Under Indian law, if a woman has engaged in sexual intercourse with a man on the promise of marriage and the man fails to keep that promise, the woman may be able to file a rape case against the man. This is because, according to Section 375 of the Indian Penal Code (IPC), sexual intercourse without the woman's consent is considered rape, and consent obtained by fraud or misrepresentation is not considered to be valid consent.
In your case, if your girlfriend has filed a rape case against you on the grounds of false promise of marriage, the court will consider various factors to determine whether the promise was indeed false, and whether your girlfriend consented to sexual intercourse on the basis of that promise. These factors may include any explicit or implicit promises you made to her, her own understanding and belief about the promise, and any evidence that suggests you had no intention of fulfilling that promise.
If the court finds that you did make a false promise of marriage and your girlfriend consented to sexual intercourse on that basis, you may be charged with rape under the IPC. If convicted, you may face imprisonment for a term ranging from seven years to life, as well as a fine.
However, if you believe that your girlfriend has falsely accused you of rape, you have the right to defend yourself in court. You may be able to present evidence that proves that you did not make any false promises of marriage, or that your girlfriend consented to sexual intercourse without any such promise. You may also be able to argue that your girlfriend filed a false case against you out of malice or to extort money from you.
It is important to note that filing a false rape case is a serious offense under Indian law, and if you can prove that your girlfriend has made a false accusation, she may be subject to criminal charges.
In summary, if your girlfriend has filed a rape case against you for false promise of marriage, you may face serious legal consequences. Your best course of action is to consult with a qualified lawyer who can advise you on your legal options and help you defend yourself in court.

सर नमस्कार मैं पोलिस डिपार्टमेंट में सब इंस्पेक्टर के पद में कार्यरत हु एक महिला ने मुझ पर ०३ एफआईआर दर्ज कराए १ एफआईआर उसने २१ जुलाई २०२१ को दर्ज कराया की मैं महिला को वर्ष २०२० में दुर्ग में छेड़खानी करता था कोई डेट नही सिर्फ वर्ष २०२० ओर दुर्ग जो की जिला है स्थान भी नही है और १७ जुलाई को मुझे फोन में गली दिया मैं गिरफ्तार हुआ मेरी जमानत हो गई । वही महिला १५ दिन बाद दुबारा ६ अगस्त २०२१ को उसी थाने में दुबारा एक केस दर्ज कराती है की २१ जुलाई वाली एफआईआर में मैंने ये नही बताया था कि १७ जुलाई को फोन में छेड़खानी करने के साथ मेरे घर में घुसकर मारपीट किया था पुनः मैं जमानत लेता हु । उसके बाद वही महिला पुनः १५ दिन बाद ३ बार थाने में आती है और तीसरा रिपोर्ट दर्ज कराती है की मेरे साथ १७ साल बलात्कार किया है मैने तीनो में जमानत ले चुका हु प्रकरण न्यायलय में चल रहा है मै इतने सारे एफआईआर के बाद पूरी तरह टूट चुका हु मुझे इंसाफ कैसे मिलेगा और जो मेरे साथ ऐसा किया है उसके साथ मैं कौन से लीगल एक्शन ले सकता हु पुलिस पर विश्वास नहीं है मुझे क्योंकि महिला बहुत ताकतवर परिवार से है।

Man can be victim too, somewhat similar case happen with me in 2016 when i was pursuing my master in Delhi. I was with in relationship with a girl i met in school for 10 years but one day fine day in Feb 2016 everything turn upside down. By january 2016 i found out that she was cheating with me with one of her UPSC coaching mate the only thing i did wrong was that i love her so much that despite knowing about her cheating i was searching for a way to pacify our relationship. We used to chat in phone every night so when she was not picking up the phone for 3 days straight i got worried and went to her rent to enquire about it. But what shock me was that when i reach her place without explaining anything she was very rude to me and even started abusing me physically so i left her place since i dont want to create any ruckus and when to my university as my final semester exam was going on. But the next day in morning while i was still asleep some policemen call up my number and ask me to visit police station soon and finally when i reach station i found that she and her new bf who is from an influential family had file a FIR against me and charges includes stalking, physical assault, groping etc. I also got few slaps from the policemen in the name of assaulting girl. I stayed for 5-6 hours in lock up and missed my final semester exam. I was in lock up for 5-6 hours but the torments, pain and embarrsment still continues without any fault of mine after all i am still given the tag of predator by society and the people who file fake FIR against me are roaming freely with no punishment or regret. To cope with the pain i fall into alcoholism and ruin myself for more than 5 years but i am now 14 months sober and trying to stay positive. All i want is for the society not to be too judgemental soon without knowing the truth.
