Kano State CP Disobeys Governor Yusuf's Order; Says Police Won't Evict Ado Bayero from Palace

  • It's still a long walk from peace, regarding the battle over Kano Emirate. In another twist to the tussle, the Police have refused the request by Governor Abba Yusuf for assistance in evicting deposed Emir Aminu Ado Bayero from the mini palace he is staying in Nasarawa area of Kano. The State Commissioner of Police, Usaini Gumel, who gave reasons for ignoring Governor Yusuf’s directive on the eviction of the deposed Emir said, obeying the eviction order will be tantamount to jumping the gun. According to him, the same State Government that gave the order, had filed a case at the State High Court on the eviction order, which would come up on Monday, the 24th June.

      Why are you opposed to a private army funded and controlled by governors? What else do you want? Imagine a governor pays your salary, provides equipment, accommodation, healthcare and even free food and you don't need anyone to show which side the bread is buttered.

    The Court order shouldn't have been a restraining order, should have sought reversal of the enacted Law. The order came after the enactment was signed into Law. A restraining Court order should be served before the enactments were signed into Law, otherwise what was the order restraining? Legally, a Court order can not reverse a Law that was signed into existence. That has to be a serious judgement that would have to prove that the State House of Assembly lacks the power to enact that law or the governor lack the power to sign and accend to the Law by giving it life through signing. Unfortunately they have such powers. Infact, the Kano state house of assembly can decide to disban the practice of Emirate altogether and cancel all Emirates and once the governor has signed it has become law and the Emirate would be no more. It is strictly a state local affair.

      You're absolutely correct and should have been on that panel to educate Jide. Jurisdiction is paramount. Also, I agree with you that the law had taken effect prior to the hurriedly procured ruling from the "judge"... We need to compile names of these clowns called judges along with all the judgments attributed to them, in making the case for their "Rawlings" treatment.

      And he applied everything upside down. All the Emirs that approached FHC got judgement on their banishment, which borders on fundamental human rights, and which jurisdiction lies with the FHC or any Court for that matter. No FHC returned a dethroned Emir or dethroned an Emir. No such thing. Only peripheral issues of fundamental human rights were addressed. It lack jurisdiction under our Constitution to dethrone or return a dethroned Emir or appoint an Emir. That's strictly a State and Local Gov't matter that rests with the State High Courts in terms of jurisdiction.

    Take note Sanusi Lamido got judgement on his banishment. That's fundamental right infringement. The fact that he won doesn't mean he can return to the throne. He won on his right to freedom of movement, which Federal Court has jurisdiction over.
    2nd, peruse the copy of the Court judgement. The judgement was imposing the Court order of the 23rd. Received by Head of Litigation on the 27th. The filing of the order was done by Aminu Baba Dan'agundi albeit after the abolishion of the Emirates and the appointment of Sanusi was done over with and already signed into Law. A Court order cannot take down an enacted and duly signed Law. It has to be a proper judgement.
    3rd, the Judge passed judgement enforcing the court order given. Saying all activities done in negation of the Court order in relation to the appointment of Sanusi as Emir is null and void. The Court order was terribly belated. No any Emir was appointed after the Court order. Aminu Bayero badged into Kano after the Court order, raising tension, making Kano Emirate a 2 Emir throne by his action. Nobody was looking at that. He should have remained where he was until after judgement is delivered.
    4th, a Federal High Court can address peripheral issues pertaining to human right abuse as it affects an appellant but cannot dethrone or crown an Emir, that's strictly state and local affair rested with the State High Court.
    5th A peripheral issue in a litigation can never take the place of the main subject of litigation. FHC can give Order or judgement to stop Ejection or banishment for instance, as it borders on human rights, but it can NOT dethrone an appointed Emir or appoint an Emir. That's Chieftancy matters and it's under State and local Gov't which jurisdiction also lies with State High Courts as far as Nigerian Constitution is concerned.
    All the cases you sighted, about Sanusi approaching a FHC were to do with his banishment which trampled on his freedom of movement rights.
