Because every cop on scene is an idiot. Prior to 2012 the actual law was that you were required to keep “at least one hand on the handlebars.” But that requirement was removed in 2012. So now you can ride legally with no hands on the handlebars if you want, but there was NEVER a law that said you needed two hands on.

If it goes to court, ask the cop to testify how many other tickets he cited for riding a bike the wrong way on a sidewalk. I disagree, the second cop is merely helping him fill out the proper forms and only mentioning the the citation numbers pertaining because of the story the cop the first cop told the second cop. Opportunity to bridge the gap, wasted. Cost of free speech to cyclists, $64.50. Cost of free speech to taxpayers, 35 minutes for three LEOs, crusiers, court processing, court hearing costs, in the thousands. Risk to officers walking on a busy roadway. I'm not worried about the cops in the roadway. I'm worried about all the motorists the cops are unnecessarily putting in danger that have to veer towards oncoming traffic to avoid hitting the cops because they feel like hanging out and chatting in traffic. Cops can wander in traffic, it's by choice and the danger is self imposed. The poor motorists they needlessly endangered don't get a choice, I'm worried about them and the damage to their cars the officer's body would cause.
Also love how half the laws they look up have been removed from city ordinances. That speaks volumes. Nope - they can ride on sidewalk cause street is dangerous. Yes - they can take their hands off the handle bars because that's how you signal your turns (and redress your grievances).

He knew it was wrong, the second the officer mentioned flipping off, he looked right at the body cam to see.if it was on. Correct procedure then would have been to put him straight and let the cyclist go, but of course default behavior is cover up and persecute a member of the public

The officer just absolutely admitted the stop was for flipping him off. "The next time you want to flip off the police, make sure you are not violating any laws." So if Our Hero had not flipped him off, he would never have been stopped. And the officer should receive more training because he wasn't even sure how to write the ticket and what he could write it for. I sure hope Our Hero gives the officers some training in Federal Court for violating his civil rights.
Well, the difficulty in writing the ticket might be because 1) there's no law that requires you to have hands on the handlebars, 2) you are allowed to ride bikes on a sidewalk, and 3) sidewalks don't have a specific direction of travel. None of the things the cop wanted to cite him for were legit.
This officer illegally prolonged the traffic stop. He had to wait more than ten minutes for another officer to arrive to teach him how to manually write the ticket. See Rodriguez v. US, 575 U.S. 348 (2015).
I thought the same thing about the fake infractions he made up. And he can’t extend the stop because he forgot his ticket book. This is just America today. Laws only matter if the people who uphold them have integrity, and I haven’t seen that here.

That would make any further detention unlawful, a violation of rights under color of law which is a crime by state and federal law. If only the law was enforced and cops were criminally prosecuted. Now only the government can prosecute and the prosecutor has near absolute discretion over whether to prosecute or not. In fact, this cop can arrest or cite all he wants, but unless the prosecutor agrees to prosecute, nothing happens. Civil citations don't require the prosecutor generally but they can if challenged and taken to trial.

The last cop that arrived actually corrected Officer Besse on 2 of the 3 citations he wanted to write but then in the end conspired and went along with riding on the wrong side of the roadway without asking if the guy was ever in the roadway. The ticket will be dismissed, probably before the court date. All that will be left is to file a claim with the city for the civil rights violations.
I'm a cop and this man hurt my feelings, so I I stopped him and started throwing stuff against the wall, hoping something would stick. First, I said he didn't have both hands-on handle bars when he hurt my feelings. When I was informed, that's not a violation, I then try to say he was riding the wrong way. That didn't work either. I eventually wrote him a ticket for riding against the flow of traffic. There are no cars coming the opposite way on a sidewalk. I realize this, but at the time my feelings were so hurt that I couldn't use logic, and I had to try to extort this man for money because he hurt my feelings. I'm a cop and when cops get their feelings hurt they retaliate. When cops get their feelings hurt, they try to steal money. I initially tried to steal $300 from him, but I was only able to steal $65. When cops get their feelings hurt, they try to throw people in cages. It's what cops do. It's just us doing our jobs. You must remember that we are all heroes. Everyone watching my actions could only come to the conclusion that everything I did was heroic.

In Daytona it is illegal to do acrobatics on a bicycle or take both hands and feet off the bike. There is no bike lane so it is not illegal to ride on the sidewalk, and he only removed one hand, which has to be allowed for signaling a turn. These cops are retaliating for free expression. They are garbage.
@jackburton7062 - the small town I grew up in required registration of bicycle, with an annual registration fee and license plate. I got fined for "improper display" of the plate, as I didn't like how the plate was rattling around when dangling from the seat in the "intended" method of display, and instead bent the plate to wrap around the stem of the frame with a bit of pipe foam to avoid metal-on-metal contact. He threatened to fine me for "destruction of public property" as well, but decided he didn't want to take a kid to court over a $10 bicycle license plate.

it is but not all sidewalks are created equal....all states should allow bikes on sidewalks... there may be exceptions that should be clearly posted and based on safety... or have a bicycle lane... every road open to cars is open to bikes...with laws applying to type of road and easements available

On November 28th 2023 at approximately 10am in the City of Daytona Beach Florida our hero here was riding his bicycle in compliance with all State laws and local ordinances when he noticed two City of Daytona Beach Police Officers driving by in their cruisers. As the Officers drove by our hero exercised his right to free speech by flipping the Officers the bird. The City of Daytona Beach Officers responded by driving on the wrong side of the road head on into opposing traffic to stop our hero and detain him for almost 40 minutes in what was clearly an ego driven stop in retaliation for free speech. Our hero reached out to yours truly for help and through a public records request I have obtained the following body worn camera video.
I honestly don’t even think he will have to try that hard. A letter of intent to sue to the city laying out the case with the body am will more than likely produce a settlement because it is so egregious. I would hope that he puts some demands on the police department in his prayers for relief.

I'm not worried about the cops in the roadway. I'm worried about all the motorists the cops are unnecessarily putting in danger that have to veer towards oncoming traffic to avoid hitting the cops because they feel like hanging out and chatting in traffic. The officer just absolutely admitted the stop was for flipping him off. "The next time you want to flip off the police, make sure you are not violating any laws." So if Our Hero had not flipped him off, he would never have been stopped. And the officer should receive more training because he wasn't even sure how to write the ticket and what he could write it for. I sure hope Our Hero gives the officers some training in Federal Court for violating his civil rights.
Well, the difficulty in writing the ticket might be because 1) there's no law that requires you to have hands on the handlebars, 2) you are allowed to ride bikes on a sidewalk, and 3) sidewalks don't have a specific direction of travel. None of the things the cop wanted to cite him for were legit.
This officer illegally prolonged the traffic stop. He had to wait more than ten minutes for another officer to arrive to teach him how to manually write the ticket. See Rodriguez v. US, 575 U.S. 348 (2015).
I thought the same thing about the fake infractions he made up. And he can’t extend the stop because he forgot his ticket book. This is just America today. Laws only matter if the people who uphold them have integrity, and I haven’t seen that here.
If a judge doesn't throw it out and grant punitive damages to the Bike man it proves the judge is a corrupt revenue generator too.

The last cop that arrived actually corrected Officer Besse on 2 of the 3 citations he wanted to write but then in the end conspired and went along with riding on the wrong side of the roadway without asking if the guy was ever in the roadway. The ticket will be dismissed, probably before the court date. All that will be left is to file a claim with the city for the civil rights violations.

I'm a cop and this man hurt my feelings, so I I stopped him and started throwing stuff against the wall, hoping something would stick. First, I said he didn't have both hands-on handle bars when he hurt my feelings. When I was informed, that's not a violation, I then try to say he was riding the wrong way. That didn't work either. I eventually wrote him a ticket for riding against the flow of traffic. There are no cars coming the opposite way on a sidewalk. I realize this, but at the time my feelings were so hurt that I couldn't use logic, and I had to try to extort this man for money because he hurt my feelings. I'm a cop and when cops get their feelings hurt they retaliate. When cops get their feelings hurt, they try to steal money. I initially tried to steal $300 from him, but I was only able to steal $65. When cops get their feelings hurt, they try to throw people in cages. It's what cops do. It's just us doing our jobs. You must remember that we are all heroes. Everyone watching my actions could only come to the conclusion that everything I did was heroic.

In Daytona it is illegal to do acrobatics on a bicycle or take both hands and feet off the bike. There is no bike lane so it is not illegal to ride on the sidewalk, and he only removed one hand, which has to be allowed for signaling a turn. These cops are retaliating for free expression. I got fined for "improper display" of the plate, as I didn't like how the plate was rattling around when dangling from the seat in the "intended" method of display, and instead bent the plate to wrap around the stem of the frame with a bit of pipe foam to avoid metal-on-metal contact.
He threatened to fine me for "destruction of public property" as well, but decided he didn't want to take a kid to court over a $10 bicycle license plate.
@Starhawke_Gaming Yeah, those bicycle laws are absolutely ridiculous. I have known a few places with registration and plate requirements. Also, he can not get you for the destruction of government property, as you pay for the plates, they are yours, and you do not have to return them when you get rid of the bike. It is pathetic they wanted to harass a child over something so petty.

Don't forget the hazard they caused by blocking a lane of traffic and then unnecessarily wandering around in and near the one remaining lane. Hanging out beside the wrong side of the cruiser so motorists have to veer towards oncoming lanes just to avoid the cop casually hanging out. They have zero self awareness or appreciation for the danger they're causing. That's what you get from people who are very rarely properly held accountable for their actions.

it is but not all sidewalks are created equal....all states should allow bikes on sidewalks... there may be exceptions that should be clearly posted and based on safety... or have a bicycle lane... every road open to cars is open to bikes...with laws applying to type of road and easements available

So they wrote him a ticket for riding on the wrong side of the road, but he was on the sidewalk. He also said he was going to write him $300 worth of tickets but could only come up with one ticket for $64.

Love that the Sgt. checked to see if the body camera was on when he got out of his car. Entire squad is suspect when the Sgt. allows this retaliatory stop to continue. Suspend them all!

If the cop had a brain cell that sparks a thought he would drive on by and wave acknowledging the bird but but being affected by it, this would annoy the cyclist more as it suggests the bird didn't annoy the cop one bit.

On November 28th 2023 at approximately 10am in the City of Daytona Beach Florida our hero here was riding his bicycle in compliance with all State laws and local ordinances when he noticed two City of Daytona Beach Police Officers driving by in their cruisers. As the Officers drove by our hero exercised his right to free speech by flipping the Officers the bird. The City of Daytona Beach Officers responded by driving on the wrong side of the road head on into opposing traffic to stop our hero and detain him for almost 40 minutes in what was clearly an ego driven stop in retaliation for free speech. Our hero reached out to yours truly for help and through a public records request I have obtained the following body worn camera video.

I honestly don’t even think he will have to try that hard. A letter of intent to sue to the city laying out the case with the body am will more than likely produce a settlement because it is so egregious. I would hope that he puts some demands on the police department in his prayers for relief.
