This appeal considered whether West Beach, Newhaven, should be registered as a town or village green under s.15 of the Commons Act 2006. The appellant owns an area of sand within the port of Newhaven known as West Beach, Newhaven ("West Beach") and operates Newhaven Port. On 18 December 2008 the first respondent received an application from the second respondent to register West Beach as a town or village green. The appellant objected, and following an inquiry the first respondent resolved to register the site. The appellant applied for judicial review of the first respondent's decision.
The Supreme Court unanimously allows the appeal.
