I'm glad that you realised that it wasn't your job to fix. I pray that you get your freedom and get your happily ever after. I hardly ever comment on these things because of the fine line between minding my own business and my opinion but just felt a need to say this after watching this video. You're also helping to open our eyes on the realities of some relationships because love can indeed blind us to horrors. Blessings!

Owamie I have just one question as a sister: Did he receive the summons / divorce papers from the sheriff?
In my understanding if he received the papers he has some days (30 or so) to provide a response to the court on whether he agrees to your settlement or not. And if he doesn’t respond within those days the lawyer or you can be able to apply for an uncontested divorce and the court will grant you without any issues.
I would suggest that you visit a family court in order to get an advice on the matter. Family courts are free of charge and very helpful, but you should be patient because there will be lines to stand in. I know one efficient family court in Johannesburg (1655 Albertina Sisulu) not far from John Foster Police Station.
Lastly, just remember that the longer the case takes the lawyer makes more money. I suspect some foul play in your case.

But Owamie as far as my legal knowledge stretches a divorce can be granted without the guys presence….I know many years ago lol my parents divorced similar situation but the magistrate granted the divorce to my mom. So I don’t know if the law around this maybe has changed now. I feel like the law is strange when it comes to divorce. Why do you need the next person to sign in order to be free from a situation you no longer want to be a part of, especially if you don't want anything from them. One person wanting out of the marriage should be enough to grant the divorce especially when there are no kids nor obligations from either party. This is when there is a Settlement Agreement. If there is no agreement you can just serve the other party, if they don't pull through on their part (ie respond) you have avenues to just proceed and go to court for a divorcee decree.
In this situation it's because they have a settlement agreement in place.

I went about my divorce process without a lawyer. I went to my Civil Law Court and filed for divorce. Had to take papers to the Sheriff to serve him. The Sheriff then stamped the documents as proof that he was served, he didn't have to sign anything. That took 2 months then everything just rolled from there onwards, the whole process took me 11 months. Yes, it takes long but it's way more cheaper than getting a lawyer.
It took about 2 months for me start to finish. I did it myself as well.

The process is longer, the partner need to be unknown where abouts, the news paper be out with the divorce details or so. Given some time to show up. Failing which it would be granted in absencia
I can relate when you say they told everyone that you were a bad person. Everyone around me knows me as this good person but as soon as I got with my ex boyfriend (father of my baby) he kept on telling me how bad of a person I was and I was like dude you are literally the only one that sees me like that. We ended up breaking up, his mother used to call and check on the baby now no one from that family checks on the baby even though we have opened doors and said they could check on the baby anytime. Maybe you can try this route, way cheaper than using lawyers.
1. Serve him with Signed Summons and a Settlement Agreement via sheriff, and take the sheriff's return back to court.
2. He should serve you back with a Notice to defend within 10 days when you both live within the jurisdiction of the court or 20 days if you live in different provinces.
3. If the he doesn't defend the divorce after the lapse of those days,
4. Go back to court and Apply for the trial date, serve him again with the notice of trial date via sheriff and registered mail.
5. Take the sheriff's return back to court again and the registered mail slip.
6. On the day of the court/trial should he not pitch, your divorce will be granted in his absence because the proof of him (Sheriif's return) receiving the documents would be there.

im no lawyer but i have something to say that might be helpful... you are in war and in the art of war the less your opponent knows about you the less accurate their plan of attack would be... its great that you find therapy in this and you want to warn your fellow sisters but if your opponent is watching too he knows which buttons to press coz u come on camera and you break down... the issue of an ID that you just mentioned might be obvious to you but it might have been out of his mind... the kind of money you mention on the cannel.. hes using all that info to farther hurt you. You have made it clear time and again that him signing the papers will give u the greatest joy and everytime u r close he moves the goal post.... my advice would be that make the videos, the personal ones and keep them to yourself for now...you can even make a big-ish production about it like podcast and chill did with the Zola episode, a lot of people are interested but doing them now i think is not a good idea.
